JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7MC16R0111

DLA Land & Maritime Justification for Other Than Full & Open Competition (April 2014)

ORIGINAL

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies/services on other than a full and open competition basis.

3. The supplies/services required to meet the using activity’s needs are described as follows:

Valve, Swing, Check 48200108454933 579 C

This Valve, Swing Check supports the Blackhawk UH-60A Helicopter. The swing check valve is check valve in which the disc, the movable part to block the flow, swings on a hinge or trunnion, either onto the seat to block reverse flow or off the seat to allow forward flow. The seat opening cross-section may be perpendicular to the centerline between the two ports or at an angle.

4. The statutory authority permitting other than full and open competition is:

10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.

5. If restricted to the only source(s) of supply, include source and CAGE code:

The approved sources of supply for this part are Parker Hannifin Corp. CAGE 3H889 P/N 2770006- 101, Parker Hannifin Corp. CAGE 59211 P/N 2770006-101, Sikorsky Aircraft Corp. CAGE 78286 P/N 70307-03045-101. This NSN requires engineering source approval by the design control activity in order to maintain the quality of the part. Parker Hannifin Corp. and Sikorsky Aircraft Corp. are the only known sources with the proven manufacturing capacity and capability to produce this item to meet the Government’s needs. This is a Navy Critical Safety Item. The Government has no data for full and open competition.

AMC 1. Suitable for competitive acquisition for the second or subsequent time.

(The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.)

AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

• The acquisition will be synopsized on or about 7-22-16.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

Price analysis using past contract history will be performed, and negotiations will be conducted to address price as well as delivery. Other than certified cost or pricing data may be requested, if necessary, in order to determine the price fair and reasonable. It is anticipated that the price will be determined fair and reasonable based on price analysis and negotiations. A one time, firm fixed price award will be made for the quantity of 579 each.

8. Market Research/Efforts to Obtain Competition:

Market Survey [10 U.S.C. 2304(f)(3)(D)]:

A market survey was conducted on/during June 1-6, 2016.

Total number of vendors contacted: three.

Names of vendors contacted: Intergrated Procurement Technologies, Sikorsky Aircraft Corp., Parker Hannifin Corp.

Names of vendors responding: Intergrated Procurement Technologies

Techniques used to conduct survey:

• The NSN was reviewed in Haystack and manufacturers of similar items were researched using the Thomas Register. The Acquisition Specialist verified that the part is not on the GSA schedule. Past buys were reviewed in Records Management.

• Market surveys were emailed to the approved large manufacturers and one small business dealer. One completed survey was returned on 6-6-16 with the following information:

Integrated Procurement Technologies (CAGE 4K0V2) is an authorized distributor for Parker Hannifin (CAGE 59211). They submitted a market survey on 6-6-16 and indicated the following:

• They are a small business distributor for Parker Hannifin Corp (59211).

• They are willing to submit an offer.

• This is not a commercial item.

A Sources Sought Notice with a market survey attached was also posted to Fed Biz Ops from 6-1-16 to 6-6-16. No responses were received.

Information received regarding the commerciality of the item: Per review of past orders for this NSN and information from the authorized distributor during market survey, there is no indication that this is a commercial part. It is not stocked or price listed. It is not on the GSA schedule.

In accordance with DFARS PGI 206.303-2(B), the buyer has reviewed the items procurement history for the last procurement over the simplified acquisition threshold to locate a copy of the previous

DLA Land & Maritime Justification for Other Than Full & Open Competition (April 2014) justification to assist the approval authority in determining whether the planned actions to remove any barriers to competition cited on the previous justification were completed. The last procurement over SAT was contract SPM4A112G0003033J in October 2013 by DLA Aviation in Richmond. Although some records for this procurement exist in Records Management, the buyer was unable to locate a copy of the previous justification.

9. Additional facts supporting other than full and open competition are:

Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. Date of the last technical certification is 6-23-2016. The data presently available reflects the minimum needs of the Government. The Government does not own the data or the rights to the data needed to purchase this part from additional sources.

10. A listing of sources, if any, indicating an interest in the acquisition is:
