DEFENSE LOGISTICS AGENCY

JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

The Defense Logistics Agency (DLA Land – Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

PART I - Description of Item Required:

k. ACQUISITION METHOD: 3—Acquire, for the second or subsequent time, directly from the actual manufacturer.

l. ACQUISITION METHOD SUFFIX CODE: B--This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained.

PART II - Technical Information and Certification

1. The US Army TACOM LCMC requires the acquisition of the above item. The only approved source for the above item is:

2. Reasons the item is not suitable for full and open competition:

a. Status of the Acquisition Data:

The customized Redesigned Turret Networks Box (RTNB) Slipring Cable 1W610-E (P/N: 12992442) is an integral part of the Embedded Diagnostics (P/N: 12992628) which is a vital part of the Redesigned Turret Networks Box (RTNB) used on M1A1 US, AUS, EGYPT, IRAQ Abrams Tank; M1A2S Abrams Tank.

The Government has limited rights in accordance with DFARS 252.227-7013 and 7017;

however; the Technical Data Package (TDP) acquisition production specification data is not fully defined and not suitable for full and open competition. The unique military grade Redesigned Turret Networks Box (RTNB) Slipring Cable 1W610-E was developed, designed, built, and tested at DRS Test and Energy Management’ s expense. This item is proprietary to DRS Test and Energy Management, who is the actual (or original equipment) manufacturer.

Thus, the Government does not own a competitive TDP for this item, and no other contractor can viably provide this item to be used on the M1A1 Abrams Tank.

Based on the above information, sole source procurement to DRS Test and Energy Management is the only method of procurement currently available to insure supportability of fielded vehicles.

b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement:

There are no current plans to acquire a competitive TDP because funds are not available to acquire the data necessary to support a competitive acquisition. In addition to not having the information necessary to develop a competitive TDP, ARDEC-RI engineer estimates that the cost to develop a competitive package for this item through reverse engineering, qualification procedures and engineering analysis are listed below:.

* Redesigned Turret Networks Box (RTNB) Slipring Cable 1W610-E:

Estimated costs associated with reverse engineering: $300,000 Estimated time associated with reverse engineering: 24 months

Estimated costs associated with the development of qualification procedures: $200,000 Estimated time associated with the development of qualification procedures: 12 months

Estimated costs associated with the conducting engineering analysis: $200,000 Estimated time associated with the development of qualification procedures: 12 months

The aggregate cost of reverse engineering; writing the qualification procedures, and conducting an engineering analysis would be at least seven hundred thousand dollars ($700,000) which would not be recovered through subsequent competition.

The aggregate delay in the acquisition process for reverse engineering Redesigned Turret Networks Box (RTNB) Slipring Cable 1W610-E; the preparation of qualification procedures and for the engineering analysis to determine if a new source met the qualification procedures is at least forty-eight months. A delay of this scale is unacceptable in fulfilling the army’s requirements and would have significant detrimental impact on the army’s ability to support the soldier in the field.

Note: This would not be a Government funded reverse engineering effort for Redesigned Turret Networks Box (RTNB) Slipring Cables 1W610-E available, since funding is not available..

c. Demonstration of Approved Contractor's Unique Qualifications:

DRS Test and Energy Management has the unique experience with the DRS Test and Energy Management required to meet the requirements timeframe to prevent further delay of meeting backorders. No other vendors have been approved for production on this item nor have any other vendors expressed interest in becoming qualified to producing this item.

DRS Test and Energy Management has successfully produced this item on numerous occasions. DRS Test and Energy Management has the facilities, personnel, technology and ability to deliver this item in accordance with the Government’s requirements.

d. Efforts to Qualify Additional Suppliers for future procurements:

There are no contractors in the process of being qualified at this time nor will be prior to the contract award due to funding and time constraints.

Qualifying a new source would require a substantial expenditure of the limited funding that has been provided to support the Abrams Vehicles. New sources would require the development of extensive testing and processing procedures. The additional time required for these actions would prohibit delivery of this item in a time frame that would meet the Government’s requirements.

There has not been any expressed interest by any known contractors to become a qualified source to produce this Redesigned Turret Networks Box (RTNB) Slipring Cable 1W610-E.

e. Market Research:

On 11 May 2015, the ARDEC-Rock Island CMO/Engineer conducted a Google search for the Redesigned Turret Networks Box (RTNB) Slipring Cable 1W610- E. The results of this search did not yield new production sources for this item. There are no other commercial or non-developmental items available to meet the Government's need or that would be economically modified to operate on the ABRAMS Tank.

This item appears on the Competition Advocate’s Shopping List (CASL), dated 31 Jul 2014. The CASL contains TACOM-Warren’s projected buy list of sole source items for the next three years based on the AMRC Codes of 3, 4 and 5. It is updated and advertised twice a year in the FedBizOpps and is available to interested contractors on the TACOM-Warren Business Opportunities website under the Future and Potential Buys Link. Contractors interested in competing on any items listed are instructed to contact the Competition Advocate’s Office.

A Sources Sought Synopsis was requested by DLA Land – Warren on 13 May 2015.

To date, no contractors have expressed interest in becoming qualified source(s) to produce this item. Interested suppliers may apply to the Source Approval Program through the TACOM LCMC-Warren Competition Advocate’s Office.

PART IV - Contracting Information

1. Description of Action: The required item will be solicited on Request for Proposals SPRDL1-15-R-0236. It is proposed to negotiate a firm fixed-price contract with DRS Test and Energy Management (CAGE 24290), who is the approved source for this item used in the embedded diagnostics in the M1 Abrams Tank.

2. Efforts to Obtain Competition: Although this procurement will be restricted to the above source, every effort will be made to obtain potential sources by synopsis through the FedBizOpps system.

3. Interested Sources: To date, no other sources have expressed a written interest in the acquisition of this item. Should potential sources respond to the synopsis in FedBizOpps, they will be evaluated by the appropriate engineering office as an alternate source.

5. Fair and Reasonable Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable.

The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary. Certified cost and pricing data will not be required because the value of the procurement falls below the certification threshold.
