DLA Maritime Puget Sound Justification For Other Than Full And Open Competition Over $250K (May 21,2018) inspection or training) for one year. Zetec has proprietary rights to the Velocityl.16.x. software that Code 135 owns, and, as such, is the sole source for the license that will unlock the RevospECT HX PRO application. Code 109 has authorized the use of Velocity 1.16.x. and the software is listed in the Department of Navy Application and Database Management System (DADMS) under 120461.

The cost savings in purchasing the RevospECT licen se would be realized in avoidance of increased staffing levels of up to I 00% for eddy current inspection analysts. Currently, the number of available analysts for bobbin and array probe data analysis is insufficient to execute the next several availabilities. The estimated initial cost of increasing staffing levels, and the training associated with qualifying additional analysts, is expected to be at double the cost of the license to use RevospECT HX PRO (approximately $500k initially, with costs associated with continued employment and training of additional analysts extending in perpetuity).

7. Efforts to ensure that offers are solicited from as many sources as practicable are:

8. Market Research:

A sources sought notice was posted on 11 June 2019 with a closing date of 17 June 2019. Zero responses from vendors were received during this time. Velocity 1.16.x software was purchased through contract SPMYM217C0037 (CLIN 0002). This software is the software that is being licensed to add functionality of the auto analysis feature. The previous acquisition was a sole source to Zetec (Cage 51327). The contract was awarded to Jess W. Jackson (Cage 0DLY2), a small business distributor for Zetec. There are no prior purchases found in Procurement Desktop Version 2 (PD2), or fpds.gov for a license to this exact software license.

Software licenses are commercially available through multiple sources, but tend to be issued for the specific software that is being used. The EPA, Unicor and Ability One are all unable to supply this requirement. A search of the Small Business Dynamic website indicates that there are zero small businesses capable of supplying software licenses under NAICS code 334614. GSA Advantage was queried with resulting 10 pages of software licenses for other software programs.

Based upon market research, the recommended acquisition strategy is to solicit this requirement on an unrestricted sole source basis.

9. Additional facts supporting other than full and open competition are:

[x] Based upon the technical certification on file, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

The sources sought notice resulted in zero interested firms.

11. The actions being taken to overcome barriers to competition before any subsequent acquisitions are made are:

The solicitation will be posted on www fedbizops.gov to give adequate opportunity for competition.

12. Fair and reasonable pricing will be evaluated prior to award of the contract. In event that there is not multiple offers for this requirement, market research, and comparison to similar items in industry will be used to achieve fair and reasonable pricing. I determine that the anticipated cost to the Government will be fair and reasonable.
