About this file
This justification document outlines a proposed sole source procurement by the Defense Logistics Agency Troop Support for HEPA air vacuum systems components from DCM Clean Air Products, Inc. The procurement includes three proprietary starter kits identified by National Stock Numbers that are only manufactured by DCM Clean Air Products as the original equipment manufacturer. The justification cites 10 U.S.C. 2304(c)(1) and FAR 6.302-1 as the authority for this other than full and open competition procurement due to DCM being the only responsible source. The proposed single award contract would have a one year base period and four one year options with an estimated total value of $17-25 million. The solicitation is planned for issue on or around April 20, 2021 with responses due on or around May 20, 2021.

4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, only one responsible source and no other supplies will satisfy agency requirements.
5. The use of this authority is necessary because DCM Clean Air Products, Inc. (0YBX0), the manufacturer of the DCM HEPA Air Vacuum Systems and its accessories, is the only known approved source of supply for the subject POSI-VAC Starter Kits that meet the needs of the Government. DCM Clean Air Products holds the Design/Source Control for these NSNs. These items are tools used to support aircraft maintenance, specifically used as accessories for air filtration systems which help to reduce exposure to hazardous dust. These proprietary components are critical to the operation of DCM’s HEPA Air Vacuum Systems. These systems were specifically engineered in coordination with the US Army and US Air Force and were designed with a three-filter filtration system that captures dust, asbestos, lead, and other harmful toxins that have been linked to occupational diseases such as lung cancer, respiratory diseases, and dermatitis.
DCM’s HEPA Air Vacuum Systems are small, portable units that make them ideal for use on small aircrafts or ships. These systems’ have proven to be highly effective in capturing harmful dust at the source of its generation. These three components are accessories that are manufactured exclusively for the DCM Vacuum Systems, and the sole components that will suit the needs of the Government.
The first NSN requirement, part number 151153, is a kit of both tools and accessories that were designed to work with the HEPA air filtration systems. Included in this kit are battery powered tools and attachments specific to the systems, which facilitate bolt and fitting removal from wheeled vehicles and aircrafts, without exposing the workers to dust and fumes.
The second NSN requirement, part number 150074, is a storage box containing accessories that were engineered specifically for the structural and composite repair teams that maintain wheeled, tracked, and aviation vehicles. Accessories contained in this kit include netting to secure cargo, and code locks to secure gear. This storage box is insulated to protect resins, coatings, and other temperature sensitive repair products.
The third NSN requirement, part number 150085, is a kit containing electric powered sanders and tools. This kit was manufactured specifically to support dust collection tools when electrical power, or generators, are not available. This kit allows the aircraft maintainers to work safely on their vehicles when compressed air powered tools are not available.
These NSNs are commercial items and are customarily available in the commercial marketplace.
6. The subject acquisition will be posted to Contract Opportunities in accordance with FAR 5.2.
This justification will also be published with the solicitation in accordance with FAR 6.305(c).
7. As the contracting officer, I hereby determine the anticipated cost to the Government will be fair and reasonable based on price analysis techniques in accordance with FAR 15.404-1(b)(2), specifically comparison to historical prices paid and prices obtained through market research for the same, or similar, items or price list.
8. Market research was conducted through a Market Research Survey provided to DCM Clean Air Products, Inc., the Original Manufacturer, who expressed interest in this solicitation. The Market Research Survey was returned by DCM on October 22, 2020, and it stated that this item is customarily available in the commercial marketplace. Market Research Analysis of available internet materials, such as catalogs, was also performed. In addition, a Sources Sought Notice was posted in Beta.Sam.Gov on November 6, 2020 and closed on December 7, 2020. No responses were received.
9. There are no other facts supporting the use of this authority.
10. DCM Clean Air Products, Inc., is the only source that has supplied these NSNs in the past, and the only source to express interest in the proposed acquisition.
11. Procurement Notes M06, Evaluation of Offers for Part Numbered Items and L04, Offers for Part Numbered Items, encouraging the submission of offers for alternate products will be included in the solicitation. Any alternate offers received will be forwarded to the Product Specialist for evaluation and approval.
12. As the contracting officer, I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
