CAUTION NOTICE

It is the responsibility of all those submitting offers in reply to this Request for Quote (RFQ), to read, understand and comply with the terms, conditions and restrictions of this solicitation.

This solicitation incorporates technical/quality requirements (‘R’ or ‘I’ number in section B). The full text is in the DLA Technical and Quality Master List of Requirements at: http://www.dla.mil/HQ/Acquisition/Offers/eprocurement.

1. This solicitation contains the requirement for Qualified Products List (QPL) 53039 Black Aerosol Coating, NSN 8010-01-633-9122

2. This procurement is being solicited on an Unrestricted Basis.

3. FOB Destination applies. All pricing MUST be submitted on an F.O.B. Destination basis. Inspection/Acceptance will take place at Destination.

4. A fixed price contract is anticipated. The suggested delivery is 120 days.

5. Delivery will be to:

6. The Government intends to issue an award to the responsible vendor offering the lowest price and taking no exceptions to the terms and conditions of the solicitation. Taking no exceptions to the terms and conditions of the solicitation means that an offer must meet or exceed all of the terms and conditions set forth in the solicitation.

Therefore, offerors are cautioned to take extreme care in reading and responding to this request for quote.

7. Trade Agreements (DFARS 252.225-7021) applies and is the controlling source restriction for this procurement.

8. Other than cost and pricing data may be requested in support of your quote.

9. NOTICE: Page 8 of the solicitation contains TQ L09 for Reverse Auction (RA). The Government reserves the right to activate this provision after timely offers have been received and evaluated. Prior to doing so the Contracting Officer will establish a competitive range, decide whether a reverse auction will be conducted, and determine which firms will participate in that event. Those firms removed from the competitive range will be notified in writing prior to the Government conducting a reverse auction.

10. Prior to award, the Contracting Officer will make a determination of responsibility regarding the proposed awardee in accordance with FAR 9.104-1.

11. Invoicing: All invoicing will be done via Wide Area Workflow procedures (WAWF). Reference DFARS 252.232-7003 Electronic Submissions of Payment Requests and Receiving Reports.

12. Variation in quantity of +0%, -0% is applicable.

13. ***Please be advised that all ‘Fill-In’ clauses must be completed. Failure to complete these clauses or making exception to any of the terms and conditions of the solicitation may result in your offer being excluded from consideration for award.***

14. A copy of the Material Safety Data Sheet (MSDS) as well as a copy of the Hazardous Communication Standard (HCS) I/ A/W OSHA 29 CFR 1910.1200, MUST be submitted in conjunction with the quote.

15. This NSN has a 12-month shelf life. All material furnished under this contract shall have at least 85% of the shelf life remaining at the time of delivery.

16. All quotes, as well as any required supporting documentation including, but not limited to, pricing, SDS and HCS I/A/W OSHA 29 CFR 1910.1200, and fill-in clauses, must be submitted via the DLA Internet Bid Board System (DIBBS / https://www.dibbs.bsm.dla.mil/Solicitations/) and received by the solicitation closing date – Wednesday, July 11, 2018 at 3:00 P.M. Eastern Standard Time (EST).

17. The item offered/furnished must be manufactured by an approved QPL Manufacturer. No substitution will be accepted.

18. Vendor’s Quote shall remain valid for ninety (90) days unless Contractor states otherwise.

19. Offers of Surplus Material will NOT be accepted.

Effective June 1, 2015, Federal Standard No. 313-E, Material Safety Data, Transportation Data andDisposal Data for Hazardous Materials Furnished to Government Activities, establishes the requirement for preparation and submission of Safety Data Sheets (SDS) in lieu of Material Safety Data Sheets (MSDS) by suppliers who provide hazardous materials togovernment activities.

The Occupational Safety and Health Administration (OSHA) has modified its Hazard Communication Standard(HCS) to conform to the United Nations Globally Harmonized System of Classification and Labeling of Chemicals.

As a result of thischange, GSA revised Federal Standard No. 313-E requiring Safety Data Sheets for classifying chemicals and communicating theapplicable information on labels.

In accordance with the revised standard after June 1, 2015:

1. Suppliers will be required tosubmit, to the contracting officer for review and approval prior to award, safety data sheets consistent with the requirements found at 29 C.F.R. 1910.1200 for hazardous materials delivered to the Government.

52.211-17 DELIVERY OF EXCESS QUANTITIES (SEP 1989) FAR

252.211-7005 SUBSTITUTIONS FOR MILITARY OR FEDERAL SPECIFICATIONS AND STANDARDS (NOV 2005) DFARS As prescribed in 211.273-4, use the following clause:

(a) Definition. “SPI process,” as used in this clause, means a management or manufacturing process that has been accepted previously by the Department of Defense under the Single Process Initiative (SPI) for use in lieu of a specific military or Federal specification or standard at specific facilities. Under SPI, these processes are reviewed and accepted by a Management Council, which includes representatives of the Contractor, the Defense Contract Management Agency, the Defense Contract Audit Agency, and the military departments.

(b) Offerors are encouraged to propose SPI processes in lieu of military or Federal specifications and standards cited in the solicitation. A listing of SPI processes accepted at specific facilities is available via the Internet at http://guidebook.dcma.mil/20/guidebook_process.htm (paragraph 4.2).

(c) An offeror proposing to use an SPI process in lieu of military or Federal specifications or standards cited in the solicitation shall

(1) Identify the specific military or Federal specification or standard for which the SPI process has been accepted;

(2) Identify each facility at which the offeror proposes to use the specific SPI process in lieu of military or Federal specifications or standards cited in the solicitation;

(3) Identify the contract line items, subline items, components, or elements affected by the SPI process; and

(4) If the proposed SPI process has been accepted at the facility at which it is proposed for use, but is not yet listed at the Internet site specified in paragraph (b) of this clause, submit documentation of Department of Defense acceptance of the SPI process.

(d) Absent a determination that an SPI process is not acceptable for this procurement, the Contractor shall use the following SPI processes in lieu of military or Federal specifications or standards:

ADDENDUM TO 52.212-01 INSTRUCTIONS TO OFFERORS - COMMERCIAL ITEMS

52.212-02 EVALUATION - COMMERCIAL ITEMS (OCT 2014) FAR

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
