3. Invoice Information:
The contractor shall utilize the electronic invoicing upon delivery of supplies indicated herein. Invoice may be submitted not more than one every two weeks. Invoices must be submitted electronically using Wide Area Work Flow (WAWF) – Receipt and Acceptance. The contractor shall self-register at the web site: https://wawf.eb.mil.

5. Defense Biometric Identification System (DBIDS):
Effective 14 August 2017, NCACS credentials will no longer be accepted for base access. Any new contractor, vendor or supplier requesting base access will be required to obtain a Defense Biometric Identification System (DBIDS) credential. NCACS credentials will no longer be issued. Only DBIDS credentials will be issued to ALL contractors, vendors and suppliers seeking base access AFTER 30 June 2017. Defense Biometric Identification System (DBIDS) increases installation security and communications by receiving frequent database updates on changes to personnel/credential status, law enforcement warrants, lost/stolen cards, and force protection conditions.
The system provides continuous vetting anytime the DBIDS card is scanned at an installation entry point.
If you currently have a Navy Commercial Access Control System (NCACS) card, the following is required to get a DBIDS credential:
Present your NCACS Card and a completed copy of the SECNAV FORM 5512/1 to the base Visitor Control Center (VCC) representative.
The VCC will pull up your information in the computer, ensuring all information is current and correct.
Once your information is validated, a temporary DBIDS credential is provided.
Your temporary credential will have an expiration date, prior to which you will need to obtain your permanent DBIDS credential (~ 180 days).
For each additional U.S. Navy installation to which you need access, the first time you visit you only need to bring your DBIDS credential and statement of purpose for base access when arriving at the Visitor Control Center.
The representative will enter base access authorization and then you may proceed to work.
If you do NOT have an NCACS Card, the following is required to obtain a DBIDS credential:
Present a letter or official document from any government sponsoring organization that provides the purpose for your access.
Present valid identification, such as a passport or Real ID Act-compliant state driver's license.
Present a completed copy of the SECNAV 5512/1 form to obtain your background check.
Upon completion of the background check, the Visitor Control Center representative will complete the
DBIDS enrollment process, which includes your photo, finger prints, base restrictions, and several other assessments; after all this is done, you will be provided with your new DBIDS credential.
All deliveries must pass through the base Truck Inspection Station. All delivery vehicles are subject to inspection.
Drivers should expect delays due to heightened security.
For access to the main, perimeter gates at any Navy Base Kitsap installation, contractors are required to be a US Citizen and have either:
(a) DBIDS badge or
(b) Request a One-day Visitor badge at Pass & ID. Be prepared to present:
-Photo ID -Original proof of citizenship (any one of the following is acceptable):

SPECIFICATIONS
3’ X 3’ X 5’ BATCH OVEN (BLDG 873)
1. SCOPE
This specification reflects those characteristics, which are essential to the minimum needs of the government for an on-site installed "Turn-Key BATCH OVEN, in support of PSNS waterfront. This "Turn-Key" system is to include the preparation of the work site, the assembly, installation, and testing of the equipment, and the training of operator and maintenance personnel as specified herein. It is the government's intent that a single (primary) contractor be awarded this contract and be responsible for the accomplishment of all work detailed by this specification.
2. APPLICABLE DOCUMENTS
The following documents form a part of this specification to the extent specified herein. Unless otherwise indicated, the issue in effect on the date of an invitation for bids or a request for proposals shall apply.

3. REQUIREMENTS:
GENERAL DESCRIPTION OF SYSTEM - This specification covers the minimum government requirements for a "Turn-Key" BATCH OVEN to heat ferrous and nonferrous materials to a uniform temperature.
3.1. WORK INCLUDED - The Contractor shall be responsible for the following:
Preparation of the work-site consistent with this specification.
Design, manufacture, test and groom all equipment required to provide a complete system as specified herein.
Assemble and install the BATCH OVEN as described elsewhere in this specification.
The operational testing and grooming of the system, in accordance with the requirements specified herein.
Complete documentation and organization of all technical data which applies to the installation, operation, maintenance, repair and testing of the specific equipment.
Provide training to Shipyard personnel on the proper operation and maintenance of the installed equipment and its component parts.
3.2. WORK NOT INCLUDED - The Shipyard will provide:
a. An area within a shop building for the installation of the proposed equipment.
b. Utility services as required by the contractor installation (PIP) drawings for the proper operation of the equipment unless otherwise stated herein.
3.3. CONDITIONS OF SERVICE AND PERFORMANCE: - The following service and operational conditions shall apply to the equipment delivered under this specification.
3.3.1. Basic Operational Performance Requirements:
Maximum Rated Temperature 550 degrees F
Normal Operating Temperature 200 - 500 degrees F @ +/- 25 degrees of set point.
Uniform heating throughout heating chamber of +/-10 degrees F.
Horizontal air flow across oven.
3.3.2. Operational Condition - The proposed system will be operated in a heavy-duty industrial environment and shall be capable of continuous operation over an extended period of time with minimal maintenance and upkeep.
3.3.2.1. The proposed system shall be installed in an industrial manufacturing building having limited space. The proposed equipment shall fit within the following site dimensions:
Maximum Overall System Width: 5 feet Maximum Overall System Depth: 6 feet Maximum Overall System Height: 7 feet Chamber dimensions: 3 feet Wide x 3 feet Length x 5 feet High
3.3.3. Environmental Conditions - The unit shall be designed to operate in a non-air-conditioned manufacturing building in an industrial environment.
Temperature Range: 40 to 120 o F Relative Humidity: up to 100% Non-Condensing
3.4. GENERAL EQUIPMENT REQUIREMENTS:
3.4.1. Standard, Off the Shelf Components - All materials and parts comprising the system shall be new, of current design and manufacture, and shall not have been in prior service except as required for factory testing.
Standard, off the shelf components with proven reliability shall be used wherever possible to increase performance reliability and reduce costs. The equipment shall be one of the manufacturer’s current production models which, on the day this solicitation is issued, has been designed, engineered and sold, or is being offered for sale through advertisements or manufacturer’s published catalogs or brochures. Products such as a prototype unit, pre-production model, or experimental unit DO NOT qualify as meeting this requirement. The equipment shall be complete, so that when connected to the utilities identified herein, it can be used for the function for which it is designed and constructed.
3.4.2. Personnel Safety and Health Requirements - All machine parts, components, mechanisms, and assemblies furnished on the unit shall comply with all specific requirements of “OSHA Safety and Health Standard (29CFR1910), General Industry” that are applicable to the equipment itself. Covers, platforms, guardrails, belt guards, and safety devices shall be provided for all parts of the equipment that present a safety hazard. The safety devices shall not interfere with the operation or maintenance of the equipment. The safety devices shall be removable to facilitate inspection, maintenance, and repair of the part. Additional safety and health requirements shall be as specified in other paragraphs of this specification.
3.4.3. NRTL Listing or NRTL Field Inspection and Approval - The oven shall be listed or approved by one of the following methods:
3.4.3.1. Nationally Recognized Testing Laboratory (NRTL) Listing and Labeling - The equipment specified herein shall be listed and labeled by an Occupational Safety & Health Administration (OSHA) approved Nationally Recognized Testing Laboratory.
3.4.3.2. Nationally Recognized Testing Laboratory (NRTL) Field Inspection - The equipment specified herein and installation shall be field inspected, labeled and approved by an Occupational Safety & Health Administration (OSHA) approved Nationally Recognized Testing Laboratory. Test data reports shall be furnished for review.
3.4.4. Safety Devices All machine parts, components, mechanisms, and assemblies furnished on the unit shall comply with all specific requirements of “OSHA Safety and Health Standard (29 CFR 1910), General Industry” that are applicable to the equipment itself.
3.4.4.1. Covers, platforms, guard rails, belt guards, and other safety devices shall be provided for all parts of the equipment that present a safety hazard.
3.4.4.2. The safety devices shall prevent unintentional contact with the guarded part. The safety devices shall not interfere with the operation or maintenance of the equipment.
3.4.4.3. The safety devices shall be removable to facilitate inspection, maintenance and repair of the part.
3.4.4.4. Access Ladders, Platforms, and Safety Rails: For all equipment that requires preventative maintenance and servicing, provide access ladders, platforms, safety rails with toe boards and devices as required to meet 29 CFR 1910 Subpart D to allow workers to perform the maintenance without the use of personal fall protection. A platform with ladder and guardrails shall be included to change the filter bags or cartridges when the dust collector is in the lowered position.
3.4.5. Energy Isolating Devices - The equipment shall be provided with energy isolating devices (e.g., power switches, safety switches, circuit breakers, valves, etc.) that protect personnel from the release of hazardous energy.
3.4.5.1. The devices shall be designed and manufactured such that they can be padlocked in the user-selected position (ON or OFF, OPEN or CLOSED) to prevent inadvertent or unauthorized change.
3.4.5.2. All energy isolating devices installed or modified shall be capable of being locked by being integral to the equipment installed. This includes both mechanical and electrical devices.
3.4.6. Maintainability - The equipment shall be designed and constructed to permit maintenance personnel to service the equipment easily and effectively using a minimal number of tools. The contractor shall provide any special tools required to service the unit. The equipment shall have access covers, as necessary, to facilitate inspection, cleaning and repair or replacement of internal parts.
3.4.7. Electrical - The equipment delivered and all accessory parts shall operate from a single source of primary power, which is 460 VAC (+5%), three-phase, 60 Hz. The proposed system shall include all transformers required for individual circuits such as control power, etc.
3.4.7.1. All Electrical Components including motors, starters, relays, switches, and wiring shall conform to and be located in accordance with the applicable NFPA, NEMA, and ANSI standards for the intended application.
3.4.7.2. Over protection device shall be fuse or circuit breaker protected in each phase conductor for AC circuits.
Overloads, fuses and circuit breakers shall be coordinated for maximum component protection and minimum circuit disruption.
3.4.7.3. Motors shall be rated for continuous duty. Motors shall be equipped with ball bearings of the sealed and permanently lubricated type. All electrical motors shall meet NEMA-MG1 requirements.
3.4.7.4. Main and auxiliary control circuits shall operate on a circuit of 120 volts or less derived from isolation transformers integral with the equipment.
3.4.7.5. Grounding - All exposed, non-current carrying metal parts shall be maintained at common, zero ground potential. None of the primary circuits in the equipment shall be connected to ground. A grounding stud/lug shall be provided as a means for grounding the equipment. For cord connected equipment, a NEMA type grounding plug which effectively grounds the equipment for the safety of personnel shall be acceptable in lieu of a ground stud or lug on the equipment.
3.4.8. Bearings - All bearings contained in the equipment and the entire system must be United States (U.S.) or Canadian manufactured. If they are not U.S. or Canadian manufactured bearings, the vendor must provide a list of exact U.S. or Canadian made equivalent bearings that can be used for replacement of each bearing within this equipment or system.
3.4.9. Audible Noise Levels - During normal operation, the dust collector assembly shall not produce noise levels greater than 84 dB(A) as measured on the “A” scale and 92 dB(C) as measured on the “C” scale, at any point three feet from the unit of a standard sound level meter at slow response (29 CFR 1910.95, Occupational Noise Exposure Standard). See paragraph 4.4.3 for noise level testing.
3.4.10. Environmental Protection - The unit shall be designed and constructed so that during operation, service, transportation and storage conditions described herein, including final disposal, the equipment will comply with all applicable Environmental Protection Agency (EPA) and Occupational Safety and Health Agency (OSHA) and State of Washington Department of Ecology (WDOE) restrictions for materials classified as hazardous to the environment in effect on the date of the contract. The equipment described herein shall not contain or emit material hazardous to the ecological system as prescribed by federal, state, and local statutes in effect at the point of installation.
3.4.11. Hazardous Material Exclusions - Materials being provided as part of the equipment shall be free of known hazardous materials. Definitions of hazardous materials are specified in the latest version, including revisions adopted during the term of the contract, of Federal Standard No. 313.
3.4.11.1. Notwithstanding any other hazardous material usage permitted in this contract, radioactive materials or instruments capable of producing ionizing radiation as well as materials which contain asbestos, mercury, cadmium, lithium, methylene chloride, lead (=or>0.06%), or polychlorinated biphenyls (PCB’s) are prohibited.
3.4.12. Painting - All exterior surfaces shall be painted in conformance with the manufacturer’s standard practices and good workmanship. Painting shall result in a highly wear-resistant finish that guarantees continued protection to the surfaces covered against the specified environment under all service conditions. The manufacturer’s standard color shall be provided. Lead base or chromium base paints are prohibited.
3.4.13. Caution - Warning Plates - Corrosion resistant “Caution” or “Warning” plates shall be securely attached to the equipment in visible locations, with any safety precautions to be observed by the operator or maintenance personnel permanently marked on the plates.
