JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

The action being approved is the acquisition of supplies on other than a full and open competition basis.

The supplies required to meet the using activity’s needs are described as follows:

Identify end item, weapon system, or class of item: Subject NSN 6625-01-217-2553 is described as a Case, Electric, equipment, and is used on the B-2 BOMBER as support equipment.

The statutory authority permitting other than full and open competition is:

[X] 10 U.S.C. 2304(c) (1) - Available from only one or a limited number of sources.

If restricted to the only source(s) of supply, include source(s) and CAGE code: AAI Corporation DBA Textron Systems (97384).

[X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

[X] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.

Per the approved manufacturer part list available for this NSN in SAP, only AAI Corporation DBA Textron Systems (97384) has been identified by the Government as having the complete technical dataset and appropriate manufacturing expertise to supply this NSN to DLA and the using military service. NSN 6625-01-217-2553 is designated as a non-critical item, and its weapon system indicator code is T (failure will render the end item inoperable). As such, acquisition from the currently approved sources is required to maintain the quality of the part. Last technical review of this item was conducted on 8/1/2018 and no additional sources beyond those listed in the AMPL were identified. Based upon the technical review, only the approved sources currently listed in the AMPL has the complete technical data and manufacturing expertise to successfully manufacture this item for the Government and the using military service.

Efforts to ensure that offers are solicited from as many sources as practicable are:

[X] The acquisition will be synopsized on or about 9/28/2018. The solicitation SPE7M118R0054 will be available via DIBBS for 31 days on or about 10/15/2018.

I hereby determine that the anticipated cost to the Government will be fair and reasonable. The buyer will utilize price Analysis techniques such as comparison to past purchases of same item to determine price reasonableness.

Informal cost/price data will be requested if determined to be necessary. Quantity ranges of up to 10 units will Also be included.

A market survey was conducted on/during: 5/29/18

Market research consisted of review of past procurements, Internet research and a Sources Sought. The unsolicited requirement were initially generated on 03/20/18 for a quantity of 4.

Total number of vendors contacted: A Sources Sought notice was posted by SAPD to FBO on 5/29/2018 and closed on 6/4/2018. The Sources Sought revealed no other potential manufacturing sources for NSN 6625-01-217-2553 apart from AAI Corporation DBA Textron Systems (97384).

Names of vendors contacted and responding: A market surveys was requested via email on 5/29/2018 and no response was received on from AAI Corporation DBA Textron Systems (97384). The buyer was able to abstain price break information by email from AAI Corporation DBA Textron Systems (97384). AAI Corporation DBA Textron Systems also stated in the email that they do not have qualified dealers and they prefer to do the bidding themselves. There were no other market surveys requested by the buyer and 0 surveys were received from the Sources Sought notice.

Types of information requested: Size of business, type of business, commerciality, and price-listed/stocked inventory status, willingness to offer proposal, delivery schedule, quantity sensitivity, FDT acceptance, inspection/acceptance points, and hazardous materials.

Summary of information gathered: AAI Corporation DBA Textron Systems (97384) is a large business manufacturer with a preference to do business with the government. or commercial. Based upon the last RFQ, the solicitation will be issued with a delivery requirement of 419 days, FOB origin (FDT) and inspection/acceptance destination requirements. The approved manufacturer did respond via email about price breaks being offered for an order of at least 3 EA.

PR history reflects: AAI Corporation DBA Textron Systems (97384) as the awardee on all awards dated 12/27/2012 thru 3/5/2018. All the awards were reviewed and AAI Corporation DBA Textron Systems (97384) was the only offer received on each. The estimated unit price in , The last award was issued on 03/05/2018 for quantity of 1 EA. A total of 1 offer was received from the approved source, AAI Corporation DBA Textron Systems (97384). This is the first time that this NSN is being solicited as an RFP therefore there was not a previous J&A available.

Additional facts supporting other than full and open competition are:

[X] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

This item is subject to the following methods of locating additional sources: Efforts to Qualify Additional Suppliers for future procurements include the following: Any new vendor who decides to pursue source approval will be directed to the Competition Advocate's Source Approval Program. The Competition Management Office (CMO) would encourage interested parties to submit Source Approval Request (SAR) for this item if it should later be determined that future buys of subject NSN are in the best interest of the Government.
