The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
The action being approved is the acquisition of supplies on other than a full and open competition basis.
The supplies required to meet the using activity’s needs are described as follows:

The use of the authority cited is based on: (The following are condensed versions of the AMSC descriptions. The full text is available in DFARS PGI 217.7506 Part 2).
[ X ] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid. The product specialist of record verified on 27 FEB 2019 that a review of the subject NSN was completed on 26 FEB 2019 and that the material master for this NSN is considered accurate and is ready for procurement. As a result of market survey possible part number change identified. Tech responded the correct part number is PC0614-2331-1 and initiated a catalog action to update the part number on the material on 4/11/2019.
Therefore, information regarding the technical specifications for this item is accurate and complete.

Per the approved manufacturer part list available for the subject NSN, only the sole above source has been identified by the Government as having the complete technical dataset and appropriate manufacturing expertise to supply this NSN to DLA and the using military service. The weapon system indicator code is “T”. “Failure will render end item inoperable”. As such, acquisition from the currently approved sources is required to maintain the quality of the part.
The Government does not have the data. Smiths Detection, Inc. is uniquely qualified because they are the only known source with the data necessary to manfacture this item. Smiths Detection will not release the data to the Government. The source identified above has demonstrated the unique and proven manufacturing capabilities to establish and maintain the processing control required to repetitively produce this item. The use of incorrect material and/or improper process/quality control during manufacture would render the end item inoperable.
Efforts to ensure that offers are solicited from as many sources as practicable are:
[ X ] The acquisition will be synoposized on or about 05/13/2019 and will run for 15 days. At the completion of the synopsis period the solicitation SPE7M1-19-R-0015 will be available via DIBBS for 30 days.
I hereby determine that the anticipated cost to the Government will be fair and reasonable. Formal C/P Data will not be required because the current estimated contract price is below the price threshold of $2,000,000 (per Class Deviation 2018-O0015 to FAR 15.403-4 and 10 U.S.C. 2306(a)). Offerors may be required to provide additional information for determining reasonableness of price. The buyer only intends to award this NSN when a fair and reasonable price determination can be made. The Contracting Officer will conduct price analysis by reviewing historical pricing, usage of the Producer Price Index (PPI), and learning curve analysis. The acquisition specialist may ask for assistance from the DLA Land and Maritime pricing office if necessary. Negotiations may take place in an effort to comply with DoD Material Cost Reduction Initiative. An option quantity will not be used for this procurement.
A market survey was conducted on/during: February 27, 2019 to March 11, 2019.
Total number of vendors contacted: Market Survey was emailed to the sole approved source: Smiths Detection, Inc (23667). As well as 7 independent dealers that quoted on previous PRs under the simplified acquisition threshold:
Pride Electronics, Inc (7N929), Equipment Parts Sales (1N0P1), WBParts, Inc (46PU2), Hermes Technical International (0MYY3), Aviarms Support Corp (58985), Spaires, Inc (6ZPL8), WKF (Friedman) Enterprises, Inc (6KB87). A sources sought notice with attached market survey was posted to FedBizOps on February 27 through March 11, 2019. The only response received from the market survey was from Smiths Detection. No other responses to the market survey or the sources sought notice posted on FedBizOps were received.
Types of information requested: Company size, is the company a dealer or manufacturer, if a manufacturer are there any authorized dealers or distributors, who are the authorized dealers and distributors, is this item commercial, if commercial is it sold to the private sector, is the item a catalog item, is it on a GSA schedule, what is the delivery schedule, what are the appropriate incremental quantities, Inspection/Acceptance/FOB Origin/Destination acceptable?
Summary of information received: Smiths Detection, Inc (23667) responded to the market survey on March 5, 2019.
They did not complete and return the market survey sent to them but they did provide a copy of a “first time buy questionnaire” they completed on a previous buy. They also included their previous awards for this item and award confirmation. The completed first time buy questionnaire contained the following information: Smiths is a manufacturer that regularly makes these types of items, they sell to various entities
And DLA L&M cannot have the technical drawing or description.
. They have received two prior awards from DLA for this item (see procurement history above). However, market survey resulted in identifying the correct part number for this item is: PC0614-2331-1 and not 0614-2331M-1 as it was listed in the master and on previous awards. Per phone conversation with OEM this is an administrative change and the item is same form, fit, and function as previous part number.

Contracting Officer who provided a copy of the basic contract and further confirmed the NSN on this procurement (6665-01-483-2919) was not on this contract or included in any of the modifications.
Information regarding the commerciality of the item(s): Based on past history review and Internet research that did not reveal any commercial sales history, catalogs/brochures, or established price list, blank SAP COTS field status, and market survey responses, and in accordance with FAR 2.101 this item is considered to be non-commercial.
Additional facts supporting other than full and open competition are:
[ X ] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

Efforts to Qualify Additional Suppliers for future procurements include the following: Any new vendor who decides to pursue source approval will be directed to the Competition Advocate's Source Approval Program. The Competition Management Office (CMO) would encourage interested parties to submit Source Approval Request (SAR) for this item if it should later be determined that future buys of subject NSN are in the best interest of the Government.