3.4.14. Informational Plates – The following informational plates shall be marked by engraving or photo imaging, on wear and corrosion resistant metal, permanently affixed to the equipment. Identification Plate - The following information shall be on the plate: Nomenclature, Contractor’s name, manufacturers name, equipment model number, equipment serial number, electrical utilities (Volts, Full Load Amps, Frequency, and Phases), date of manufacture, contract number and any other pertinent information for identifying the part as a unique component of the system.
3.4.14.1. PCB Label Plate - A label plate containing the PCB Certification information shall be permanently affixed to the equipment in the vicinity of the manufacturer’s identification plate.
3.4.15. Controls and Instrumentation - Operator controls, instrumentation and indicators shall be mounted convenient to operating personnel. Such devices shall be clearly and legibly marked for function and identification.
Controls shall be fitted with suitable handles, pushbuttons, or control knobs, as applicable. Gauges and instruments shall be designed for recalibration. Pressure gauges shall be calibrated in the U.S. system of measurement.
3.5. EQUIPMENT AND SERVICES TO BE PROVIDED:
3.5.1. Preparation of the Work-Site - The proposed installation site is currently occupied. Utility services to the building shall remain as currently installed. The following site work shall be required as part of this contract:
Remove existing 6-inch ventilation pipe (see attachment B building layout).
Install new oven on existing floor in proposed (see attachment B building 873 layout) location, shown as “Plastisol Oven”. Building is approximately 390 feet long x 180 feet wide x 30 feet high walls.
Install main disconnect panel near the powder coating oven along with electrical conduit from 400-amp power panel (see attachment B building 873 layout). Electrical conduit shall be routed to avoid overhead crane envelop (see attachment A paragraph 3.15).
Install power from main disconnect panel to the oven main power panel.
Install new breaker in 400-amp power panel.
WARNING: Avoid energized electrical wiring. Crane rails, overhead conductors, and other risks in the area. De-energize and lock-out/tag-out crane rails prior to overhead work.
3.5.2. Batch oven shall include the following features:
Free work area 36" X 36" x 60" high (minimum heating chamber).
Insulation 4" (minimum) insulated panels.
1,600 CFM @ 1.5 HP (minimum) recirculation blower and combination airflow through the work chamber.
18 kw (minimum) heat input (incoloy sheathed elements) with time proportional SSR power control and backup contactors.
4 removable shelves with equally spaced channel shelf supports to prevent shelves tipping. Shelves shall be capable of handling a 100 pound (minimum) uniformly distributed load.
3.5.3. Main Control Panel and Instrumentation which includes the following features:
Electric heating element 480volt, 3 phase, 60 Hertz Oven mounted UL certified and labeled NEMA 12 enclosure.
Purge timer and excess temperature cutout and all necessary equipment and interlocks to comply with
FM, IRI, NEC, & NFPA 86.
Main oven temperature controller Door limit switch safety interlock Indicating lights and push button start/stop
3.5.4. Oven Doors shall be provided, which includes the following minimum features.
Heavy-duty steel insulated doors.
High temperature Bi-parting horizontal swing doors at front end only.
High temperature gaskets around door perimeter and closures.
Ball bearing hinges.
Safety latches.
3.5.5. Oven Floor shall include the following features:
Fully insulated reinforced floor with 500 pound (minimum) load capacity.
3.5.6. Exhaust Blower and Stack: shall include:
650 CFM @ ½ HP (minimum) motor.
Meet or exceed NFPA 86 requirements.
All necessary sections and turns to exhaust the oven outside the building roof thru existing 6-inch roof penetration (see attachment B building layout).
Up to 8 feet over the roof line (APPROX 30 FEET) with no-loss rain stack.
Include all necessary supports structure for the oven and stack.
Screen around ventilation pipe on roof to prevent touching of the pipe if exit pipe temperature is above
110 degrees F.
3.5.7. Main Disconnect Panel (separate from main control panel) - A NEMA 12 enclosure with UL 98 motor controller or safety switch (visible blade type). Disconnecting means shall be included to provide isolation of all electrical energy to the main control panel. This disconnecting means shall be lockable in the open circuit (off) position.
3.6. ON-SITE PERSONNEL TRAINING: - Within twenty (20) working days after satisfactory completion of acceptance testing of the system, the services of a qualified representative(s) shall be provided for specialized training to familiarize receiving activity personnel with the equipment and to help ensure reliable performance and maximum service life, during normal usage. Training sessions shall be provided separately for each group/type of government personnel. The training shall apply to personnel as follows:
Operator Personnel - Training shall be provided for five (5) operator personnel at a journeyman mechanic level for a period of one (1) hour minimum. This training shall include preparation of equipment for operation and actual, safe operation of the equipment.
