I. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies on other than a full and open competition basis.

3. The supplies required to meet the using activity's needs are described as follows:

This FSC 4820 is a liquid oxygen valve used to transfer liquid oxygen from a supply source to the LOX converters of the FA-18 aircraft, other military aircrafts and on the civilian side it's used on civilian EMS helicopters throughout the United States. The number of LOX equipped civilian EMS helicopters in the US is estimated to be around 600 aircraft.

4. The statutory authority permitting other than full and open competition is:

10 U.S.C. 2304(c)(]) - Available from only one or a limited number of sources.

5. If restricted to the only source(s) of supply, include source(s) and CAGE code: Because only the approved source possesses the complete technical data for the item listed, they are the only source uniquely qualified to manufacture this item; therefore, this acquisition will be solicited with other than full and open competition under the authority of IO U.S.C 2304(c) (I), as implemented by FAR 6.302.

This item is a critical safety item, and in accordance with DFARS 209.270, DLA must procure this item only from those sources approved by the design control activity. At this time, only Essex Industries Inc. has been approved by the design control activity to supply this CSI.

The use of the authority cited is based on:

AMSC C: This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the parts in the intended application.

______________Product Specialist or record for this NSN indicated on December 13, 2016 that the AMC/AMCS code is 3/C and that the Navy CSI website indicates that the only approved source is Essex Industries (19062).

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

a. The acquisition will be synopsized on or about March 30, 2017, and will run for 15 days. At the completion of the synopsis period, the RFP will be solicited on the internet for 30 days, via the DLA Internet Bid Board System (DIBBS).

b. Alternate items will be evaluated for this procurement.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

Past procurement history will be reviewed, and a price analysis will be performed using the producer price indexes from the Bureau of Labor Statistics. The basis for determining the reasonableness of this procurement will be price analysis, analysis of the prices in the commercial market place plus other than cost or pricing data will be reguested if needed.
