DEFENSE LOGISTICS AGENCY
JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
The Defense Logistics Agency – Warren (DLA-Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (2), as implemented by FAR 6.302-2, “Unusual and Compelling Urgency.”
PART I – Description of Item Required:
The requirement included on this J&A is one hundred fifteen (115) spare parts, referred from herein as “AMS vehicle items,” in support of sustainment efforts for the Medium Mine Protected Vehicle Type II (MMPV TYPE II). The estimated amount of this Firm- Fixed-Price contract is $562,005.00 and Army Working Capital Fund (AWCF) funding will be utilized. The identification of the particulars of this action is provided below:

PART II - Statement of Urgency
1. TACOM has an urgent need for the items described above. They must be procured by the quickest means possible since full and open competition will not achieve the required delivery date. The rationale for citing urgency follows:
a. Describe the Urgent Requirement:
There is an urgent need for these lighting kits. This urgent requirement was first known in April 2015 and approval to purchase was granted in May 2015.
The MMPV TYPE II lighting kits is needed to support a depot RESET/RECAP production line at Letter Kenney Army Depot (LEAD). The wiring for the kit must be installed during production and failure to obtain this kit will result in a production line stop which will increase production costs to the Program Office, as well as delay the fielding of the MMPV TYPE II vehicle is US Army Engineering Route Clearance Units.
Currently, the MMPV TYPE II vehicle program is the number one priority system for the US Army Engineering Command. Failure to meet program fielding schedules will have an adverse impact on the Combatant Commander’s ability to perform the US Army Engineering Route Clearance mission. The MMPV TYPE II vehicle has proven beyond a doubt that it is a force multiplier and effective in its mission Truck Lite Co.,. Route Clearance Units are first to deploy and remain in combat support roles throughout all operations. Sustaining the readiness of a US Army Engineering Route Clearance Units is a force protection issue that has visibility at the highest levels within the Department of Army.
The Army requires this quantity as soon as possible to meet current vehicle production schedules at LEAD and Truck Lite is the only source of supply for this lighting kit. The US Government does not own the TDP rights to this design.
The Government did not procure rights to the MMPV TYPE II vehicle design or rights to the design of the crucial sustainment components, such as this Lighting Kit. Therefore, at the present time, only Truck Lite has the technical data necessary to manufacture and deliver the MMPV TYPE II lighting kit to meet critical stock demand.
b. Justify the proposed delivery schedule:
This asset is for the Lighting Kit on the Assured Mobility Systems MMPV TYPE II.
TACOM’s current stock level is zero due to this being a newly provisioned item with a long lead time. There is a long term contract (LTC) currently out for solicitation.
Delivery for this contract is not expected until fourth quarter of fiscal year 2016. This is not sufficient to meet the immediate production line stopping requirements at LEAD.
c. Describe the extent and nature of the harm to the Government if the proposed delivery date is not met:
1. What is the serious injury (financial, harm to soldier, etc.) to the
Government if the required delivery dates are not met?
A delay in availability of the MMPV II Lighting Kit would result in a production line stop at LEAD and would seriously jeopardize the Product Office’s ability to field the MMPV TYPE II to US Army Engineering Route Clearance Units in accordance with Department of Army directed scheduled. The lack of vehicle ability would result in an increased risk to soldiers who will not have the required equipment to perform and complete a Route Clearance Missions supporting critical training events and potential operational missions.
2. What impact would this have on the Army’s mission?
Failure to meet program fielding schedules will have an adverse impact on the Combatant Commander’s ability to perform the US Army Engineering Route Clearance mission. The MMPV TYPE II vehicle has proven beyond a doubt that it is a force multiplier in saving the lives of Soldiers in a wartime environment. Route Clearance Units deploy early and remain in combat support roles throughout all operations.
Sustaining the readiness of a US Army Engineering Route Clearance Units is essential to force protection and has visibility at the highest levels within the Department of Army.
3. What financial impact would this have on the Government and how was this dollar value assigned? Explain the basis for cost estimates.
Any vehicles that do not have the lighting kit installed during production will require rework prior to delivery. The rework effort will be approximately an 8 hour task per truck and result in an increase Unit Funded Cost per vehicle of approximately $1,040 per vehicle (total cost $119,600). Additionally, there will be a storage cost for the vehicle as it awaits the kit installation. This storage cost is project to be $115.00 per month, per truck. Increased fielding cost will also be incurred by the Product Office, as Materiel Fielder and New Equipment Training teams will be placed on hold awaiting vehicle availability for fielding. These delayed fielding costs are projected to be approximately $10,000 per month. It is estimated there will be at least an 8 to 12 month gap in lighting kit availability through the normal procurement process. Therefore, there is a projected cost of $351,850.00 if an urgent procurement is not approved.
Unit Funded Cost Increase: 115 vehicles x $1,040 = $119,600.00 Storage Cost: (115 vehicles x $115) x 10 months (avg) = $132,250.00 Fielding Cost: 10 months (avg) x $10,000= $100,000.00 Total Potential Average Cost: $351,850.00
4. This is a new kit, individual kit parts have not been provisioned yet and are not available to purchase. No other items are available at this time to fill the requirement.
d. Urgent circumstances requiring the inclusion of an option: N/A

PART III - Contracting Information

1. Description of Action: Offers to provide the required item will be solicited under Request for Proposals SPRDL1-15-R-0316. It is proposed to negotiate a Firm-Fixed- Price contract with Truck Lite Co., Inc. (DBA Signal Stat Product Line CAGE 13548) for its part number 07630.
2. Extent of Competition: Due to the urgency of this buy, no further action will be taken to increase competition on this buy. No market survey will be conducted. Further, the procurement will not be synopsized due to the urgency of the requirement.
There is a pending long term contract for the Lighting Kit but the current lead times are too long to meet the depot production line requirements.
Truck Lite is the only source of supply for the required part as there is no available provisioning data. The Government did not procure rights to the MMPV TYPE II design or rights to the design of crucial sustainment components, like the Truck Lite lighting kit.
Therefore, at the present time, only Truck Lite has the technical data necessary to manufacturer and delivery the MMPV TYPE II lighting kit.

4. Fair and Reasonable Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. Based on the estimated dollar value, certified cost and pricing data will not be required as the contract is expected to fall under the threshold identified in FAR 15.403-4.
