JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

The Defense Logistics Agency – Warren (DLA – Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C.

2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

PART I - Description of Item Required:

PART II - Technical Information and Certification

1. The US Army TACOM LCMC requires the acquisition of the above item. The only approved source(s) for the above item is (are):

2. Reasons the item is not suitable for full and open competition:

a. Status of the Acquisition Data: At this time, the two vendors listed in paragraph 1 above are qualified to build the Tow Lift elevation motor. While the Government has the Critical Product Item Spec listing the Qualification procedures (12292189, rev J), it is estimated that qualification of another vendor would take an additional year and cost an additional $1,000,000. With the limited quantity being purchased, and the low unit cost, the cost for qualification of a third vendor would never be recovered.

b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement: As stated in paragraph 2a above, the costs associated with qualifying another source would exceed any reasonable expectation of cost savings from competition given the quantities being purchased.

If the Government did try to compete this requirement, it is important to understand that the above time and cost estimate does not take into consideration any margin for failure or delay in the process of qualifying a new vendor or the subsequent year plus delay in production. This delay would potentially lead to a much higher number of Bradley Fighting Vehicles that would have degraded tow missile launcher capability.

c. Demonstration of Approved Contractor's Unique Qualifications:

The Contractors listed in paragraph 1 above are both presently qualified to produce this item, and have built and fielded the motor for the entire Bradley fleet to include new production and spares of all 12292401 motors in existence used by the U.S. Army to date, meeting suspense dates over the life of the program.

d. Efforts to Qualify Additional Suppliers for future procurements:

No contractors are in the process of becoming qualified, and no other contractor would be able to provide qualified spares in a reasonable time frame given program funding restraints and the estimated time line in 2a above.

e. Market Research:

Market research was performed on 14 April 2017. ARDEC-Rock Island conducted computer based market research on the TOW Lift Motor and Bradley Fighting Vehicle and did not yield any information about new production sources for this item. There are no other commercial or non-developmental items available to meet the Government's need or that could be modified to meet the Government's need that interfaces as necessary in the A2, A2-ODS, A3, M7-SA BFIST and ODS-SA BFVS Turrets operating under extreme environmental conditions on a battlefield anywhere in the world.

Additionally, to date, no additional contractors have expressed an interest in this item in writing to this office.

PART IV - Contracting Information

1. Description of Action: The required item will be solicited on Request For Proposals SPRDL1-17-R-0335. It is proposed to negotiate a Firm-Fixed-Price contract with either of these vendors:

The costs associated with qualifying another source would exceed any reasonable expectation of cost savings from competition given the quantities being purchased.

2. Efforts to Obtain Competition: Although this procurement will be restricted to the above source(s), every effort will be made to obtain potential sources by synopsis through the FedBizOpps system.

3. Interested Sources: A sources sought synopsis submitted to FedBizOpps on 09/29/2017. To date, no other sources have expressed a written interest in the acquisition of this item. Should potential sources respond to the synopsis in FedBizOpps, they will be evaluated by the appropriate engineering office as an alternate source.

5. Fair and Reasonable Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable.

The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary. Due to the value of the procurement, certified cost and pricing data is required.
