JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

The Defense Logistics Agency – Warren (DLA – Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

Acquire, for the second or subsequent time, directly from the actual manufacturer.

EXPLANATION of AMSC H: The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source(s). This code is applicable only to parts under immediate buy requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different AMSC. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

PART II - Technical Information and Certification

1. The US Army TACOM LCMC requires the acquisition of the above item. The only approved source is:

2. Reasons the item is not suitable for full and open competition:

a. Status of the Acquisition Data: There is insufficient technical data at this time to support competitive purchasing of the DSESTS item listed above. Additionally there is no process underway, or funding available by which technically sufficient data can be obtained in a responsible time frame.

b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement: To date the Government has not purchased sufficient data from DRS Test & Energy Management regarding the present design by which these items may be competed. The Government does not have funding to purchase or develop competitive data. The Government estimates that the development of competitive data will take 104 weeks and $75,000 to reverse engineer these items and an additional $7,500,000 and 104 weeks in order to qualify a new vendor.

c. Demonstration of Approved Contractor's Unique Qualifications: This item, designed and developed by DRS NCTS, has passed all Army required testing for use on the electronic assemblies of all variants of the Abrams Tank and the Bradley Fighting Vehicle. DRS also has historically manufactured and supplied this item and the assemblies it goes into as well as all the spares for this item.

d. Efforts to Qualify Additional Suppliers for future procurements: Based on the reasons stated in 2b above, and because of the forecasted absence of any future cost savings due to anticipated low purchase quantities, it is not cost or time effective for the Government to develop the technical data package required for this spares procurement.

e. Market research: The Government does not possess or have rights to the technical data defining in a technically adequate manner the form fit, function and interoperability of the circuit card being purchased. On 29 December 2016, the POC below conducted an internet search for “Circuit Card Assembly”. Several hits were returned, but without the necessary technically discerning information available needed to perform a technical comparison of Form, Fit and Function they could not be legitimately evaluated.

5. Fair and Reasonable Determination: I hereby determine that the anticipated cost for this contract action will be fair and reasonable. DLA Land Warren will use the appropriate acquisition procedures and price and/or cost analysis to determine that the contract price is fair and reasonable. NSN 6150-01-555-8457 has been determined to be non-commercial item through market research. Due to the dollar value not exceeding $700,000.00, other than Certified Cost or Pricing Data will be obtained in accordance with FAR 15.403-1.