Maintenance Personnel (Mechanical/Pneumatic) - Training shall be provided for two (2) mechanical maintenance personnel at a journeyman mechanic level for a period of one (1) hour minimum. This training shall include trouble-shooting and methods of correction if the equipment malfunctions, with particular emphasis on minimizing equipment down time.
Maintenance Personnel (Electrical/Electronic) - Training shall be provided for two (2) electrical/electronic maintenance personnel at a journeyman mechanic level for a period of one (1) hour minimum. This training, with respect to equipment/controls/drives/interface units and related components, shall include trouble-shooting and methods of correction should equipment malfunction, with emphasis on minimizing equipment down time.
3.6.1. Training Location - Training services shall be rendered at Puget Sound Naval Shipyard.
3.6.2. Training Scheduling - shall be scheduled and tailored by mutual agreement between the Contractor and the receiving activity. Two (2) weeks prior to the start of any training, the contractor shall provide a course outline for government review and comment. Training sessions shall be provided separately for each group/type of government personnel. The contractor shall provide all training manuals and guides. The government shall provide classroom space in close proximity to the equipment/shop,
3.6.3. Training Cost - The entire contractor cost of providing the training (including travel, per diem, etc.) shall be covered by this contract.
3.7. TECHNICAL DATA TO BE PROVIDED
3.7.1. Operator / Maintenance / Repair Manuals - The equipment shall be furnished with six copies of the manufacturer’s standard Operation, Maintenance, and Repair Manual(s). The manuals shall include all mechanical and electrical schematics showing discrete components/block diagrams/wiring diagrams with inputs and outputs identified/system electrical interface documents and drawings for the specific model of all machine equipment/drives/controls supplied. The information contained in the manual(s) shall reflect the unit and its components in the “as built” configuration, shall be in the English language, shall be adequate to permit trouble shooting and repair of the equipment by journeymen level Shipyard personnel, and shall be in imperial units of measure.
3.7.2. PCB Certification - The Contractor shall provide written certification from the manufacturer that the equipment contains no detectable PCBs (less than two (2) part-per-million (PPM)). The certification shall be on manufacturer’s letterhead, and signed by a company official who is empowered to provide the certificate.
3.7.3. NRTL Listing or NRTL Field Inspection and Approval Compliance Statement - The contractor shall provide signed, written certification of compliance to the requirements of 3.4.3 - NRTL listing or NRTL field inspection and approval. Failure to provide this certification will delay acceptance of the equipment, and could result in rejection for failure to comply with the terms of the contract.
3.7.4. Warranty - Supplies and services furnished shall be covered by warranty from defects in design, materials and workmanship. The warranty shall be the manufacturer’s standard commercial warranty which shall conform to all the requirements of the contract. Acceptance of the manufacturer’s standard commercial warranty shall not minimize the rights of the Government under clauses in the contract, and in any conflict that arises between the terms and conditions of the contract and manufacturer’s warranty, the terms and conditions of the contract shall take precedence. The warranty period shall commence when final acceptance has been achieved as determined when all contract line item numbers have been processed through Wide Area Workflow (WAWF) as indicated per paragraph 4.5.5.
4. QUALITY ASSURANCE PROVISIONS
4.1. RESPONSIBILITY FOR INSPECTION - The Contractor shall be responsible for the performance of all inspection requirements (examinations and tests) as specified herein. The Contractor may use his own facility or any other facility suitable for the performance of the inspection requirements specified herein. The Government reserves the right to perform any of the inspections set forth in this specification, where such inspections are deemed necessary to assure supplies and services conform to the prescribed requirements.
4.2. RESPONSIBILITY FOR COMPLIANCE - All items shall meet all requirements of sections 3 and 5.
The inspection(s) set forth in this specification shall become part of the contractor’s overall inspection system or quality program. The absence of any inspection requirements in the specification shall not relieve the contractor of the responsibility of assuring that all products or supplies submitted to the Government for acceptance comply with all requirements of the contract. Sampling inspections, as part of manufacturing operations, is an acceptable practice to ascertain conformance to requirements; however, this does not authorize submission of known defective material, either indicated or actual, nor does it commit the Government to accept defective material.
