Justification for Other Than Full & Open Competition (November 2011)
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Solicitation number: TBD
1. Contracting Agency and Activity: __DLA Maritime Puget Sound .
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.

6. The use of the authority cited above is based on:
(1) Need was identified one year ago. The DLA Aviation corporate IDIQ contract for CASCON was supposed to be awarded 10/1/17. Award date continues to slip every month as of 1/31/18.
(2)180 days after receipt of order, but are capable of achieving 120 days in urgent circumstances.
The Navy has an established process for the use of CASCON units throughout the four naval shipyards and industrial maintenance facilities. The proprietary controller (main control panel) is specifically designed from the ground up to support processing parameters that are unique to the current CASCON systems available at all four naval shipyards. It is imperative due to workers safety and the safety of the ship, that all the CASCON units purchased be the same type to allow for compatibility and interchangeability of parts and units amongst the naval community.
Recognition of the communications station & proper response by the trained workers could be compromised with an alternate manufacturer’s design. Circuit operations and compatibility between various components cannot be assured with an alternate manufacturer’s design, if the proprietary design information from R.B. Allen Co. Inc. is not shared openly with that alternate manufacturer.
Depending on the unique repair requirements, some repairs of existing CASCON units will require components identical in form, fit, and function which can only be assured with OEM parts.
Electronically addressable elements using a specific communication protocol are used in the design of communication stations, such that the main control panel can determine the specific identity, status, and location of the communication station. This protocol is proprietary to the R.B. Allen design for intercommunication of the various system components.
In development of the current R.B. Allen Co. design for Casualty Control communications systems used throughout the naval community, the initial corporation-wide purchase was undertaken with the full intent to establish a long-term standardized method and system design for use in all four shipyards and other naval activities. Training of a mobile workforce can be universally applied in changing work sites. Should urgent circumstances necessitate it, sharing of equipment can reduce downtime.
Due to all considerations discussed, it is the conclusion of this procuring activity that R.B. Allen Co. Inc. is the only source capable of providing the engineering and manufacturing services required to result in delivery of the equipment as ordered, compatible with the Navy’s current CASCON systems and processes.
7. Efforts to ensure that offers are solicited from as many sources as practicable are:

8. Market Research:
This requirement is for two (2) each Cascon Systems. These are designed to provide temporary fire alarm systems for submarines. This procurement is to furnish additional Cascon Systems in the event that the current Cascon Systems fail. There is only one proprietary source that supplies the required items, RB Allen (Cage 5E976).
All mandatory sources of supply were vetted, including: Abiltiy One, GSA, EPA, and Unicor (Federal Prison Industries). These sources do not currently supply, and are not capable of supplying the required items. A search of the Small Business Dynamic search resulted in zero small business manufacturers under NAICS code 335929, and keyword, “Cascon”. In addition, ThomasNet yielded no results when searching for Cascon Systems.
A commercial item determination was made in accordance with FAR part 12 acquisition procedures based upon the results of market research. In addition seven (7) previous procurements for the same/similar products were found in the Electronic Document Access (EDA) portal in Wide Area Workflow (WAWF). These seven procurements were all issued on an unrestricted, sole source basis.
An urgency statement, and sole source justification were supplied for this requirement. The solicitation and subsequent award will be issued as unrestricted utilizing the authority of FAR 6.302-1, and FAR 6.302-2.
9. Additional facts supporting other than full and open competition are:
