JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
The Defense Logistics Agency – Warren (DLA – Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

This Display Assembly is part of the Remote Binocular Display (RBD) in the Commander’s Independent Viewer (CIV) used on the A3, A3 BFIST w/FS3, M7-SA and ODS-SA Bradley Fighting Vehicle System (BFVS) Turrets. The CIV is a 360 degrees panoramic sight used by the commander to acquire targets by detecting and handing off targets to the gunner for engagement. The CIV can acquire targets during day, night, bad weather, or smoke and haze commonly found on the battlefield.
PART II - Technical Information and Certification
1. The US Army TACOM LCMC requires the acquisition of the above item. The only approved source(s) for the above item is (are):

2. Reasons the item is not suitable for full and open competition:
As authorized by FAR 6.302-1(b)(1)(i), procurement by other than full and open competition is necessary as follows:
a. Status of the Acquisition Data:
During the development of the A3 Bradley, PM-ABCT made the decision not to buy any Technical Data for the Commander’s Independent Viewer (CIV) from either the Bradley Prime Contractor, BAE Systems, CAGE Code 80212 or the CIV developer, Raytheon Company (CAGE Code: 96214). The bottom line is that the U.S. Army does not own a competitive TDP for this Display Assembly because the entire CIV is still proprietary to Raytheon.
b. Efforts to Increase Competition or Qualify a New Source in Relation to this
Procurement:
It is estimated that it will take 1 year and $200,000 to develop qualification procedures for this item. The estimated cost and time to reverse engineer this assembly is $1 million and take 1 year to complete. Then it will take a new vendor an additional year and $1 million to qualify their part for use on the A3 and SA Bradley Turrets. The total effort to obtain a new qualified production source for this Display Assembly would take 3.0 years and cost $2.2 million dollars. At this time, PM-ABCT has not allocated any funding to even develop the qualification procedures much less the reverse engineering and testing effort. Even if funding was available, the costs associated with qualifying a new repair source is not expected to be recovered through subsequent competition. Additionally the time frame for this effort is much too long for adequately providing spare parts to keep Bradley Vehicles in the U.S. Army operational.
c. Demonstration of Approved Contractor's Unique Qualifications:
In 1997 Raytheon (formerly Texas Instruments) began development of the CIV for the use on the A3 Bradley Turret. Since 1997 approximately 2,000 CIV have been installed on A3 and SA Bradley Turrets. Raytheon is still the proprietary sole source provider for the CIV because they own all of the technical data for the entire CIV and all of the lower level assemblies including this Display Assembly. Currently only Raytheon has the capability to produce this Display Assembly, Raytheon Part Number 3227416-1.
d. Efforts to Qualify Additional Suppliers for future procurements:
Since there are no qualification procedures for this item, no other contractors are in the process of being qualified for future repair contracts at this time. As stated earlier, PM-ABCT has not allocated any funding to even develop the qualification procedures much less the reverse engineering and testing effort. Due to these funding constraints the costs associated with qualifying a new production source is not expected to be recovered through subsequent competition.
e. Market Research:
This procurement will be synopsized in FedBizOps and interested suppliers may apply to the Competition Management Office.
This item also does not appear on the TACOM Warren Competition Advocate Shopping List (CASL) or the Advanced Procurement Planning List (APPL) dated 05 Dec 2013.
On 26 Dec 2013, ARDEC-Rock Island conducted computer based market research for
CIV Display Assemblies for use on the Bradley did not yield any information about new production sources for this item. There are no other commercial or non-developmental items available to meet the Government's need or that could be modified to meet the Government's need that interfaces and functions with the hardware and software in the CIV for the A3 and SA Bradley Turrets.

PART IV - Contracting Information
1. Description of Action: The required item will be solicited on Request For Proposals SPRDL1-14-R-0157. It is proposed to negotiate a Firm-Fixed-Price contract with Raytheon Company for their part number 3227416-1. Raytheon Company is the sole owner of the drawings and technical data rights and the Government does not own proprietary rights to the Technical Data Package.
2. Efforts to Obtain Competition: Although this procurement will be restricted to the above source(s), every effort will be made to obtain potential sources by synopsis through the FedBizOpps system.
3. Interested Sources: To date, no other sources have expressed a written interest in the acquisition of this item. Should potential sources respond to the synopsis in FedBizOpps, they will be evaluated by the appropriate engineering office as an alternate source.

5. Fair and Reasonable Determination: Fair and Reasonable Determination I hereby determine that the anticipated cost for this contract action will be fair and reasonable based on FAR 15.403-1(c)(1)(ii)(A)(1) and (2). Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary.
