JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

1. Contracting Activity: The Defense Logistics Agency,Land Warren is the procuring activity for this action.

2. Description of Action: Offers to provide the required item will be solicited under Request For Proposal SPRDL1-15-R-0131. Award is projected for the 3rd quarter of 2015 and AWCF funding will be used. An acquisition plan is not required because this action does not meet the dollar threshold for an acquisition plan.

DLA anticipates to negotiate a firm-fixed-price contract with the following source:

Ridge Instruments Co., Inc. (cage 7D457) 4603 Highway 31 South Decatur, AL 35603

4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(2), as implemented by FAR 6.302-2, "Unusual and Compelling Urgency."

5. Reason for Authority Cited: TACOM Life Cycle Management Command’s (LCMC’s) Director, Integrated Logistics Support Center (ILSC), approved a Class Statement of Urgency on 8 Jun 2012 for requirements, such as those described in paragraph 3 above, supporting Operation Noble Eagle (ONE), Operation Enduring Freedom (OEF), Operation New Dawn (OND), and Reset. A summary of the rationale for urgency follows:

a. The urgent quantities requested is 136ea and were first known 15 Sep 2014.

This item supports a depot overhaul program. The is no serviceable stock on hand and zero due-in from repair. If normal acquisition methods are used, anticipated deliveries would begin 15 Oct 2016 resulting in depot production line stoppage.

b. Justify the proposed delivery schedule:

This unforeseen rise in demands is due to recent Red River Army Depot (RRAD) production overhaul programs and an increase in DOF for this item.

c. Describe the extent and nature of the harm to the Government if the proposed delivery date is not met:

1. What is the serious injury (financial, harm to soldier, etc.) to the

Government if the required delivery dates are not met?

The lack of availability of these Equilabrator Guns will seriously impair Bradley Fighting Vehicles operational readiness and the support of the soldier in the field.

Without the Equilabrator Guns, the firing capability will be negatively impacted leaving the turret inoperable.

Lack of Equilabrator Guns will put the Bradley in a non-mission capable status. The Bradley Fighting Vehicle System (BFVS) production line at RRAD, will have to shut down. This line stoppage will result in high financial cost to the Department of the Army and the Department of Defense due to employees at RRAD not being able to work on planned program demands for its customers. Lack of this item may result in fielding delays of the Bradley.

2. What financial impact would this have on the Government and how was this dollar value assigned? Explain the basis for cost estimates.

The ripple effect in terms relative to cost would be catastrophic if RRAD does not meet their schedule and deadline. To shut down the production line as a result of no available material would relay a cost-impact that could be felt at the fleet level.

6. Efforts to Obtain Competition:

a. Consistent with the urgency of ONE/OEF/OND/Reset, we will seek competition to the maximum extent practicable. We intend to solicit responsible past or present producers of the item rather than synopsize this procurement in Federal Business Opportunities, to avoid the delay of synopsis publication. The contract file will contain a Justification for Non-Synopsis.

b. The quantity represented in this J&A is the minimum quantity needed until a normal replenishment contract can start to deliver. The normal replenishment buy will be input prior to 13 March 2015, for a quantity of 27 EA.

7. Actions to Increase Competition: As this acquisition is being made under the condition of ”Unusual and Compelling Urgency,” we will not take specific actions to increase competition. As stated above, we will seek competition on a limited source basis consistent with the overriding need for an expeditious contract award and performance.

8. Market Research: Due to the urgent nature of ONE/OEF/OND/Reset requirements, as outlined in Paragraph 5, we have done limited market research to confirm that the identified source(s) can best meet the Government’s needs. Procurement history shows that Ridge Instruments is the only contractor that has manufacturured these items since 2002.

9. Interested Sources: To date, no other sources have written to express an interest in this procurement. As we will not synopsize the requirement, per the exception at FAR 5.202(a)(2), we do not anticipate additional interested sources.

10. Technical Certification: Not Applicable.

12. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.

The appropriate forms of cost and/or price analysis will be utilized and negotiations will be conducted if necessary. Other than certified cost and/or pricing data will be required in order to evaluate the contractor’s prices. These costs will be analyzed to determine that the unit prices are fair and reasonable prior to awarding a contract.

13. AMC & AMSC: 1G. Definition of AMC 1: Suitable for competitive acquisition for the second or subsequent time. Definition of AMSC G: The Government has rights to the technical data, the data package is complete, and there are no technical data, engineering, tooling or manufacturing restrictions. (This is the only AMSC that implies that parts are candidates for full and open competition. Other AMSCs such as K, M, N, Q, and S may imply limited competition when two or more independent sources exist yet the technical data package is inadequate for full and open competition.) AMCs 1 or 2 are valid.
