DEFENSE LOGISTICS AGENCY J&A: SPRDL1-16-R-0409
PART II - Technical Information and Certification:
1. The United States Army TACOM Life Cycle Management Command requires the acquisition of the above item. The only approved source for the above item is:
a. Contractor Name: MTU AMERICA
39525 MACKENZIE DR
NOVI, MI 48377
CAGE Code: 72582 MFG Part Number: 5199418 MIL Part Number: 2815-01-120-5985
2. Reasons the item is not suitable for full and open competition:
a. Status of the Technical Data Packages (TDP):
(1) This item is source controlled to MTU America, Inc. The engine block assembly is part of the 8V71T engine for the M109A6 self-propelled howitzer and the M992A2 Field Artillery Ammunition Supply Vehicle (FAASV). The Government does not have detailed drawings that are necessary for competitive procurement.
(2) MTU has developed, tested, and obtained the Government's approval of this engine block. The Government did not fund MTU’s efforts in development and qualification testing of this item. Additionally, the Government did not fund the preparation of the fully detailed TDPs after approval. As such, MTU is the sole owner of the drawings and technical data rights; and the Government does not have proprietary rights to the TDP that would be required to produce a competitive TDP.
(3) The Government does not own the patent rights to MTU’s data which would be required to produce a competitive TDP.
b. Efforts to Develop a Competitive Package:
(1) There are no current plans to develop or acquire a competitive TDP. This item is critical to functioning of the engine. The cost to either reverse engineer the assembly or develop a new assembly is estimated at ;
developing a TDP for this item would take about 48 months. The engine block is a very large and complicated machined casting. In addition to the large holes for the cylinders, there are passages for coolant and for oil.
These passages are essential for proper cooling and lubrication. Porosity in power. Failure of this item could render the engine inoperative and the vehicle not mobile under its own power.
d. Efforts to Qualify Additional Suppliers
(1) No vendors are in the process of being qualified at this time, nor will be prior to the contract award due to funding constraints.
(2) At this time, there are no current or planned efforts to qualify additional sources due to the fact that there is no technical data available to produce a competitive TDP. Any new source would be required to reverse engineer the block and then pass extensive first article/validation testing at the component and vehicle level. Vehicle testing is required to ensure that an additional supplier obtains the same performance levels (function, safety, RAM-D, etc.), as those produced by MTU. The additional time required for these actions would preclude the delivery of the items in a time frame that would satisfy the Government’s needs.
(3) Any new vendor who decides to pursue the qualification process will be directed to the Competition Advocate's Source Approval Program. The Competition Management Office (CMO) will encourage interested parties to submit a Source Approval Request (SAR) for this item for future buys.

PART IV - Contracting Information:
1. Description of Action: The required item will be solicited on Request for Proposal SPRDL1-16-R-0409. It is proposed to negotiate a Firm-Fixed-Price contract with MTU and/or authorized suppliers for their part number 5199418. Rationale for restriction: The item is limited source controlled to MTU, and/or its suppliers because the Government does not have drawings that are suitable for competitive procurement. MTU developed, evaluated, and obtained the Government’s approval of the Engine Block Assembly.
The Government did not fund MTU’s efforts to develop and test the kit; nor did the Government fund MTU to prepare a fully detailed Technical Data Package. Therefore, MTU is the sole owner of the drawings and technical data rights; and the Government does not own proprietary rights or patent rights to the TDP which would be required to produce a competitive TDP.
2. Efforts to Obtain Competition: Although this procurement will be restricted to the above source every effort will be made to obtain potential sources by synopsis through the FedBizOpps system.
3. Interested Sources: To date, no other sources have expressed a written interest in the acquisition of this item. As a result, DLA-Warren Contracting Office requested Sources Sought Synopsis be published to Fed Biz Opps on 23 December 2016. Should potential sources respond to the synopsis in FedBizOpps, they will be evaluated by the appropriate engineering office as an alternate source.
4. The POC for this action is , OFFICE SYMBOL: ZGBA, Ext. .
5. Fair and Reasonable Determination: I hereby determine that the anticipated cost for this contract action will be fair and reasonable. Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. Other than Certified cost and pricing data will be required to justify price reasonableness.
