DLA Troop Support Industrial Hardware Supply Chain

Justification and Approval (J&A) for Other than Full and Open Competition

1. Defense Logistics Agency (DLA) Troop Support, Industrial Hardware Supply Chain, is the contracting activity.

2. The action being approved is the ability to solicit for DLA requirements on an other than full and open competition basis.

3. Following is a description of the supplies required to meet DLA's needs:

4. The applicable statutory authority permitting other than full and open competition is 41 U.S.C.1901, as implemented by FAR 13.5. The applicable regulatory authority is FAR 13.501(a)(l).

5. The use of the authority cited is necessary because SEAL MASTER CORPORATION DBA, KIRKHILL INC. DBA, and RUBBERCRAFT CORPORATION Of are the only sources that can produce the required Seal f?.S�ymbly to satisfy the military's needs. The Government does not possess complete unrestricted technical data to develop an item description or specifications for purposes of full and open competition. No alternate item will satisfy the military services' requirements unless otherwise tested, evaluated and approved by the cognizant Government Engineering Support Activity (ESA). The ESA has determined that the identified approved sources are the only one that can provide the required item and satisfy the military's needs. The DLA Troop suppott Industrial Hardware supply chain does not possess the ability to make the item competitive as ultimate authority to determine the manufacturing source(s) and competitiveness rests with the ESA outside of DLA Troop Support Industrial Hardware control and authority. DLA Troop Support Industrial Hardware has taken what measures it can in order to achieve competitiveness including verifying the assigned codes regarding competitiveness and ownership of data, seeldng additional sources through public notice, and following up with the ESA when feasible. The item is coded Acquisition Method Code (AMC) 2 -determined for the first time to be suitable for competitive purchase

6. A Sources Sought Notice was published in Federal Business Oppo1tunities (FedBizOpps) on May 2, 2019 to ensure that offers are solicited from as many potential sources as is practicable.

The Sources Sought Notice closed on June 3, 2019. This requirement will be synopsized in Federal Business Oppo1tunities (FedBizOpps), as required by FAR 5.2. In addition, this justification will be posted with the solicitation for public inspection, redacted as necessary, in accordance with FAR 6.305( c ).

7. As contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on price analysis including a favorable comparison to historical cost and contractor submission of other than cost or pricing data, if necessary.

8. Market research was conducted from April 3, 2019 to June 3, 2019.

9. There are no additional facts supporting the use of other than full and open competition. All possible actions were taken in the past to promote full and open competition, such as synopsizing the requirement and issuing a Sources Sought Notice. The drawings required to produce this item are proprietary and are not possessed by the Government.

Actions to remove or overcome any barriers to competition before any subsequent acquisition for the supplies and to encourage the submission of offers for alternate products will include periodic screening of the AMC/AMSC codes assigned to the item by a Product Specialist and the inclusion of Defense Logistics Agency Directive (DLAD) Clause 52.217-9002, "Conditions for Evaluation and Acceptance of Part Numbered Items" in the solicitation to encourage the submission of offers for alternate products. Technical data packages for alternate items will be sent to the Govermnent ESA for evaluation and potential approval.
