JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
Defense Logistics Agency (DLA) Land Warren is the procuring activity for this action.
The statutory authority permitting other than full and open competition is 10 U.S.C.
2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

PART II - Technical Information and Certification
1. The US Army Tank-automotive and Armaments Command LCMC requires the acquisition of the above item. The only approved source for the Fuel Metering
Pump MPN. 3074559 is:

2. Reasons the item is not suitable for full and open competition:
a. Status of the Technical Data Package:
The main component of the vehicles Fuel System is the Fuel Metering Pump, part number 3074559. Cummins Engine Inc. is the sole owner of their drawings and technical data rights. The government does not own proprietary rights to the TDP that would be required to produce a competitive TDP. The above identified supplier has developed, tested and obtained Government approval for this item for application to the M2 Bradley Vehicle system at its own cost. The Government did not fund their efforts in developing and testing this item.
b. Efforts to Develop a Competitive Package:
Fuel Metering Pump, part number 3074559 is used on the M2 Bradley series vehicles. It functions as a sub assembly for the Engine Fuel System in the vehicle. The Fuel Metering Pump is used to provide fuel to the engine in the Bradley Fighting Vehicle. It is an integral part of the vehicles mobility and survivability system. This Fuel Metering Pump allows the vehicles engine to operate. In order to qualify additional vendors, a significant amount of time and money would be necessary to reverse engineer, procure and test additional prototypes before releasing the TDP. This delay would severely impact the availability of the Fuel Metering Pump in the field and Anniston Army Depot's rebuild program. This Fuel Metering Pump is critical to Bradley vehicle readiness.
Through our previous experience, we estimate that the cost to develop a competitive package for this critical item through reverse engineering would cost about $300K and would require an estimated delay of at least 12 months.
Testing this Fuel Metering Pump, part number 3074559 (20,000 Impulse Cycles at 200°F fluid temperature and 70,000 Impulse Cycles at 200°F without evidence of leakage or structural failure, particle removal 97%, gun fire shock, basic shock, endurance sand and dust, vibration) is estimated to cost $200K and take 6 months. Durability testing at Yuma Proving Grounds would also be required.
The 12 month, 6000 miles of durability test for the three prototypes will cost about $200K each. In summary, the cost to reverse engineer the current design, conduct laboratory testing, fabricate 3 prototypes and conduct vehicle durability testing would cost about $1.1 M and take 30 months. To do otherwise would be a high risk, as a premature failure of this item in the field would result in failure of the Engine to operate in a battlefield situation, which in hence will cause engine failure ($350K) and vehicle breakdown. Testing would also surface defects that could adversely impact the readiness of the equipment and Operational and
Support (O&S) Costs. These stated costs would be very difficult to be recouped through subsequent competition and the consequential time delay for this effort is unacceptable to meet the Government's requirements.
c. Demonstration of Approved Contractor's Unique Qualifications:
Only the vendor (Cummins Engine Inc.) has the requisite technical and engineering expertise to perform all efforts required to provide the item identified in this J&A. The current supplier has qualified in accordance with all the necessary test requirements and performance parameters. The subject component 3074559 is installed in the Bradley vehicle to provide an effective operation of the Engine Fuel System. It provides a mechanism where the vehicles Engine is fed with fuel. A failure of the Fuel Metering Pump under battlefield conditions could damage the vehicles Engine, thus rendering the vehicle unable to proceed with its mission function. The approved source identified above has demonstrated the ability to establish and maintain the processing required to produce this item. An award to any other source would cause a substantial duplication of costs to the Government not expected to be recovered through competition and would cause unacceptable delays in fulfilling TACOM LCMC fielding requirements. Qualifying a new source would also require a substantial expenditure of the limited funding that has been provided to support the STS contract. Any new source would require funding for the research and development of extensive processing procedures involved. Since the current contractor (Cummins Engine Inc) currently owns all the data for this item, the additional time required for these actions would prohibit delivery of the items in a time frame that would meet the Government's requirements.
d. Efforts to qualify additional suppliers:
At this time, there are no current or planned efforts to qualify additional sources due to the fact that there is very limited technical data available for P/N 3074559 (Fuel Metering Pump) nor are there any funds available to conduct the extensive (costly and time consuming) qualification testing requirements. Furthermore, any new source would be required to pass extensive validation testing of this item as those produced by the current vendor. The additional time required for these actions would prohibit delivery of the Fuel Metering Pump in a time frame that would satisfy the Government's needs. Contractors interested in producing this item can seek approval through the Source Approval Program with the Competition Advocates Office.
e. Market Survey:
This item “Fuel Metering Pump” P/N 3074559 does appear on the Competition Advocate Shopping List (CASL). The CASL is part of an on-going effort by the Department of the Army to increase secondary spares competition. This publication is used to apprise the public of the US Government's acquisition intent for TACOM-Warren secondary items. Projected CASL requirements are published semi-annually using a fiscal budget year, instead of a calendar year.
As a result, the December/January CASL Listing project requirements for the first-half of the current fiscal budget year. While the requirements for the second-half of the year are provided in the CASL Listing published in June/July. In addition to the current fiscal year, each listing provides requirements for two additional budget years.

PART IV - Contracting Information
1. Description of Action: The required item will be solicited under Request For Proposals SPRDL1-15-R-0121. Negotiation of a Firm-Fixed-Price contract with Cummins or its distributors for P/N 3074559 is anticipated.
2. Efforts to Obtain Competition: Although this procurement will be restricted to the above source, every effort will be made to obtain potential sources by synopsis through the FedBizOpps system.
3. Interested Sources: To date, no other sources have expressed a written interest in the acquisition of this item. Should potential sources respond to the synopsis in FedBizOpps, they will be evaluated by the appropriate engineering office as an alternate source.

5. Fair and Reasonable Determination: Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. The appropriate forms of cost or price analysis will be utilized, and negotiations will be conducted if necessary. Certified cost or pricing data will be required for this procurement to support price reasonableness in accordance with FAR 15.4.
6. AMC & AMSC: 3H. Definition of AMC 3: Acquire, for the second or subsequent time, directly from the actual manufacturer. Definition of AMSC H: The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source(s). This code is applicable only to parts under immediate buy requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different AMSC. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