4.3. BASIC PERFORMANCE TESTS - Basic performance tests shall be conducted on the primary equipment and all associated equipment to the extent practicable, to demonstrate functionality. The tests may be performed by the Manufacturer, either by personnel of their service organization directly, or by an independent testing agency.
4.4. GOVERNMENT WITNESS TEST - At the option of the government, tests may be witnessed by a representative of Puget Sound Naval Shipyard who shall have the option of sending their technical representative(s) to witness the tests. The Contractor shall schedule and coordinate the test at origin. At least fifteen
(15) days prior to the test, the Contractor shall notify the Shipyard Point of Contact of the scheduled date, time, and location of the test.
4.5. INSPECTION AT DESTINATION
4.5.1. Initial Test and Grooming - The equipment delivered with the system shall by inspected by the Government for mechanical and electrical integrity as follows:
All welds shall be inspected for integrity and appearance.
Surfaces shall be examined for sharp edges and burrs.
Fasteners shall be checked for tightness and if fixed to prevent loosening due to vibration.
Paint will be checked for flaking and blistering.
Electrical requirements shall be examined for compliance to the National Electrical Code, (NFPA
70/79).
The fit of parts shall be observed, with particular reference to the interchangeability of those which are likely to require replacement.
4.5.1.1. Faults will be duly recorded and presented to the contractor for rectification.
4.5.2. Operational Tests - Upon satisfactory completion of the tests above, the equipment shall be setup for an operational test and evaluation by the contractor. The contractor shall demonstrate the ability of the equipment to perform as required in paragraph 3.3.1 on five pieces of material selected by mutual agreement of the Shipyard and the contractor. All equipment functions shall be exercised to the extent necessary to prove proper operation in accordance with specification requirements. The system shall function, without failure, for the duration of this test period. If a failure occurs during the test period, repairs shall be immediately effected by the Contractor, and the tests shall be restarted from the first test. Three failures without completion of the test period shall be considered cause for rejection of the system. For the purpose of this test, a “failure” is defined as any equipment malfunction, which requires remedial action to restore the system to full operation in accordance with contract specifications.
4.5.3. Noise Level Test - The Shipyard Industrial Health and Safety Department shall conduct a noise level survey using a certified sound level-measuring instrument. Four random measurements shall be taken at the operator’s work position(s) and at each side and end of the equipment. For each measurement, the microphone shall be located on a straight line which is perpendicular to the surface/corner being measured and at a height corresponding to the point of the highest noise level emitted from the surface/corner at the herein specified location or distance from the equipment. Each sample shall be 84 dB (A scale) or less. Noise generated by the work piece shall be excluded in determining compliance of the equipment with the 84 dB requirement.
4.5.4. PROVISIONS FOR REPAIR AND RETEST - In the event of a test failure, the contractor, at their discretion, may elect to correct the failed condition and request a retest of the system.
4.5.5. FINAL ACCEPTANCE - Upon satisfactory completion of delivery, inspection, testing of the system, OSHA Approved Certification, and on-site training, the contractor shall utilize electronic invoicing. Invoices must be submitted using Wide Area Workflow (WAWF) - Receipt and Acceptance. The contractor shall self-register at the web site: https://wawf.eb.mil. 4.6. DELIVERY
4.6.1. The receiving activity shall be notified no less than 48 hours prior to the arrival at the site of the contractor’s installation personnel or any equipment associated with this contract.
4.6.2. Shipment of materials shall be coordinated with site preparation and installation. Material transportation from the manufacturer’s facility to the work site shall be the responsibility of the contractor. Limited secured storage areas at the facility will not permit the Government to store material for extended periods of time. Early shipment of materials, without the permission of the receiving activity shall be refused.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment
(AUG 2019)
(a) Definitions. As used in this provision— “Covered telecommunications equipment or services,” “Critical technology,” and “Substantial or essential component” have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Representation. The Offeror represents that—
It ___ will, ____ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
(d) Disclosures. If the Offeror has responded affirmatively to the representation in paragraph (c) of this provision, the Offeror shall provide the following information as part of the offer
(1) All covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);
(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;
(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and
(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

52.204-25 Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment (AUG 2019)
(a) Definitions. As used in this clause—
“Covered foreign country” means The People’s Republic of China.
“Covered telecommunications equipment or services” means–
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country
“Critical technology” means–
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology;
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817). “Substantial or essential component” means any component necessary for the proper function or performance of a piece of equipment, system, or service

L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in Federal Acquisition Regulation 4.2104.
