JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7M4-17-R-0042

Justification for Other Than Full & Open Competition (April 2014)

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies on other than a full and open competition basis.

3. The supplies required to meet the using activity's needs are described as follows:

• This solicitation is for 154 pieces of NSN 4720-00-053-4577, “Hose, Nonmetallic”.

The weapon system 05F (Aircraft, Stratolifter C/KC), and 06F Aircraft, Hercules C-130, for the Hose, Nonmetallic

• NSN item HOSE, NONMETALLIC is a critical application item. This is a Navy Critical Safety Item (CSI), FAR 52.246-11, Higher Level Contract Quality Requirements applies. First Article testing is not required. Hose, Nonmetallic, 2-3/8 IN. ID, 93 FT LG also referenced with federal logistics item name code 22670 - A flexible, tubular item having a nonmetallic tube inner conveying surface and one or more reinforcement layers of a metallic or nonmetallic material. It is designed to convey gasses, liquids, or solids. For items with fittings on one or both ends, see hose assembly, nonmetallic. Excludes hose, air duct; and hose air duct, air breathing.

• The primary customers are the US Navy and the US Air Force. The AMC/AMSC code for this item is 1C. The solicitation has an estimated base value of for qty of 154, and with quantity ranges up to 180 units. These prices were based on the DPC estimated at a unit price of

4. The statutory authority permitting other than full and open competition is:

• 10 U.S.C. 2304(c) (l) - Available from only one or a limited number of sources.

5. If restricted to the only source(s) of supply, include source(s) and CAGE code:

• Sargent Fletcher Inc. (72429) P/N 128B5030-11

• Sargent Fletcher Inc. (72429) P/N 128B5030-11-3

• Eaton-Aeroquip Inc. (3E6R6) P/N EH63138-93

• AMC 1. Acquire, for the second or subsequent time, directly from the manufacturer.

o Two manufactures are approved for this item.

• AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity.

The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.

• Per the approved manufacturer part list available for subject NSN 4720-00-053-4577, bo th Sargent Fletcher Inc. (72429) P/N 128B5030-11 and Sargent Fletcher Inc.

(72429) P/N 128B5030-11-3 and Eaton-Aeroquip Inc. (3E6R6) P/N EH63138-93 has been identified by the Government as having the complete technical dataset and appropriate manufacturing expertise to supply this NSN to DLA and the using military service. The weapon system indicator code is F "Failure will render end item inoperable". As such, acquisition from the currently approved source is required to maintain the quality of the part. The last technical review of this item was conducted on 03/10/17 and no additional sources beyond those listed were identified. Based on the technical review, only the approved sources have the complete technical data and manufacturing expertise to successfully manufacture this item for the Government and the using military service.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

• The acquisition will be synopsized on or about 09/26/17 and will run for 15 days. At the completion of the synopsis period, the PR will be solicited on the internet for 30 days, via the DLA Internet Bid Board (DIBBS).

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

• Past procurement history will be reviewed, and a PPI price analysis will be performed.

Based upon past contract history, it is anticipated that the award will be determined fair and reasonable. Informal cost/price data will be requested if determined to be necessary. Quantity ranges of up to 180 u nits will also be included.

o No responses were received from the Sources Sought on FedBizOpps.

o Eaton Hydraulics LLC CAGE (45X75) returned a completed survey by e-mail they are a large business manufacturer interested in the subject acquisition. Per Eaton Hydraulics LLC CAGE (45X75) NSN 4720-00-053-4577 is non catalog/price listed, or commercial, o Cobham Mission Systems Division (72429) did not return a completed survey Per Connie Davies, Inside Sales, Service and Support, II. Thank you for your request but unfortunately Eaton is our supplier for this part.

o Cobham Mission Systems Division (72429) owns Sargent Fletcher Inc. (72429).

Sargent Fletcher Inc. (72429) is one of the approved source manufactures of this item.

o Eaton-Aeroquip CAGE (3E6R6) does not quote direct on items they quote thru Eaton Hydraulics LLC CAGE (45X75). The parts would be made at the Eaton- Aeroquip CAGE (3E6R6) location and all paper goes thru Eaton Hydraulics LLC

CAGE (45X75).

• Information regarding the commerciality of the item(s): Based on Internet research that did not reveal any commercial sales history or catalogs/brochures, AMC/AMSC of 1C, blank SAP COTS status, and 0 results found on GSA Advantage site, NSN 4720-00-053-4577, in accordance with FAR 2.101, is considered to be non-commercial.

• Previous history reflects all orders dating from 04/30/10 thru 09/16/16 have been awarded to Eaton Hydraulics LLC CAGE (45X75) there was an unredacted J&A and a re-dacted J&A found in the file issued under solicitation SPE7M314R0041 for this NSN 4720-00-053-4577.

Based upon the technical certification on file in DLA Land and Maritime -VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government
