1.3. DEFINITIONS
1.3.1. Required Dredging Prism
The dredging prism shall be defined as the area down to the required depth and to the associated side slopes as specified on the contract drawings. The dredging prism does not include the allowable overdepth in the channel or allowable overdepth in the associated side slopes.
1.3.2. Allowable Overdepth Prism
To cover inaccuracies of the dredging process, material actually removed from within the specific areas to be dredged below the required dredging prism to a depth of not more than shown on the contract drawings will be computed and paid for at the contract price. This material is considered to be optional and shall not be considered for purposes of determining any variation in quantity. See Paragraph “Variations In Estimated Quantity – Dredging”.
1.3.3. Side Slopes
Dredging of side slopes is required for acceptance of new work only. Material actually removed from the required side slope section shown on the contract drawings will be computed and paid for at the dredging unit cost per cubic yard for that acceptance section. For the purpose of dredging, the side slopes constitute a design criteria for new work dredging. Side slopes may fall flatter than those shown on the contract drawings. However, no payment will be made for material removed outside these specified limits.
1.3.4. Excessive Dredging
Material taken from beyond the limits as extended in the provisions of Paragraphs “Allowable Overdepth Prism” and “Side Slopes” above will be considered as excessive dredging for which payment will not be made. Nothing herein shall be construed to prevent payment for the removal of acceptance sections performed in accordance with Subsection EXAMINATION AND ACCEPTANCE or Paragraph “Shoaling” and as applicable and as further set forth under Subsection MEASUREMENT AND PAYMENT.
1.3.5. Acceptance Section
For the purpose of acceptance, each acceptance section is shown on the
SECTION 35 20 23 PAGE 5
contract drawings. Acceptance sections may be modified as described in Paragraph “Acceptance of Work”.
1.3.6. Floating Pipeline
Floating pipeline is any pipeline which is not anchored on the channel bottom.
1.3.7. Submerged Pipeline
Submerged pipeline is any pipeline which is anchored on the channel bottom.
1.3.8. Authorized Release Zone Limit
The Authorized Release Zone Limit is the area within the ODMDS that is designated for material placement. Equipment used to transport dredged material may not open doors to release material until inside of this zone.
1.4. MEASUREMENT AND PAYMENT
The Contractor shall dredge each acceptance section to the required depths as indicated on the contract drawings. The required dredging prism for each Contract Line Item shall be considered for purposes of determining any variation in quantity. See Paragraph “Variations In Estimated Quantity – Dredging”.
The required amount of material removed and placed by dredging according to contract specifications will be measured and paid for by the cubic yard in situ based on before and after dredge surveys performed by the Government.
The volume computation method used will be determined according to the most accurate method for each acceptance section and the type of survey performed and may include: the TIN to Channel Single TIN method for before dredge (BD) volumes and the TIN to Channel Dual TIN method for after dredge (AD) volumes, the Philadelphia Pre-dredge Side Slope Non-contour method for BD volumes and the Philadelphia Post-dredge Side Slope Non-contour method for AD volumes, or the Cross Sections and Volumes Philadelphia Predredge method for BD volumes and the Cross Sections and Volumes Philadelphia Postdredge method for AD volumes. After dredge volumes will be calculated from a survey made within five (5) days (weather permitting) after dredging in the Acceptance Section that has been completed. This includes the area within the limits of the allowable overdepth and side slopes described in Paragraph “Allowable Overdepth Prism” and Paragraph “Side Slopes”, less any deductions that may be otherwise required by these specifications. Payment will be made using the after dredge method based on the before dredge survey and after dredge survey for each acceptance section. The net required and net overdepth volumes will be used for payment.
All volume calculations will be computed using HYPACK software. Calculations will be made using survey data collected in accordance with subparagraph “Survey Specifications”. Multi-beam data will be binned to a 3-foot by 3-foot matrix using the average soundings within each cell. All raw survey data and data used for volume computations will be available to the Contractor upon request.
Payment items for the work of this contract will be made as listed in the Bidding Schedule and described below. All costs for items of work, which are not specifically mentioned or are incidental to completion of the work, are to be listed in a particular lump sum or unit price payment item that is most
SECTION 35 20 23 PAGE 6
closely associated with the work involved. The lump sum price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, testing and reports, and for performing all work required for which separate payment is not otherwise provided.
Progress payments shall be made monthly in accordance with the contract clause PAYMENTS UNDER FIXED-PRICE CONSTRUCTION CONTRACTS. Progress payments shall be based on a mutually agreeable percentage of completed work, as described in Paragraph “Work Covered By Contract Price.”
