JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7L4-14-R-0164
ORIGINAL
1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis.
3. The supplies required to meet the using activity’s needs are described as follows:
This solicitation is for 51 each of NSN 2805-01-350-8874, MANIFOLD EXHAUST which is a repairable part on the exhaust system of the LCAC Hover Craft. This item has an AMC/AMSC code of 3C; the solicitations base will be , no options will be included.
4. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1) - Available from only one or a limited number of sources; with that source being SHAPES GROUP
LTD (3CJ11). .
5. If restricted to the only source(s) of supply include source(s) and CAGE code: SHAPES GROUP
LTD. CO. (3CJ11)
The use of the authority cited in other than 10. U.S.C. 2304(c)(2) above is AMC 3;aquire, directly from the manufacturer and the use of the authority cited is based on the AMSC it has of C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part.
SHAPES GROUP LTD. CO. (3CJ11) is the approved source which has retained the data rights and is the only company known that has the manufacturing knowledge. Our technical department on 01/30/14 verified that SHAPES GROUP LTD. CO. (3CJ11) is the only known source and the correct AMC/AMSC codes have been assigned.
6. Efforts to ensure that offers are solicited from as many sources as practicable are that the acquisition will be synopsized on or about 06/16/2014
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable based on price analysis and past procurement history.
8. A market survey was conducted on May 13, 2014 Total number of vendors contacted: Two; SHAPES GROUP LTD. CO. (3CJ11) and ACUDYNE (9V120), various internet searches were conducted.
Names of vendors contacted and responding: SHAPES GROUP LTD. CO. (3CJ11) and ACUDYNE (9V120).
Techniques used to conduct survey: Emailed survey to OEM SHAPES GROUP LTD and the other previous source that was listed on Haystack. Various internet searches and haystack was researched.
Haystack revealed that there was a previous manufacturer of the material and it is Accudyne.
Accudyne was sent a market survey and Shapes Group was asked about their relationship with Accudyne. Accudyne had no information regarding the material etc but Shapes Group stated that Accudyne originally manufactured this material in 2002, they closed the plant, it became Ultrafab and was purchased and the name changed to Shapes Group LTD.
Types of information requested – Price Breaks, Business size, commerciality, if P/N is valid Summary of information received: The P/N is valid and procurable, price breaks are at 10, 20 and 30 each.
Information received regarding the commerciality of the item(s): The part is not a commercial item and only manufactured for the LCAC Hover Craft.
9. Additional facts supporting other than full and open competition are that the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
