1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies on other than a full and open competition basis.

3. The supplies required to meet the using activity's needs are described as follows:

4. The statutory authority permitting other than full and open competition is:

10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.

The use of the authority cited is based on:

AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

AMSC R. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

(X) A Sources Sought synopsis was posted in Fed BizOpps on June 22-28, 2016. A response was received from Sparton Brooksville, llc.(8W588) with interest in becoming a potential source. They were placed on the Solicitation Mailing List.

(X) This requirement will be synopsized for 15 days during July, 2016.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. In order to determine the cost as fair and reasonable the following actions will be taken: 1) Assistance from the DLA Land and Maritime Pricing Office may be requested if needed; 2) Target prices will be established through Price Analysis.

8. Market Research/Efforts to Obtain Competition:

Market Survey [10 U.S.C. 2304(f)(3)(D)]:

Market Surveys were sent to Stag Enterprises (0YSA1), JGILS, LLC (1N8T8); Coltec Industries DBA Fairbanks Morse Engineering (82796) and Dela Technologies (2U435) on June 16, 2016 and since no replies were received, the Market Surveys were sent a second time on June 23, 2016. Howco Distributing (5E074) was sent a Market Survey on June 23, 2016.

Total number of vendors contacted: 5.

Names of vendors contacted and responding: Stag Enterprises (0YSA1), JGILS, LLC (1N8T8); Coltec Industries DBA Fairbanks Morse Engineering (82796) and Dela Technologies (2U435), Howco Distributing (5E074) were sent Market Surveys. On June 23, 2016, a Survey was returned from Howco Distributing and on June 24, 2016, a Survey was returned from Chand, LLC a distributor for Coltec Industries (DBA Fairbanks Morse Engineering).

Techniques used to conduct survey: The survey was conducted via e-mail.

Types of information requested: business size, estimated delivery, manufacturer or dealer status, source of supply, if part is inventoried, commerciality, if part is catalog price listed, interest to submit an offer, willingness to quote priced option years, informal pricing for economical quantity ranges and registration in SAM.

Summary of information received:

o Howco Distributing (5E074) provided the following responses to the Market Survey: they are a small business and a distributor who works exclusively with the Government, they are located in Vancouver, WA, this part is not commercial, they will submit an offer, o Chand, LLC returned their Survey on June 24, 2016. Coltec (DBA Fairbanks Morse Engineering) forwarded their Survey to Chand, LLC with the explanation that they “have an alliance with CHAND LLC (0D5X4) to handle this business”.

Chand, LLC provided the following replies in their Market Survey: they are a large business located in Matthews, LA; is

Information received regarding the commerciality of the item: The Market Survey result received from Howco Distributing stated that this item as not commercial. A search of MM03 “Commercial Off-the-shelf” section returned NO entry. Past procurements for this item have not been procured commercially. A search of Google using part numbers: Cage (82796) 13002339 and Cage (F0579) FC09AEA0, did not display any retail pricing information, and a search of GSA Advantage returned “no results” for these part numbers.

9. Additional facts supporting other than full and open competition are:

The technician, confirmed the AMC/SC as 3/R and remains valid. The Government does not have the drawings/data.

The only approved sources on the TIR are: Coltec Industries DBA Fairbanks Morse Engineering (82796) P/N 13002339. No additional approved sources exist at this time.

Requirement is currently restricted to Coltec Industries DBA Fairbanks Morse Engineering (82796) P/N 13002339. They are the only source owning/possessing the technical data to manufacture this item. .

No drawings/data are available at DLA. The manufacturers listed above must have the drawings/data in order to manufacture this item.

This is a Circuit Card Assembly that is used on weapon systems 33N:

10. A listing of sources, if any, indicating an interest in the acquisition is: On June 23, 2016, Sparton Brooksville, llc (8W588) responded with interest and was added to the Bidder’s List.

Howco Distributing (5E074) returned their Market Survey on June 23, 2016 indicating an interest to submit an offer. Chand, LLC (0D5X4) returned their Survey on June 24, 2016 indicating an interest to submit an offer.

The solicitation contains the provision entitled Conditions for Evaluation and Acceptance of Offers for Part Numbered Items.