Monthly progress payments will be based on approximate quantities estimated and agreed on with the construction representative using information taken from the surveys as described in Subsection SURVEY.
Within the limit of available funds, the Contractor will be required to excavate the entire quantity of material necessary to complete the work specified herein, be it more or less than the amounts above estimated, and as modified by Subsection EXAMINATION AND ACCEPTANCE and Paragraph “Shoaling”.
All work shall be done in accordance with the contract at the contract price or prices, except as may be affected by Paragraph “Variations In Estimated Quantity – Dredging”.
Final acceptance of the whole or a part of the work and deductions or corrections of deductions made thereon will not be reopened after having once been made, except on evidence of collusion, fraud or obvious error, and the acceptance of a completed section shall not change the time of payment of the retained percentages of the whole or any part of the work.
1.4.1. Continuity of Work
Final payment for and formal acceptance of Acceptance Sections will not be rendered until the Acceptance Section is excavated to the full depth and extents required by the contract. If the Contractor requests, and the Government approves, to adjust the extents of an Acceptance Section, in accordance with Paragraph “Acceptance of Work,” and then is unable to complete that Acceptance Section prior to the planned departure of plant, then the Contractor shall be responsible for the removal of any additional material that may shoal, accrete, or otherwise be deposited in that Section prior to acceptance by the Government, at no additional costs to the Government. See provisions in Subparagraph “Shoaling.” Progress Payments will be made in accordance with SECTION 35 20 23, Subsection MEASUREMENT AND
PAYMENT.

required to be cleared for new work acceptance only.
** 2. The allowable overdepth quantities include the allowable overdepth in the side slopes as shown on the contract drawings.
*** 3. Additional estimated shoaling to occur between acceptance of sections as laid out in the Order of Work, and the required maintenance work, and before dredge survey of new work in Acceptance Sections 6, 7, 8, and 9.
1.4.4. Variations In Estimated Quantity – Dredging
In reference to contract Clause FAR 52.211-18 VARIATIONS IN ESTIMATED QUANTITY, consideration for equitable adjustment will be determined as follows:
Where the quantity of a pay item in this contract is an estimated quantity and where the actual quantity of material within the required dredging prism varies more than fifteen percent (15%) above or below the stated estimated quantity within the dredging prism, an equitable adjustment in the contract unit price will be made upon demand of either party. The equitable adjustment will be based upon any increase or decrease in costs due solely to the variations above one hundred fifteen percent (115%) or below eighty-five percent (85%) of the estimated quantity within the dredging prism. No consideration for an adjustment in the contract unit price will be given for any variation in quantities of material below the required dredging prism or outside the associated side slope lines; such quantities will not be subject to any adjusted unit price.
1.4.5. Shoaling
If before the contract is completed, shoaling occurs in any section previously accepted, including shoaling in the finished channel because of the natural lowering of the side slopes, dredging at contract price, within the limits of available funds, may be done if agreeable to both the Contractor and the Contracting Officer. Shoaling, including natural lowering of the side slopes, that occurs after the before dredge survey for an Acceptance Section and before final acceptance of that Section, shall be the responsibility of the Contractor to remove, at no additional costs to the Government, except in the case of the Government directing the Contractor to move at the direction of the Contracting Officer, or due to the Order of Work requirement under this contract as explained in subparagraph “Final Examination of Work”.
1.5. SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with this section.

1.6. CHARACTER OF MATERIALS
All dredge excavation will be unclassified, regardless of the nature of the materials encountered. It is the responsibility of the bidders to analyze the associated geotechnical information located in the ATTACHMENTS to determine for themselves the character and dredgeability of the materials, the volumes of different types of materials, and the difficulties inherent to performing the scoped work. The Contractor is responsible for properly preparing himself and his equipment to deal with the existing geologic conditions at the project site.
1.6.1. Maintenance
Materials to be excavated are principally those which naturally accumulated as a result of shoaling that has occurred since the areas were last dredged.
The previously maintained depths were 47 feet in the channel plus up to 2 feet allowable overdepth, plus any advanced maintenance in applicable areas.
For purposes of this contract, all materials in Acceptance Sections 6, 8, and 9 shoaler than 48 feet shall be defined as maintenance, and shall be paid at the contract price for maintenance dredging in those templates where maintenance material is included. In areas of this project where advanced maintenance has been previously authorized and dredged, the maintenance depths will be 52 feet (AS-9 Drum Island Reach). These areas are identified on the contract drawings by cross hatching.
