JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

The Defense Logistics Agency – Warren (DLA – Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

PART II - Technical Information and Certification

1. The US Army TACOM LCMC requires the acquisition of the above item. The only approved source(s) for the above item is (are):

2. Reasons the item is not suitable for full and open competition:

a. Status of the Acquisition Data:

The government has limited rights in accordance with DFARS 252.227-7013 and 7017;

however; the Technical Data Package (TDP) acquisition production specification data is not fully defined and not suitable for full and open competition. The unique military grade 15 VDC Regulator Plus GWS Level Shifter and Overvolt Circuit Card Assembly (CCA) were developed, designed, built, and tested at Kearfott Corporation’ s expense.

This item is proprietary to Kearfott Corporation, who is the actual (or original equipment) manufacturer.

Thus, the Government does not own a competitive TDP for this item, and no other contractor can viably provide this item to be used on the M1A2 Systems Enhancement Packages v2 Abrams Tank.

Based on the above information, sole source procurement to Kearfott Corporation is the only method of procurement currently available to insure supportability of fielded vehicles.

b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement:

There are no current plans to acquire a competitive TDP because funds are not available to acquire the data necessary to support a competitive acquisition. In addition to not having the information necessary to develop a competitive TDP, ARDEC-RI engineer estimates that the cost to develop a competitive package for this item through reverse engineering, qualification procedures and engineering analysis are listed below:.

* 15 VDC Regulator Plus GWS Level Shifter and Overvolt Assembly Circuit Card Assembly (CCA):

Estimated costs associated with reverse engineering: $250,000 Estimated time associated with reverse engineering: 12 months

Estimated costs associated with the development of qualification procedures: $100,000

Estimated time associated with the development of qualification procedures: 12 months

Estimated costs associated with the conducting engineering analysis: $350,000 Estimated time associated with the development of qualification procedures: 12 months

Note 1 (Additional Cost): Circuit Card Assembly (CCA) (PN:9377512) is a Nuclear Hardness Critical Item (HCI) which means that the CCA requires Nuclear Hardness and Survivability Testing (NH&S) to include nuclear testing, physical testing in a simulated environment, modeling, simulation, and analysis. The NH&S as well as the Nuclear Survivability Assessment (electronic microcircuit test phase, system analysis test phase and system level test phase) will be conducted at U.S. Army Test and Evaluation Command and the estimated cost to conduct NH&S is five hundred thousand dollars ($500,000) and take at least 6 months.

The aggregate cost of reverse engineering; writing the qualification procedures, conducting an engineering analysis and Nuclear Hardness & Survivability Testing (NH&S) would be at least one million two hundred thousand dollars ($1,200,000) which would not be recovered through subsequent competition.

The aggregate delay in the acquisition process for reverse engineering 15 VDC Regulator Plus GWS Level Shifter and Overvolt Circuit Card Assembly (CCA); the preparation of qualification procedures and for the engineering analysis to determine if a new source met the qualification procedures is at least forty-two months. A delay of this scale is unacceptable in fulfilling the army’s requirements and would have significant detrimental impact on the army’s ability to support the soldier in the field.

Note 2: This will not be a government funded reverse engineering effort because the approved source of supply has more than enough customized military grade 15 VDC Regulator Plus GWS Level Shifter and Overvolt Circuit Card Assembly (CCA) (PN:9377512) available. Thus, if any contractor decides to take on an effort to reverse engineer and/or procure proprietary data, the new contractor will be solely responsible for taking on all of the cost listed in the above paragraphs with “little” to no assistance from the government.

c. Demonstration of Approved Contractor's Unique Qualifications:

Kearfott Corporation has the unique experience to meet the requirements timeframe to prevent further delay of meeting backorders. No other vendors have been approved for production on this item nor have any other vendors expressed interest in becoming qualified to producing this item.

Kearfott Corporation has successfully produced this item on numerous occasions.

Kearfott Corporation has the facilities, personnel, technology and ability to deliver this item in accordance with the Government’s requirements.

d. Efforts to Qualify Additional Suppliers for future procurements:

There are no contractors in the process of being qualified at this time nor will be prior to the contract award due to funding and time constraints.

Qualifying a new source would require a substantial expenditure of the limited funding that has been provided to support the Abrams Vehicles. New sources would require the development of extensive testing and processing procedures. The additional time required for these actions would prohibit delivery of this item in a time frame that would meet the Government’s requirements.

There has not been any expressed interest by any known contractors to become a qualified source to produce this 15 VDC Regulator Plus GWS Level Shifter and Overvolt Circuit Card Assembly (CCA).

e. Market Research:

This item does not appear on the TACOM Warren Competition Advocate’s Shopping List (CASL) or the Advanced Procurement Planning List (APPL)

On 03 March 2015, Lance Brock (ARDEC-Rock Island CMO/Engineer) conducted a Computer based market research for the 15 VDC Regulator Plus GWS Level Shifter and Overvolt Circuit Card Assembly (CCA). The results of this search did not yield new production sources for this item. There are no other commercial or non-developmental items available to meet the Government's need or that would be economically modified to operate on the ABRAMS Tank.

A Sources Sought Synopsis was issued on 27 February 2015. No responses have been received to date.

PART IV - Contracting Information

1. Description of Action: The required item will be solicited on Request For Proposals SPRDL1-15-R-0128. It is proposed to negotiate a Firm-Fixed-Price contract with Kearfott Corporation for their part number 9377512. This item is proprietary to Kearfott Corporation, who is the actual (or original equipment) manufacturer.

2. Efforts to Obtain Competition: Although this procurement will be restricted to the above source(s), every effort will be made to obtain potential sources by synopsis through the FedBizOpps system.

3. Interested Sources: To date, no other sources have expressed a written interest in the acquisition of this item. Should potential sources respond to the synopsis in FedBizOpps, they will be evaluated by the appropriate engineering office as an alternate source.

5. Fair and Reasonable Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable I hereby determine that the anticipated cost for this contract action will be fair and reasonable based on FAR 15.403-1(c)(1). Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. Certified cost or pricing data will not be required, as this procurement is anticipated to be less than the $700,000 threshold stated in FAR 15.403-4. However, data other than certified cost or pricing data will be required in accordance with FAR 15.403-3. The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary.
