SOLICITATION SPE7L316R0089
DLA LAND & MARITIME JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. The Defense Logistics Agency, DLA Land and Maritime is the contracting activity.
2. The action being approved is the acquisition of supplies on other than a full and open competition basis. This requirement is in accordance with Waukesha Bearings Corp (07332) P/N 000080037- 000, Pad, Thrust, Accessories for the VIRGINIA CLASS SUBMARINE, SSN-774.
3. The supplies required to meet the activity's needs are described as follows:

4. The statutory authority permitting other than full and open competition is:
10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
Brief narrative supporting the situation and weapon system:
The weapon system code specified for this particular NSN is YJN, which is used on the
Virginia Class Submarine, SSN-774. This requirement is in accordance with Waukesha Bearings Corp (07732) P/N 000080037-000. Waukesha Bearings Corp (07732) is the only approved source for this item.
5. If restricted to the only source(s) of supply, include source(s) and CAGE code:
• Waukesha Bearings Corp (07732) P/N 000080037-000
The use of the authority cited in other than 10. U.S.C. 2304(c)(1) above:
• The PR Trailer indicated that only the source cited above has been approved to provide this part, and is the only source that has been approved to produce this item.
AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
AMSC D. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source require acquisition of the part from the approved source. The approved source retains data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. It is confirmed the AMC/AMSC code of 3D, and that Waukesha Bearings Corp (07332) is the only known source that possesses the technical data required to manufacture this item and has the design control to maintain the quality of the specified part.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
• The acquisition will be synopsized on or about 6/25/2016 and will be synopsized for 15 days. At the completion of the synopsis period, the PR will be solicited on the internet for 30 days, via the DLA Internet Bid Board System (DIBBS).
• Alternate items will be evaluated for this procurement, but will be referred to the Product Specialist of record for final approval. If vendors wish to be considered as an approved source, the vendor is required to provide a complete SAR data package, which may take from 30 to 180 days to be evaluated.
• Waukesha Bearings Corp (07332), the sole manufacturer, as well as Kingsbury Inc.
(3PLH0) will be included on the bidders list.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
• This is a definite quantity contract, for a quantity of: 78 pcs, with a 100% Option, for a total quantity of 156 pcs. (See Attachment #1)
• I hereby determine that the anticipated cost to the Government will be fair and reasonable. The unit price will be determined fair and reasonable based on past buy history and /or a price analysis prepared by the buyer. Based upon past contract history, it is anticipated that the award will be determined fair and reasonable. This will be a definite quantity contract.
• This item is being procured on an All or None basis, and Multiple/Split awards will not be considered.
8. Market Research/Efforts to Obtain Competition:
Describe the market research conducted and the results.
• A Sources Sought Notice was posted on FedBizOpps, in accordance with PGI 206.302- 1, seeking to identify potential sources of supply for NSN 2530014802484. The Sources Sought Notice was posted on 5/10/2016, with a response date of 5/16/2016. One vendor Kingsbury Inc. (3PLH0) did response to the sources sought notice. As this NSN has an AMSC of “D”, “The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation.

A market survey was conducted on/during 5/10/16 – 5/16/2016

2. Names of vendors contacted and responding:
Waukesha Bearings Corp (07332).
3. Techniques used to conduct survey: The market survey was conducted by e-mail.
4. Types of information requested:
• Size of business
• Manufacturer or dealer
• Whether stock is on hand, or will need to be manufactured.
• Commerciality
• Estimated delivery
• Whether or not item is quantity/price sensitive
Summary of information received:
• of Waukesha Bearings Corp (07332) was sent the market research via email, on May 5, 2016, and the market research was returned back via email from Waukesha Bearings Corp (07332) stating Waukesha Bearings Corp does intend to quote this item.
• of Kingsbury Inc. (3PLH0) responded to the sources sought via the FedBizOpps.Gov website. Kingsbury Inc., states they are a “for profit organization, manufacturer of goods, contracts and grants” for NAICS 332710, 332721, 332999, 333611. A phone conversation occurred between the Contract Specialist, and to explain how to submit a SAR package.
Information received regarding the commerciality of the item(s):
• An internet search was conducted using OEM P/N 000080037-000, but no results were found.
9. Additional facts supporting other than full and open competition are:
Based upon the technical certification on file in DLA Land and Maritime-VEP, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
10. A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state)

11. In addition to the specific actions being taken by Technical Support personnel to overcome barriers to competition before any subsequent acquisitions or recertification of class determination are made, this item is subject to the following methods of locating additional sources:
The solicitation contains the provision entitled Conditions for Evaluation and Acceptance of
Offers for Part Numbered Items
• Per PGI 206.304 (a)(1), the requirement states that “the justification shall include a copy of the previous justification to assist the approval authority in determining whether the planned actions to remove any barriers to competition cited on the previous justification were completed.”
o The previous contract for subject NSN was: SPE7L316M0988. It was awarded on 11/23/2015, for a total contract value of: $117,600.00. This purchase was made under the SAP, and therefore did not require a J&A. The contract prior to number SPE7L316M0988, is contract SPM7L212C0032, which was awarded on 5/10/2012 and did require a J & A. The J & A is available for review. (See Attachment #2)
• Subject NSN has an AMC/AMSC of 3-D, which means the data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation.
