JUSTIFICATION FOR FULL AND OPEN COMPETITION
SPE7MX-15-R-0061

ADDENDUM (attach copy of original J & A for add-ons or revisions)
1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.
3. The supplies required to meet the using activity's needs are described as follows:
The subject solicitation is an IQC project for a 3 year base period with two options of one year each for NSN 6105-01-211-6635 (Motor, Direct Current) with an ADQ of 919. This item is a direct current motor used by the U.S. Air Force, Army, and Marines on numerous military vehicles, including the HMMWV. The AMC/AMSC is 3/B with estimated values as shown on the chart below.

4. The statutory authority permitting other than full and open competition is:
(x) 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
5. If restricted to the only source(s) of supply, include source(s) and CAGE code:

The use of the authority cited in other than 10. U.S.C. 2304(c)(2) above:
(x) AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer. Only Unimotor possesses the necessary data and legal rights to the data to manufacture this ESA approved item.
The use of the authority cited is based on:
[X] AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate

DLA Land & Maritime 1 technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid. In this case, Unimotor is the source specified on the applicable source control drawing. Unimotor is the only source that possesses the drawings necessary to manufacture this item.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
(x) The acquisition will be synopsized.
( ) Manufacturers of similar products identified in the market research will be solicited.
(x ) Dealers of the manufacturer will be solicited.
( ) A synopsis exception cited in FAR 5.202 applies. (explain)
(x) Other. (Explain) Sources Sought Notice posted to FedBizOps on 2/12/2015.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
- The basis for the Government’s fair and reasonable price determination is anticipated to be price analysis and/or analysis of other than cost & pricing data and the review of past buy history completed during market research. Further, the contract length will be 3 years, plus 2 options of one year each, based on the information obtained during market research.
8. Market Research/Efforts to Obtain Competition:
Other market research efforts include: A review of the purchase history, coordination with the DLA Land and Maritime Small Business Office, and a review of the project data by DLA Land and Maritime- ZCC. DLA Land and Maritime Product Specialists reviewed the data prior to assignment and solicitation preparation. Although a Sources Sought notice was posted to FEDBIZOPS on 2/12/2015, no responses were received.

9. Additional facts supporting other than full and open competition are:
(x) Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
DLA Land and Maritime-VE was contacted on 02/13/15 by email. responded on 02/17/15 by email and stated that although there is an open project, no responses from alternate companies were received in response to their inquiries.
10. A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state) Windward Enterprises (0UKB6)
11. In addition to the specific actions being taken by Technical Support personnel to overcome barriers to competition before any subsequent acquisitions or recertification of class determination are made, this item is subject to the following methods of locating additional sources:

Market Research / Survey
Market Survey Results: Formal market survey was conducted with one of the last awardees, Windward Enterprises (Windward). It appears that AM General was contacted, but did not respond to the market survey. Windward is a distributor for the approved source for NSN 6105-01-211-6635 (L5176) Unimotor, and was the only response received to the market survey. The results of the survey are as follows:
A detailed market survey was conducted with Mr. of Windward. The vendor’s survey responses and follow-on emails were completed by 2/13/2015 and yielded the following data: Windward is a small business distributor/dealer with 3 employees located in Ridgeland, SC with no parent company, Windward has indicated an interest in participating in a long-term contract with DLA.
indicated that this item is not commercially available. The indicator in SAP shows that the item is non-commercial. For these reasons, the item is determined to be non-commercial. The last several awards have been to Windward, acting as a dealer for Unimotor.
Value Engineering was contacted as to whether or not they had any current projects. Although there is an open project, no responses were received from prospective sources.

Patricia, You're probably safe to put this item on LTC from a VE perspective. The only thing that's going on with it is we advertised it on the RPPOB website to try and find an additional source of supply. As of today no other contractor has submitted a SAR.
