JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
PR 0058353213; SOLICITATION SPE7L315R0120
SOURCE SELECTION INFORMATION – SEE FAR 2.101 AND 3.104

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.
2. The action being approved is the acquisition of supplies/services on other than a full and open competition basis. This requirement is in accordance with Van Products Co (63513), P/N 5304390, Bollinger Shipyards Lockport, (64513), P/N 243-6736967 PC 25 and SKF USA Inc.
DBA SKF Coupling (9V902), P/N OKCE 115/SS/176141.
3. The supplies/services required to meet the using activity's needs are described as follows:
This solicitation is for 8 pieces of NSN 3010-01-411-4227, “Coupling Half Shaft”. The AMC/AMSC code for this item is 3D. The solicitation has an estimated base value of
; with a 50% option for an estimated total value of . This is an unrestricted procurement. The weapon system code specified for this particular NSN is Z0N which is used on Coastal Patrol Boats. This requirement is in accordance with Van Products Co (63513), P/N 5304390, Bollinger Shipyards Lockport, (64513), P/N 243-6736967 PC 25 and SKF USA Inc. DBA SKF Coupling (9V902), P/N OKCE 115/SS/176141. A Sources Sought Notice was posted in FedBizOpps, in accordance with PGI 206.302-1, seeking to identify potential sources of supply for NSN 3010-01- 411-4227. The Sources Sought Notice was posted on 6/3/15, with a response date of 6/12/15. No responses were received.
4. The statutory authority permitting other than full and open competition is:
10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.
There are three (3) approved sources for this item: Van Products Co (63513), Bollinger Shipyards Lockport, (64513) and SKF USA Inc. DBA SKF Coupling (9V902).

The use of the authority cited in other than 10 U.S.C. 2304(c)(1) above:
AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
AMSC D. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source require acquisition of the part from the approved source. The approved source retains data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction

over the part in the intended application. It is confirmed the AMC/AMSC code of 3D, and that Van Products Co (63513), Bollinger Shipyards Lockport, (64513) and SKF USA Inc. DBA SKF Coupling (9V902) are the only known sources that possesses the technical data required to manufacture this item and has the design control to maintain the quality of the specified part.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
The acquisition was synopsized on 12/10/2015 and will be synopsized for 15 days. At the completion of the synopsis period, the PR will be solicited on the internet for 30 days, via the DLA Internet Bid Board System (DIBBS).
Alternate items will not be evaluated for this procurement, but will be referred for possible future acquisitions. For alternate offers, the supplier is required to provide a complete SAR data package, which may take from 30 to 180 days to be evaluated.
Van Products Co (63513), Bollinger Shipyards Lockport, (64513) and SKF USA Inc.
DBA SKF Coupling (9V902) are included on the bidder list.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
I hereby determine that the anticipated cost to the Government will be fair and reasonable. The unit price will be determined fair and reasonable based on past buy history and /or a price analysis prepared by the buyer. Based upon past contract history, it is anticipated that the award will be determined fair and reasonable. This will be a definite quantity contract.
This item is being procured on an All or None basis, and Multiple/Split awards will not be considered.
8. Market Research/Efforts to Obtain Competition:
Market Survey [10 U.S.C. 2304(f)(3)(D)]:
Market research was conducted on 6/2/2015 with responses due by 6/9/2015 by e-mail.
Total number of vendors contacted two (2). Van Products was not contacted due to buyer not being able to secure contact information on the vendor in the System for Award Management System (SAM). Bollinger Shipyards Lockport, (64513) was not contacted due to buyer oversight.
Names of vendors contacted and responding: Applied Industrial Technologies Inc. and SKF USA Inc. Applied Industrial Technologies Inc. and SKF USA Inc. responded on 6/8/2015.

Summary of information received:
o Applied Industrial Technologies Inc. responded that they were a large business dealer. Applied Industrial Technologies Inc. stated that the item was not commercial and that they would be willing to quote on this requirement.
o SKF USA Inc. responded that they were a large business manufacturer. SKF USA Inc. stated that the item was commercial: therefore commerciality documentation was request on 11/19/2015, with a response due by 11/23/2015. No response was received for evaluation. SKF USA Inc. states that they would be willing to quote on this requirement.
9. Additional facts supporting other than full and open competition are:
Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government. This requirement is in accordance with Van Products Co (63513), P/N 5304390, Bollinger Shipyards Lockport, (64513), P/N 243-6736967 PC 25 and SKF USA Inc. DBA SKF Coupling
(9V902), P/N OKCE 115/SS/176141.
10. A listing of sources, if any, indicating an interest in the acquisition is:

11. In addition to the specific actions being taken by Technical Support personnel to overcome barriers to competition before any subsequent acquisitions or recertification of class determination are made, this item is subject to the following methods of locating additional sources:
The solicitation contains the provision entitled Conditions for Evaluation and Acceptance of Offers for Part Numbered Items (52.217-9002) Per PGI 206.304, the previous J & A for NSN 3010-01-411-4227, contract SPM7L313C0068, dated 04/29/2013 was reviewed to determine whether the planned action to remove any barriers to competition were completed. This previous J & A synopsized the acquisition for 15 days, conducted market research including two (2) vendors, and included the provision 52.217-9002, Conditions for Evaluation and Acceptance of Offers for part Numbered Items (see Attachment 1). Based on this information from the previous J & A, it is determined that the planned actions to remove any barriers to competition were completed. NSN 3010-01-411-4227 has an AMC/AMSC of 3D, which means the data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. At this time, the requirement/guidance in PGI 206.304 has been fulfilled.
