JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7M219R0021
DLA Land & Maritime Justification for Other Than Full & Open Competition
(FEB 2017)

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.
3. The supplies required to meet the using activity’s needs are described as follows:

Identify end item, weapon system, or class of item: 1710-01-535-6530 is described as an Overhaul Kit used for the Repeatable Release Holdback Bar (RRHB) Overhaul for ALRE, 82N, Catapult and Arresting Gear.

4. The statutory authority permitting other than full and open competition is:
[ X] 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
5. If restricted to the only source(s) of supply, include source(s) and CAGE code: The Government is restricting procurement to CAGE 97415, Triumph Actuation Systems’ part numbered item.
In accordance with DFARS 209.270-3, DLA must procure from NAVAIR approved sources for ALRE Critical Safety Items. In addition, NAVAIR INST 4200.56 states the following with regard to sources. Per references
(a) and (g), a CSI shall be purchased or repaired and/or overhauled only from sources approved by the TA.
Aviation Critical Safety Items and Related Services and (g) SECNAVINST 4140.2. Triumph Actuation Systems is the only source approved by NAVAIR for this CSI item and, per DFARS 209.270-3, DLA must only procure Triumph Actuation Systems’ part numbered item.
The use of the authority cited below:
[X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
The use of the authority cited is based on:
[ X ] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid. Pursuant to the engineering and design activity, Naval Air Systems Command, (97415) Triumph Actuation Systems has the appropriate manufacturing expertise and quality capabilities to supply this NSN. The acquisition of only the currently approved source’s part numbered item is required to maintain the quality the part.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
[ X ] The acquisition will be synopsized on or about May 6, 2019 for 15 days.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. The most recent procurement for this NSN was made in 2018 and determined reasonable based on comparison to past buys. This procurement will require Certified Cost and Pricing Data for a DCMA and DLA review. A price analysis will also be conducted using the most recent price which was determined to be fair and reasonable.
8. Market Research/Efforts to Obtain Competition:

Names of vendors contacted and responding: Cage 97415, Triumph Actuation Systems
Techniques used to conduct survey: Posted a Sources Sought on April 16, 2019 for 5 business days with attached market survey to FedBizOpps. Sources Sought produced no responses. Emailed a market survey to be completed by Cage 97415, Triumph Actuation Systems.
Types of information requested: Business size, estimated price and delivery, economical quantities, commerciality, purpose and function, and capability to provide Cost and Pricing Data.
Summary of information received: Cage 97415, Triumph Actuation Systems is a large business manufacturer. Item is not commercial.
Information received regarding the commerciality of the item(s): There is no evidence that the NSN is available on the commercial market nor is it of a type customarily used by the general public or by non-governmental entities for purposes other than government or military purposes as defined in FAR 2.101. An internet search was completed for this item, and there is no evidence that the item is sold in the commercial market. It is specifically used for military purposes.
9. Additional facts supporting other than full and open competition are:
[ X ] Other: (Explain) This is a Critical Safety Item with an SPC code of 01. Naval Air Systems Command, Lakehurst (NAVAIR) is the design control activity and determines which manufacturers are capable of producing the item to its CSI requirements. NAVAIR has provided 1 approved small business source for this NSN. Cage 97415, Triumph Actuation Systems has the proven capabilities and quality processes for manufacturing.
10. A listing of sources, if any, indicating an interest in the acquisition is: CAGE 97415, Triumph Actuation Systems.
11. The following actions are being taken to identify additional sources:
