4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) and FAR 6.302-1(a)(2), “Only one responsible source, and no other supplies or services will satisfy agency requirements.”
5. Reason for Authority Cited: The proposed contractor is Northrop Grumman Italia (NGI), the Original Equipment Manufacturer (OEM) for the system and is the only known source that has the capability to furnish the required equipment. The AHRU and CU are Non-Developmental Items (NDIs). The hardware design and embedded software are proprietary to NGI. The Government does not possess detailed technical data such as detailed engineering drawings, embedded software and special test equipment necessary for the production of these items. The OEM does not have any interest in selling its data rights; therefore, no cost to procure the data rights is available. To develop a comparable CU or a second source that is performance wise identical to current CU and comparable to the AHRU would require extensive reengineering, production testing capabilities, qualification, and flight testing based on product specification.
Because the system is considered flight critical, a new source would also require costly and time-consuming Air Worthiness qualification.
Market research, as described in Section 8, did not reveal any interested source outside of the OEM. The Government assigned Acquisition Method Reason Code (AMRC) of 3R for this item.
An AMC code of 3 means acquire for the second or subsequent time directly from the actual manufacturer and R means that the Government does not own the data or the rights to the data needed to purchase this part from additional sources.
6. Efforts to Obtain Competition: Market Research was conducted on this acquisition and the details are described in the Market Research section of this document. This research did not yield any additional potential source that can meet the Government’s requirement.
7. Actions to Increase Competition: Per the guidance of DFARS PGI 206.304, the Contracting Officer reviewed the previous J&A to ascertain what actions were proposed to increase competition. The J&A for the W15P7T-08-D-F005 stated the Government would contact NGI, formally LITAL to determine its interest in selling the TDP. Additionally, the Government would continue to conduct market research to determine if changes occurred in the marketplace that would enable future actions to be competed.
The Government will continue to conduct market research to ascertain if changes occur in the marketplace that would enable future actions to be competed. However, at this time it is anticipated that future acquisition will need to be conducted on a sole source basis.
