JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7M918R0010

The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
The action being approved is the acquisition of supplies on other than a full and open competition basis.
The supplies required to meet the using activity’s needs are described as follows:

Identify end item, weapon system, or class of item: Subject NSN 6110-01-259-0267is described as a Regulator, Voltage and is part of weapon system TANK, M-60 SERIES. The Regulator, Voltage is component within a single enclosure or provided with a single mounting specifically designed to control automatically the voltage output of an electrical system within certain required limits, regardless of variations of the effective load of input voltages within a specific range. Does not include items in which regulation is accomplished solely by transformer action. The United States Army is the Primary customer.

The statutory authority permitting other than full and open competition is:

If restricted to the only source(s) of supply, include source(s) and CAGE code: Electro-Tech INC (21699).
The use of the authority cited is based on:
[ X ] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
[ X ] AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.
Per the approved manufacturer part list available for this NSN in SAP, only Electro-Tech INC (21699) has been identified by the Government as having the complete technical dataset and appropriate manufacturing expertise to supply this NSN to DLA and the using military service. NSN 6110-01-259-0267 is designated as a non critical item, and its weapon system indicator code is F (failure will render the end item inoperable). As such, acquisition from the currently approved sources is required to maintain the quality of the part. Last technical review of this item was conducted on 1/2/2018 and no additional sources beyond those listed in the AMPL were identified. Based upon the technical review, only the approved source currently listed in the AMPL has the complete technical data and manufacturing expertise to successfully manufacture this item for the Government and the using military service.
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Efforts to ensure that offers are solicited from as many sources as practicable are:
[ X ] The acquisition will be synopsized on or about 01/20/2018. The solicitation SPE7M118R0010 will be available via DIBBS for 30 days on or about 2/12/2018.
I hereby determine that the anticipated cost to the Government will be fair and reasonable. The buyer will utilize price analysis techniques such as comparison to past purchases of same item to determine price reasonableness.
Informal cost/price data will be requested if determined to be necessary.
A market survey was conducted on/during: 12/15/2017
Market research consisted of review of past procurements, Internet research and a Sources Sought. The unsolicited requirement were initially generated on 12/8/2017 for a quantity of 408. The quantity was increase on 12/15/2017 to a quantity of 444 per the supply planner to accommodate an increase of demand.
Total number of vendors contacted: A Sources Sought notice was posted by SAPD to FBO on 12/15/2017 and closed on 12/22/2017. No responses were received.
Names of vendors contacted and responding: A market surveys was requested via email and was received on 12/15 /2017 from Electro-Tech Inc (21699). There were no other market surveys requested by the buyer and 0 surveys were received from the Sources Sought notice.
Types of information requested: Size of business, type of business, commerciality, price-listed/stocked inventory status, willingness to offer proposal, delivery schedule, quantity sensitivity, FDT acceptance, inspection/acceptance points, hazardous materials.
Summary of information: Electro-Tech Inc (21699) is a Woman Owned Small manufacturer (WOSB) with a preference to do business with the government Per Electro-Tech, NSN 6110-01-259-0267 is or commercial. The
PR history reflects: This NSN has been procured from (21699) Electro-Tech on every procurement dating back to 1988.
Electro-Tech is the sole source OEM providing the approved PN 14400. The most recent procurement was made 11/28/2017 on SPE7M118C0005 for 283 each. The price was determined to be fair & reasonable by (BG) Comparison to most procurement. The most prior J&A is attached for review (Attachment 1).
Additional facts supporting other than full and open competition are:
[ X ] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state) Electro-Tech INC (21699)

This item is subject to the following methods of locating additional sources: Efforts to Qualify Additional Suppliers for future procurements include the following: Any new vendor who decides to pursue source approval will be directed to the Competition Advocate's Source Approval Program. The Competition Management Office (CMO) would encourage interested parties to submit Source Approval Request (SAR) for this item if it should later be determined that future buys of subject NSN are in the best interest of the Government.
[ X ] The solicitation contains the DLAD Procurement Notes L04/M06.
