DLA Land & Maritime Justification for Other Than Full & Open Competition (May 2018)

1. The Defense Logistics Agency, (DLA) at Aberdeen, is the contracting activity.
2. The action being approved is the acquisition of supplies/services on other than a full and open competition basis.
3. The supplies/services required to meet the using activity’s needs are described as follows:

Identify end item, weapon system, or class of item:
The Tactical Quiet Generators (TQG) 15kW provides critical electrical power for the Command, Control, Communications, Computer, Cyber and Intelligence Sensors and Radar (C5ISR) systems, in that it maintains service in military environments where electrical power for tactical equipment or troop support is needed.
The purpose of this addendum is to revise the following:

Brief narrative supporting the situation and weapon system:
The Justification and Approval supports a solicitation using other than full and open competition procedures for a five (5) year ,Firm Fixed Price (FFP), Indefinite-Delivery, Indefinite-Quantity (IDIQ) type contract for the 15KW engine using FAR 13.5 procedures. The National Stock Number (NSN) for this commercial part is 2815-01-538- 4257 and the part number is 97-24004. The Yanmar diesel engine is a vital component for the 15kW TQGs. The 15kW will be supported through 2031 until the Advanced Medium Mobile Power Systems (AMMPS) program is fielded. The 15kW TQG is used in maintenance and infrastructure facilities; as well as weapon systems, Combat Support Systems (CCS) and various C5ISR equipment around the world. The only company with the comprehensive knowledge, expertise and technical data rights to produce this engine is Yanmar. The original equipment manufacturer (OEM) and only approved manufacturer is Yanmar, which is a large business. There will be minimal technical and performance risk since Yanmar is the OEM of the diesel engine.
The use of the authority cited below:

The use of the authority cited is based on:
[X] AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
Efforts to ensure that offers are solicited from as many sources as practicable are:

6. The Contracting Officer: I hereby determine that the anticipated cost to the Government will be fair and reasonable based on price analysis and an analysis of other than certified cost and pricing data if necessary.
7. Market Research/Efforts to Obtain Competition:
The Technical experts within the Logistics and Readiness (LRC) published a market survey on Beta.sam.gov. The survey was posted on 5 February and closed on 28 February 2020. At the time of closing, there were two responses from the OEM, Yanmar (30554) and Melton Industries (4X8W5), an authorized dealer for Yanmar. The Government does not possess technical data that completely defines the Form, Fit, and Function (F3) characteristics of this engine to ensure it is compatible with the 15kW TQG. Any manufacturer other than Yanmar would need to conduct an extensive reverse engineering effort before it could produce this item. After the reverse engineering effort is completed, the item would then have to go through extensive testing to ensure that the new engine is compatible with the existing generators. This would result in delays and compromise mission effectiveness.
