JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
The Defense Logistics Agency (DLA Land – Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

l. ACQUISITION METHOD SUFFIX CODE: B - This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained.
PART II - Technical Information and Certification
1. The US Army TACOM LCMC requires the acquisition of the above item. The only approved source for the Control Motor, part number 12488794 is:

2. Reasons the item is not suitable for full and open competition:
a. Status of the Acquisition Data:
Part number 12488794 is used on the Abrams mine clearing blade. Royal Electrical Services, Inc. is the sole owner of the drawing and technical data rights. The Government does not own proprietary rights to the technical data that would be required to produce a competitive technical data package (TDP). The above identified supplier has developed, tested and obtained Government approval for this item for application to the M1 Abrams Vehicle system at his own cost. The Government did not fund the vendor’s efforts in developing and testing this item.
b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement:
Control Motor, PN 12488794 is used on all mine clearing blades for all Abrams variants.
It functions as the main component, used in tandem with an identical motor (two per mine blade) to provide power to the lifting mechanism in order to raise and lower the blade. It is an integral part of the mine clearing blade system. This motor used in conjunction with a speed gear assembly prevents the blade from lowering too rapidly. In order to qualify additional vendors, a significant amount of time and money would be necessary to reverse engineer, procure and test additional prototypes before releasing the TDP. This delay would severely impact the availability of the Control Motor in the field for mine clearing use. This Control Motor is critical to Abrams vehicle readiness.
Through our previous experience, we estimate that the cost to develop a competitive package for this critical item through reverse engineering would cost about $200K and would require an estimated delay of at least 12 months. In summary, the cost to reverse engineer the current design, conduct laboratory testing, fabricate 6 prototypes and conduct vehicle durability testing in accordance with section 3.13.2 of MIL-PRF- 53090A would cost an additional $200K and take approximately 12 Months. To do otherwise would pose high risk, as a premature failure of this item in the field would result in the inability to raise or lower the blade for mine clearing operations. Testing would also surface defects that could adversely impact the readiness of the equipment and Operational and Support (O & S) Costs. These stated costs would be very difficult to be recouped through subsequent competition and the consequential time delay for this effort is unacceptable to meet the Government's requirements.
c. Demonstration of Approved Contractor's Unique Qualifications:
Only the vendor listed on drawing No. 12488794 has the requisite technical and engineering expertise to perform all efforts required to provide the item identified in this J&A. The current supplier has qualified in accordance with all the necessary test requirements and performance parameters shown in specification MIL-B-53090A (Performance Requirements for Mine Clearing Blade System). The subject component 12488794 shall be designed to have mean time between failures of at least 80 hours, exclusive of failure caused by mine detonation. A failure of the motor will make raising the mine clearing blade impossible thus making the vehicle unable to proceed with its mission function. The approved source identified above has demonstrated the ability to establish and maintain the processing required to produce this item. An award to any other source would cause a substantial duplication of costs to the Government not expected to be recovered through competition and would cause unacceptable delays in fulfilling PM Armored Brigade Combat Team fielding requirements. Qualifying a new source would also require a substantial expenditure of the limited funding that has been provided to support the STS contract. Any new source would require funding for the research and development of extensive processing procedures involved. Since the current contractor currently owns all the data for this item, the additional time required for these actions would preclude delivery of the items in a time frame that would meet the Government's requirements.
d. Efforts to Qualify Additional Suppliers for future procurements:
At this time, there are no current or planned efforts to qualify additional sources due to the fact that there is very limited technical data available for part No. 12488794 (Control Motor) nor are there any funds available to conduct the extensive (costly and time consuming) qualification testing requirements. Furthermore, any new source would be required to pass extensive validation testing of this item as those produced by the current vendor. The additional time required for these actions would preclude delivery of the Control Motor in a time frame that would satisfy the Government's needs.
Contractors interested in producing this item can seek approval through the Source Approval Program with the Competition Advocates Office.
e. Market Survey:
This item “Control Motor” appears on The Competition Advocate Shopping List dated 3 Jun 2015. A Sources Sought Synopsis was requested by DLA land – Warren on 22 Jul 2015. Contractors interested in competing on any item listed are instructed to contact the Competition Advocate’s Office. While other sources are available to produce a similar item, none of these sources have produced this specific item for military application, and none have completed the necessary testing to become a qualified source. Funding and information for this item to conduct the necessary qualification testing is not available. Market research was performed by reviewing vendor catalogs and available product literature published by similar manufacturers, distributors and dealers to see if any other sources exist and to determine if commercial items or non-developmental items are available to meet Government’s needs or could be modified to meet the Government’s needs, but no such items were found. Thus to date, no contractors have expressed an interest in these items

PART IV - Contracting Information
1. Description of Action: The required item will be solicited on Request for Proposals SPRDL1-15-R-0360. It is proposed to negotiate a firm fixed-price contract with Royal Electrical Services, Inc. for its part number 45-0329W026. This vendor is currently the only approved source for this Motor. No competitive technical data is available.
2. Efforts to Obtain Competition: Although this procurement will be restricted to the above source, every effort will be made to obtain potential sources by synopsis through the FedBizOpps system.
3. Interested Sources: To date, no other sources have expressed a written interest in the acquisition of this item. Should potential sources respond to the FedBizOpps synopsis, they will be evaluated by the appropriate engineering office as an alternate source.

5. Fair and Reasonable Determination: I hereby determine that the anticipated cost for this contract action will be fair and reasonable. The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary. Certified cost and pricing data will not be obtained based on the estimated dollar value falling below the $700,000 certification threshold.
