JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
DLA Maritime Puget Sound, in support of the Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS & IMF), intends to procure the following supplies under other than full and open competitive circumstances based upon the following.
2. Description of Action Being Approved.
The purpose of this J&A is to award a Firm Fixed Price Supply contract on an only one known source basis to obtain twelve (12) complete physics lab work stations that include associated lab equipment, manuals, and curriculum for the PSNS & IMF Apprentice School physics laboratory. Award will be made in accordance with FAR part 12 and 13.5.
3. Description of Supplies/Services.
The minimum needs of the Government include 12 complete work stations that include associated lab equipment and manuals for the USN’s Apprentice School physics laboratory course, from the following original equipment manufacturer (Energy Concepts, Inc). The OEM component part numbers are as follows:

Since 1901 the Puget Sound Naval Shipyard has relied heavily upon an apprentice program to satisfy its need for skilled trades personnel and shop supervisors.
The Industrial Trades Technician (Apprenticeship) Program is a collaborative program between Olympic College, Puget Sound Naval Shipyard, and Naval Intermediate Maintenance Facility. This comprehensive industrial trades program blends theory and practical application to bolster learning experiences in oral and written communications, interpersonal skills, applied mathematics, and applied physics.
The above referenced Apprenticeship Program work stations with associated physics lab equipment and manuals are in addition to an existing ten (10) work stations that altogether must be compatible with the established current physics curriculum, provided by the OEM.

The USN needs for skilled trades personnel has increased and more students have been hired, thus increasing the number of students in the Apprentice Program and the physics lab course accordingly. An additional physics classroom is in the process of being built and these work stations will be installed in the new classroom location.
The estimated cost of this requirement is $xXXXXX for complete physics lab work stations. The appropriate fiscal years funds will be used at the time of contract award.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only One Responsible Source and no other supplies or services will satisfy agency requirements, as authorized by FAR 6.302-1.
5. Rationale Justifying Use of Cited Statutory Authority.
The trademarked technical data required to manufacture these parts is proprietary to the OEM (Energy Concepts, INC). This sole source is being pursued in accordance with current academic curriculum established and taught by Olympic College, an urban-based, but rural-and urban-serving, 2-year public institution in Bremerton, Washington, in collaboration with the USN’s Apprenticeship Program.
Olympic College has been using the OEM equipment and curriculum for over 19 years in support of the college’s physics labs both on campus and on the base at Puget Sound Naval Shipyard in Bremerton, Washington. These work stations will be used by the increased number of students and in order for the physics experiments to remain consistent throughout the Apprenticeship Program, they need to be the same as the existing work stations that are currently being used by Olympic College. The OEM was chosen by Olympic College because it is the only provider of complete physics curriculum and accompanying lab equipment that met the college’s accreditation criteria.
To develop competitive specifications to make these items would require reverse engineering and is not currently within the capabilities of PSNS & IMF’s Apprentice School or its partner, Olympic College.
6. Description of Efforts Made to Solicit Offers from as Many Offers as Practicable.
(a) Sources Sought/ RFI
None Expressing Interest.
A sources sought was posted on 31 August 2016 and currently remains open.
(b) Synopsis.
This effort will be synopsized in accordance with FAR 5.201.

(c) Market Research.
Based on these OEM items being proprietary to Energy Concepts, INC, no additional market research will be conducted as only the OEM components can be utilized.
7. Determination of Fair and Reasonable Cost.
The contracting officer will determine prior to contract award that the cost to the Government for the supplies covered by this J&A is fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
The Government would not attempt to develop competitive specifications at this time as it is not in the position of determining whether new curriculum meets the accreditation criteria of Olympic College. To do so would not be in the best interest of the government.
