JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

DLA Land Warren is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

PART I - Description of Item Required:

l. AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of

DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

PART II - Technical Information and Certification

1. The US Army Tank-automotive and Armaments Command requires the acquisition of the above item. The only approved source for the above item is:

2. Reasons the item is not suitable for full and open competition:

a. Status of the Acquisition Data:

TACOM-Warren possesses a drawing for the Circuit Card Assembly, drawing #19207- 12347123, however, the Government does not have drawings for this item that are suitable for competitive procurement. The Circuit Card Assembly, Prime Power Interrupter is part of the M1A2’s Hull Distribution Unit Assembly, drawing #19207- 12388880. The TDP is fully defined, but the government does not have full data rights because of the following:

(1) The approved source, Borisch Manufacturing, developed, tested, and acquired the Government's approval of this item for application to the M1A2’s Hull Distribution Unit Assembly at their own cost. The government did not fund their efforts in developing and testing this item. Although there is a fully developed TDP, Borisch Manufacturing has the manufacturing processes and expertise to perform-and successfully pass the First Article Testing (FAT) requirements for the Circuit Card Assembly, Prime Power Interrupter. The Government does not own proprietary rights to Borisch’s Manufacturing processes, which gives them the expertise to meet and perform the FAT requirement.

(2) The Government does not own the patent rights to BORISCH Manufacturing’s processes that would be required to produce a competitive TDP. Borisch Manufacturing is the sole owner of their specialized equipment, process sheets, and technical data rights. The Government does not own the rights to this data.

b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement:

(1) Currently, there are no plans to acquire the necessary manufacturing process sheets. These manufacturing process sheets are Borisch Manufacturing’s proprietary information and the government does not have funding that is necessary to purchase them. At present, Borisch Manufacturing has the requisite technical and engineering expertise to perform all efforts required to provide the supplies and services identified in this J&A. A significant amount of time and money would be necessary to reverse engineer, procure and test prototypes, and release the design. Through our previous experience, we estimate that the cost to develop a competitive package for this item through reverse engineering could run as high as $350K and could require an estimated delay of at least twelve months to include fabrication and testing of the prototype hardware, and releasing a validated TDP. Added to these costs and delays would be the cost and times involved to test and qualify another source. Vehicle testing is required to assure the Circuit Card Assembly, Prime Power Interrupter is compatible with the mating Driver’s Instrument Panel components. Vehicle test costs include vehicle preparation, inspection, storage, data collecting, test & evaluation reports, documenting performance, report & documentation distribution and hardware disposal.

Qualification and durability testing would be required to prove out this item manufactured by new source(s) at an estimated cost of an additional $300K and delay of 6-12 months. Borisch Manufacturing has the appropriate equipment, specialized knowledge, and engineering expertise to manufacture the Circuit Card Assembly, Prime Power Interrupter to meet the manufacturing processes and FAT requirements. Since the government does not have proprietary rights to Borisch Manufacturing’s manufacturing processes, enabling them to perform and meet the FAT requirements, the government would not be capable of helping another source develop their manufacturing process. The government could attempt to reverse engineer the manufacturing processes, but there would be an estimated delay of ~2 years. This delay would severely impact the availability of the Circuit Card Assembly, Prime Power Interrupter for application on the M1A2’s Hull Power Distribution Unit Assembly. Due to lack of funding and the urgency of the item requirement, the Government would not be able to conduct reverse engineering effort at this time. Additionally, this component is critical to M1A2’s vehicle readiness status. To do other than advised above would create a high risk situation that may lead to the premature failure of this item in the field which could result in the loss of the vehicle system.

(2) If the Government conducts the efforts to allow the procurement to become competitive, an unacceptable delay of at least 18-24 months is likely to occur. This delay would adversely impact the Army's readiness rate.

c. Demonstration of Approved Contractor's Unique Qualifications:

(1) The approved source, Borisch Manufacturing, is the sole owner of their technical data rights. The Government did not buy proprietary rights to Borisch

Manufacturing’s specialized tooling & manufacturing processes required to manufacture the Circuit Card Assembly, Prime Power Interrupter.

(2) Only Borisch Manufacturing has the requisite technical and engineering expertise to perform all efforts required to provide the supplies and services identified in this J&A.

This item is a part of a major component of a highly specialized piece of equipment.

Since, the Circuit Card Assembly, Prime Power Interrupter is electronic equipment; it contains electrostatic discharge sensitive components. Therefore implementation of an electrostatic discharge control program for protection of electrical and electronic parts, assemblies and equipment shall be in accordance with MIL-STD-1686 and DOD-HDBK-263, Class I. The item also contains nuclear hardness critical items marked HCI. The TARDEC Engineering Activity responsible for Nuclear Survivability must evaluate all changes to, or proposed substitutions of HCI, or changes to the electrical circuit and/or components for nuclear hardness impacts prior to implementation. Borisch Manufacturing has demonstrated their ability to meet these critical and complex requirements for the Circuit Card Assembly, Prime Power Interrupter made from their manufacturing processes. The approved source has passed extensive First Article/Validation testing at the component and vehicle level.

The approved source has met the drawing requirements and test to produce the Circuit Card Assembly, Prime Power Interrupter for application to the Hull Power Distribution Unit Assembly.

(3) The approved source identified above has demonstrated the unique and proven manufacturing capabilities to establish and maintain the processing control required to repetitively produce this item. Also, the item has been proven acceptable through extensive vehicle and nuclear hardness testing. An award to any other source would cause a substantial duplication of cost to the Government not expected to be recovered through competition and would cause unacceptable delays in fulfilling the agency’s requirements. Qualifying a new source would require a substantial expenditure. A new source would require tooling adjustment and development of extensive manufacturing processing procedure. The additional time required for these actions would prohibit delivery of the item in a time frame that would meet the Government’s requirements. The item required is mission critical in that a failure of this item during operation in an M1A2 Tank would cause extensive and extremely costly damage.

d. Efforts to Qualify Additional Suppliers for future procurements:

(1) No vendors are in the process of being qualified at this time, nor will be prior to the contract award due to funding constraints.

(2) At this time, there are no current or planned efforts to qualify additional sources due to the fact that there is no technical data available, nor are there any funds available to conduct the extensive (costly and time consuming) qualification testing requirements.

(3) Currently, there has not been any expressed interest by any known vendor(s) to become qualified source(s) to produce this item.

(4) Any contractors interested can seek approval through the Source Approval Program with the Competition Advocate.

e. Market Research:

Market research for this item "Circuit Card Assembly, Prime Power Interrupter”, PN 12347123 was conducted on 25 January 2016. Vendors interested in competing on any items listed are instructed to contact the Competition Advocate's Office. Market research was performed by by reviewing vendor catalogs and available product literature published by similar manufacturers, distributors and dealers to see if any other sources exist and to determine if commercial items or non-developmental items are available to meet Government's needs or could be modified to meet the Government's needs. A “Sources Sought Synopsis" was posted to FBO by on 22 Apr 2016. To date, no contractors have expressed an interest in this item.
