JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7M1-17-R-0008

ADDENDUM (attach copy of original J & A for add-ons or revisions)
1. The Defense Logistics Agency, DLA Land and Maritime is the contracting activity.
2. The action being approved is the acquisition of Compressor Unit, Rec, used on support equipment for the F-15 aircraft, using other than full and open competition by restricting the manufacturing sources to the only approved sources: Pacific Consolidated Industries (75906), and Hydraulics International (56529). AMC/AMSC codes for this procurement are AMC 1, AMSC P. Tech OPS Review Date: 08/08/16. Definitions are AMC 1: Suitable for competitive acquisition for the second or subsequent time. AMSC P: The rights to use the data needed to purchase this part from additional source(s) are not owned by the Government and cannot be purchased, developed, or otherwise obtained. It is uneconomical to reverse engineer this part. This code is used in situations where the Government has the data but does not own the rights to the data. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid. Per ESA, at this time only the listed approved sources, Pacific Consolidated Industries and Hydraulics International, have the technical data required to manufacture this item

4. The statutory authority permitting other than full and open competition is:
(X) 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
5. If restricted to the only source(s) of supply, include source(s) and CAGE code:
Pacific Consolidated Industries (75906), Hydraulic International (56529).
The use of the authority cited in other than 10. U.S.C. 2304(c)(2) above:

6. Efforts to ensure that offers are solicited from as many sources as practicable are:
(X) The acquisition will be synopsized on or about _01/20/17.
(X) Dealers of the manufacturers will be solicited.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
PPI analysis will be utilized to develop target pricing and analyzing the purchase price in comparison to the target pricing. Other than Certified Cost and Pricing Data will be requested if/as necessary
8. Market Research/Efforts to Obtain Competition:
A sources sought notice (with attached market survey) was posted to FedBizOpps on 12/09/16 with responses due 12/16/16. A response was received from Integrated Procurement Technologies, Inc. (IPT) (4K0V2), a small authorized dealer for approved source Pacific Consolidated Industries.

A market survey was emailed to both approved sources, Pacific Consolidated Industries and Hydraulic International on 12/12/16 with a response requested by 12/16/16. Both manufacturers responded to the market survey. Responses to market surveys below.
Market Survey Results:
Pacific Consolidated Industries LLC responded to the market survey with the following information: Pacific is a small manufacturer with 110 employees. They do have approved dealers/distributors. Per Pacific, this is not a commercial item, Hydraulics International, Inc. responded to the market survey with the following information:
Hydraulics is a small manufacturer with 413 employees. They do not have approved dealers or distributors. Per Hydraulics, this is not a commercial item, Integrated Procurement Technologies (IPT) responded to the market survey with the following information: IPT is a small dealer/distributor for Pacific Consolidated Industries, Inc. IPT failed to respond to the rest of the questions on the market survey.
The GSA schedules were searched for this NSN on 12/09/16. This NSN is not available on a GSA schedule.
A Google search resulted in the following information: Price Range: $22960.00 to $35192.00;
Delivery Range: 200 to 311 days; Mfr/OEM/Agencies: Pacific Consolidated Industries, (ESA approved Hydraulics International on 7/6/16 and reaffirmed them as an approved source on 11/28/2016); Suppliers: Hydraulics International, Inc., Integrated Procurement Technologies, Statz Corporation;
The Pacific Consolidated Industries website (http://pci-intl.com/) was searched but no price list or catalog was available. A search of the Hydraulics International, Inc. website (http://www.hiigroup.com/main/partslist) could not locate this item. A search of IPT’s website (http://www.iptsb.com/) failed to locate a price list or parts catalog.
9. Additional facts supporting other than full and open competition are:
(X) Based upon the technical certification on file in DLA Land and Maritime-VEP, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
10. A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state) Hydraulics International, Inc. (56529), Pacific Consolidated Industries (75906), and Integrated
Procurement Technologies (4K0V2).
11. This item is subject to the following methods of locating additional sources:
(X) The solicitation contains the DLA Land and Maritime Procurement Notes L04, Offers for Part Numbered Items, and M06, Evaluation of Offers for Part Numbered Items.
Previous large procurement which required a J & A was SPE7M1-17-C-0002 in the amount of $734,720.00 awarded on 12/02/16. The J & A for this procurement was available in Records Management. A signed copy of the J & A was available in Records Management. Copy of previous J&A is attached.
