JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7M2-16-R-0074

DLA Land and Maritime Justification & Approval for Other than Full and Open Competition (J&A) (April 2014)

ADDENDUM (attach copy of original J & A for add-ons or revisions)

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies/services on other than a full and open competition basis.

3. The supplies required to meet the using activity's needs are described as follows:

*Based on the maximum incremental quantity of 10 EA, for the solicited quantity of 6 EA at the estimated unit value of $ EA, based on procurement history.

4. The statutory authority permitting other than full and open competition is:

a. 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources. This item is a critical application item. At this time, only the two identified sources have met the qualification standards and are the only sources that have been approved by the design control activity.

5. If restricted to the only source(s) of supply, include source(s) and CAGE code:

Based on all of the research and information available as annotated in this document, the only sources known that possess the technical data necessary to manufacture this item at this time are:

Flowserve Corp. (52374) for P/N: SMB-0-40 and Emerson Process Management Valve (01379) for P/N: 84285.

The use of the authority cited below:

AMC 1: Suitable for competitive acquisition for the second or subsequent time

The use of the authority cited is based on:

AMSC B: This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

It is noted that the process of developing and releasing a Purchase Request (PR) requires, first a review and determination by the Product Specialist that the technical data is correct, including the AMC and AMSC codes, and it reflects the minimum requirements for the item. Second, a review and determination by the Supply Planner that the item is needed and the quantity is accurate. In an abundance of caution, the Acquisition Specialist requested the quantity be validated by the Supply Planner on 9/7/16 (the time of solicitation preparation). Validation of the quantity was received on 9/8/16.

Based on all of the above, it is demonstrated that Flowserve Corp. (52374) for P/N: SMB-0-40 and Emerson Process Management Valve (01379) for P/N: 84285 are the only sources known to possess the technical data necessary to manufacture this item at this time.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

a. A Sources Sought Notice was posted on FEDBIZOPPS with a Market Survey attached.

b. A Market Survey was mailed directly to the approved source(s).

c. The acquisition will be synopsized on FEDBIZOPPS for a period of 15 days.

d. The solicitation will be posted publically in DIBBS and will be open for a 30 days period.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable based on a review of the most recent previous procurements, market research and PPI Price Analysis. This solicitation is for a one time buy, for a quantity of 6 EA. The price for this solicitation will be negotiated as needed after evaluation.

8. Market Research/Efforts to Obtain Competition:

All sources responding to the market research results will be included on the Bidders List for this solicitation. A Sources Sought Notice was posted via FEDBIZOPPS on August 11, 2016 through August 19, 2016 and produced no results. The approved sources of supply were contacted directly for the market survey. The survey specifically requested an expression of interest, estimated price and delivery, business size, socioeconomic classifications, information regarding commerciality and information regarding other potential manufacturing sources. Flowserve: Intends to quote as a large business manufacturer . Item is non-commercial, sold to 100% Government.

Buyer has determined that the item is not commercial as documented in the Acquisition Plan. A search was performed in Haystack, looking for potential past manufacturers of this item. No new sources were found. Total number of vendors contacted: Infinite, via FEDBIZOPPS posting.

9. Additional facts supporting other than full and open competition are:

a. Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

b. It is restated here that based on all of the research and information above, the coded sources listed above are the only sources known that possess the technical data necessary to manufacture this item at this time.

c. There is no attached J&A for review as previous acquisition was not procured via

DLA.

10. A listing of sources, if any, indicating an interest in the acquisition is:

11. The following actions are being taken to identify additional sources:

a. All offerings of alternate items will be considered and forwarded for evaluation.

b. The solicitation contains the provision entitled Conditions for Evaluation and

Acceptance of Offers for Part Numbered Items.

c. The solicitation will be posted on the DLA Internet Bid Board System (DIBBS), in

FEDBIZOPPS and on the DSCC Bid Board.
