DLA Land and Maritime is considering a solicitation and subsequent Award of an Indefinite Quantity Contract (IQC) or Long Term Contract (LTC) for the items listed the attached spreadsheet. Procurement Item Descriptions can be found at the end of this document. As a potential supplier of these items, we are asking that you fill out this market survey to the best of your knowledge so that we can generate a realistic and beneficial solicitation. * The following pertain to the requirement for certified Cost or Pricing Data or Information Other Than Cost or Pricing Data. For contracts estimated over $2,000,000*, certified Cost or Pricing Data “may” be required. Contractors are greatly encouraged to view the sample format found at http://www.dcaa.mil to understand the in depth information required for submission.

Cost or pricing data is not required for commercial items. However, it is the contracting officer’s authority to determine an item(s) commercial or not. IV. COMMERCIAL QUESTIONS:

* It is the Contracting Officer’s authority to determine an item(s) commercial or not and if the commercial price(s) are Fair and Reasonable. This is usually accomplished through proof that commercial market forces have driven the setting of the commercial price.

Such proof would describe the commercial market acceptance of the price or, more plainly, invoices proving that the item has been sold commercially at like prices, for like quantities. Without proof of commerciality the IDC project cannot be processed as a commercial procurement (FAR Part 12), but will rather be processed using non-commercial procurement procedures (FAR Part 15).

Hazard Communication Standard Notice:

Effective June 1, 2015, Federal Standard No. 313-E, Material Safety Data, Transportation Data and Disposal Data for Hazardous Materials Furnished to Government Activities, establishes the requirement for preparation and submission of Safety Data Sheets (SDS) in lieu of Material Safety Data Sheets (MSDS) by suppliers who provide hazardous materials to government activities.

The Occupational Safety and Health Administration (OSHA) has modified its Hazard Communication Standard (HCS) to conform to the United Nations Globally Harmonized System of Classification and Labeling of Chemicals.

As a result of this change, GSA revised Federal Standard No. 313-E requiring Safety Data Sheets for classifying chemicals and communicating the applicable information on labels.

In accordance with the revised standard after June 1, 2015:

1. Suppliers will be required to submit, to the contracting officer for review and approval prior to award, safety data sheets consistent with the requirements found at 29 C.F.R. 1910.1200 for hazardous materials delivered to the Government.

2. Suppliers will also be required to submit, to the contracting officer for review and approval prior to award, Hazardous Communication Standard (HCS) labels in accordance with 29 C.F.R. 1910.1200 requirements or current Consumer Product Safety Act (CPSA), Federal Hazardous Substance Act (FHSA) labels when subject to labeling requirements under those statutes. This product labeling is required for hazardous materials delivered to the Government.

3. Finally, suppliers must train their employees on the new safety data sheets, hazardous communication labels, and requirements of 29 C.F.R.

1910.1200.

DESIGN CONTROL NUMBER AS IT APPEARS ON THE

CONTRACT OR ORDER.

BAR CODE MARKING:

BAR CODE MARKING IS REQUIRED FOR ALL SHIPMENTS

AND SHALL BE APPLIED IN ACCORDANCE WITH AIM BC1

AND MIL-STD-129.

EXCLUDED FROM BAR CODE MARKING:

WARNING LABEL (HWL):

THE ABOVE PACKAGING AND MARKING INSTRUCTIONS ARE

IN ADDITION TO AND DO NOT SUPERSEDE THE REQUIRE-

MENTS TO FURNISH A MSDS AND HWL(S) AS DIRECTED

BY FARS 52.223-3, HAZARDOUS MATERIAL IDENTIFI-

CATION AND MATERIAL SAFETY DATA (JAN 1997) AND

DFARS 252.223-7001, HAZARD WARNING LABELS

(DEC 1991).

THE CONTRACTOR SHALL SUBMIT A COMPLETED MSDS

WITH APPLICABLE HWL(S) IN ACCORDANCE WITH

FED-STD-313. THE CONTRACTOR SHALL IDENTIFY THE

MAGNETIC FIELD STRENGTH WITHIN SECTION 3

(PHYSICAL AND CHEMICAL DATA) OF THE MSDS.

THE MSDS AND APPLICABLE HWL(S) SHALL BE REQUIRED

TO BE SUBMITTED BY THE APPARENTLY SUCCESFUL

OFFEROR AND SHALL BE EVALUATED/APPROVED BY

DSCC-VSS, PRIOR TO CONTRACT AWARD.