Soils encountered during maintenance dredging are typically unconsolidated and unlithified in-shoal material consisting of very soft to soft organic silts, variable-sized sand, clay, silt, gravel, and admixtures of these soil types.
1.6.2. New Work
For the purpose of this contract, all materials in Acceptance Sections 1, 2, 3, 4, 5, and 7 shall be defined as new work. All materials in Acceptance Sections 6, 8, and 9 dredged below 48 feet within the construction template shall be defined as new work. All materials dredged in wideners shall be considered new work. In areas of this project where advanced maintenance has been previously authorized and dredged, the new work depths will be any materials below 52 feet (AS-9 Drum Island Reach).
SECTION 35 20 23 PAGE 13
Geotechnical information concerning the geologic materials to be dredged in the new work is provided in the ATTACHMENTS. Elevations shown on the boring logs and condition survey reflect the condition of the channel bottom at the time the survey/boring was taken. Elevation correction for MLW on borings is MLLW = MLW -0.20 feet. The Contractor should be aware that a portion of the geologic material that was originally sampled by a particular boring may have been removed by subsequent dredging or erosion. The Plan Sheets show the location of all geotechnical borings drilled within the harbor acceptance sections. A summary boring table, which contains boring coordinates, elevation intercept with respect to channel bottom, and general soils information is provided in the ATTACHMENTS. Drilling logs from borings drilled prior to 2004 may show coordinates that are in World Geographic Reference System or South Carolina State Plane, North American Datum 1927, Survey Feet. These coordinate locations were converted to South Carolina State Plane International Feet, North American Datum 1983, and are shown on the plan sheets and in the boring summary information table in the
ATTACHMENTS.
New Work Material that is expected to be encountered within Acceptance Sections 1, 2, 3, 4, 5, 6, and 7 generally consist of stiff to hard calcareous lean silt and clay, with minor amounts of medium dense silty to clayey sand. Standard Penetrometer Test (ASTM D1586) maximum N-values range from 9 to 37. Acceptance Section 8 is floored by similar material; very stiff to hard, calcareous clayey silt and silty clay, with variable amounts of fine sand. Maximum SPT N-values range from 19 to 30. Acceptance Section 9 is floored by stiff to very stiff calcareous silt and clay, interspersed with deposits of very soft fat clay, peat, and loose silty sands. Maximum SPT N-values range from 12 to 21.
1.6.3. Historical Geotechnical Reports

debris can be removed during normal dredging operations, it shall be removed by the Contractor. Debris removed from the dredged area shall be removed from the water. Disposal shall be the responsibility of the Contractor and disposal shall be outside the limits of government property. The removal and disposal of this debris shall be accomplished at no additional cost to the Government. Disposal of debris will not be permitted on the riverbanks, in navigable waterways, or Government provided dredged material placement areas unless otherwise specified.
1.6.5. Unexploded Ordnance
In a previous permit issued for dredging in the vicinity of the Hugh G.
Leatherman Terminal(HLT), an area of concern (AOC 501) for unexploded ordnance (UXO) was defined. This area is displayed in the contract drawings.
AOC 501 lies mostly within an area outside of the authorized (45-foot) federal channel, and had not previously been dredged prior to construction of the HLT facility. A private, new work dredging event has since occurred over the area. For this reason, it is not anticipated to be encountered on this project, but has been previously encountered in the past in nearby areas. The Contractor is not entitled to an equitable adjustment or reimbursement for work stoppages totaling 24 hours or less from the time the Contracting Officer directs the Contractor to stop dredging operations. Each encounter shall be handled on a case by case basis. A standard operating procedure for encountering UXO shall be included in an Unexploded Ordnance Plan which shall be incorporated into the Accident Prevention Plan.
If an UXO is encountered, Contractor shall immediately contact the United States Coast Guard (USCG) – Sector Charleston Command Center for instruction.
The USCG will coordinate with the local sheriff and the Air Force EOD. Upon receiving instruction from the USCG, the Contractor shall immediately notify the COR.
1.7. CONSOLIDATED REPORT
The Contractor shall submit a consolidated report within 30 days after completion of all work associated with this contract and shall include, as a minimum, the information listed on the form, CONSOLIDATED REPORT provided in the ATTACHMENTS. Final payment to the Contractor will not be made until this report has been received by the Contracting Officer.
