About this file
This document is a justification for a sole source contract award over $250,000. DLA Maritime Puget Sound requires 100 4-foot docking blocks, 200 8-foot docking blocks, and 20 12-foot docking blocks from Brandt Group, a certified Small Disabled Veteran Owned Small Business. The total estimated value of this firm-fixed price contract is $325,000. Market research found Brandt Group is the only SDVOSB capable of supplying the required docking blocks. As a result, the contract will be awarded on a sole source basis to Brandt Group in accordance with the Veteran Benefits Act of 2003 and FAR provisions for contracting with SDVOSBs. The related federal contract opportunity notice indicates contract SPMYM220C0018 was awarded to an unknown vendor for an unknown amount on September 11, 2020 by the Defense Logistics Agency Land and Maritime for these docking block requirements.

4. The acquisition is restricted to the only source(s) of supply known to have the capability of furnishing the required supplies/services. Source(s) are: (Include CAGE code) Brandt Group, Cage6CUL7
5. The statutory authority permitting other than full and open competition is:
[ X ] 15 U.S.C 657(f) – Veteran Benefits Act of 2003.
[ ] 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
[ ] 10 U.S.C. 2304(c)(2) – Unusual and Compelling Urgency.
[ x ] 10 U.S.C. 2304(c)(5) – Authorized by Statute.
6. The use of the authority cited above is based on:
Brandt Group is a Small Service Disabled Veteran Owned Small Business (SDVOSB). Pursuant to FAR 6.302- 5(b)(6) and FAR 19.1406, the authority under 15 U.S.C. 657(f) is invoked. Brandt Group is capable of supplying the requested items. Market research does not indicate that there are two or more SDVOSB firms that are capable of supplying the requested docking blocks. Therefore, a SDVOSB set-aside is not appropriate. The anticipated award amount is less than $6.5 million for NAICS code 327331 in accordance with FAR 19.1406(a)(2)(i). Brandt Group is not currently participating in the 8A program. Based on capability statements provided by Brandt Group, they are capable of supplying the requested items, and are responsible. Award to Brandt Group will be made at a fair and reasonable price.
7. Efforts to ensure that offers are solicited from as many sources as practicable are:
[ ] The acquisition will be synopsized and any firm requesting a solicitation copy will be provided one.
[ ] Manufacturers of similar products identified in the market survey will be solicited.
[ ] Dealers of the manufacturers will be solicited.
[ x ] Other (Explain): No additional sources will be solicited.
8. Market Research:
DLA Maritime Puget Sound Justification For Other Than Full And Open Competition Over $250K (May 21,2018)
All required sources of supply were screened to determine if they are capable of supplying the requested docking blocks. Ability One, Unicor, EPA, and GSA are not capable. Market research indicates that blocks are commercial in nature. Brandt Group is current in SAM and is certified as a small disabled veteran owned small business (SDVOSB). Pursuant to FAR 19.1406, and FAR 6.302-5(b)(6) the recommended acquisition strategy is a SDVOSB sole source to Brandt Group. Brand Group previously performed SPMYM2-14-D-0010 for Pearl Harbor for similar Blocks. That acquisition was 100% total small business set-aside, and was $808,293.00.
When searching small businesses using the Small Business Administration’s Dynamic Small Business Search tool, under the selected NAICS, only 24 SDVOSBs are identified. . The selected SDVOSB was first identified through an extensive search of the Federal Procurement Data System-Next Generation (FPDS-NG), reviewing contracts executed for docking blocks under the selected NAICS. Upon further review of the DSBS search, this SDVOSB was the only one that had extensive contract history in FPDS-NG where they actually manufactured docking blocks for the DoD/Navy. The other companies that came up in the DSBS search may have the selected NAICS code listed in their profile, but did not appear to actually do this specific type of work, or contract history could not be found within FPDS-NG. With a limited number of SDVOSBs listed under this NAICS, and The Brandt Group being the only one that has an extensive and successful history of executing this work for the Government, there is not a reasonable expectation that offers would be received from two (2) or more SDVOSBs in response to this solicitation. Based on this market research, and in accordance with FAR 19.1406(a), the decision was made to pursue an acquisition strategy to sole-source this award to an SDVOSB, The Brandt Group, that has an extensive and successful track record of manufacturing docking blocks for the DoD/Navy.
9. Additional facts supporting other than full and open competition are:
[ ] Based upon the technical certification on file, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
[ x ] Other: Brandt is a SDVOSB that is capable of supplying the requested items.
10. A listing of sources, if any, indicating an interest in the acquisition are:
Brandt Group, Cage6CUL7.
11. The actions being taken to overcome barriers to competition before any subsequent acquisitions are made are:
Not Applicable, as we are restricting competition on a statutory basis.
12. The pricing for this requirement is anticipated to be fair and reasonable. Fair and reasonable pricing will be established based upon comparison to previous contracts found reasonable, and market research. If necessary, other than certified cost and pricing data will be requested.
13. Additional facts, if any, supporting this determination: NA
