JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY
This Justification and Approval to request authority for Other Than Full and Open Competition supports requirements generated for the Defense Logistics Agency. The contracting authority for this requirement is Defense Logistics Agency (DLA) - Aviation- FAZC. The project number supporting this contracting action is 1000051285 for NSN 1560-01-083-7468.
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
Due to the circumstances described herein, this activity requests authority to acquire the items/spares listed in this document using Other Than Full and Open Competition as prescribed by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This action will result in the award of a new contract, which will be a firm-fixed price, ID/IQ contract with a basic year plus four-one year ordering period in which additional quantities may be ordered. The two approved sources of supply capable of producing these parts are reflected below:

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY'S NEEDS
Under the contemplated contract, Meggitt (Rockmart), INC. / Engineered Fabrics Corp. or Sikorsky Aircraft Corporation will provide the following supplies which are required to support the A-10 Thunderbolt II aircraft: NSN: 1560-01-083-7468, Tank Fuel, Aircraft.
data to support acquisition of this requirement from any other sources. However, any source who responds to the Government because of this synopsis will be identified to the prime contractor as a potential for subcontracting possibilities in accordance with Procurement Notice L22-Restriction of Alternate Offers for Source Controlled Items.
Synopsis was posted to FEBIZOPPS on 26 January 2017. Synopsis was amended to change the Estimated Demand Qty due to increase in customer demands.
Sources Sought Synopsis was posted 26 October 2016 and resulted in an expressed interest from Robertson Fuel Systems via email 28 October 2016 7:26 PM. The Synopsis number was SPE4A7-17-R-0124. DLA Aviation issued the Sources Sought Synopsis as a means of conducting market research to identify parties having an interest in and the resources to support this requirement for a Tank, Fuel, Aircraft. This procurement will be issued as Unrestricted, utilizing other than full and open competition 10 U.S.C. 2304 (c)
(1) and FAR 6.302-1 procedures. The result of this market research will contribute to determining the method of procurement. The applicable North American Industry Classification System (NAICS) code assigned to this procurement is 336413.
Robertson Fuel Systems responded to the Synopsis. The Source Approval Request procedures were provided to Robertson Fuel Systems via e-mail on 24 July 2017. As of 25 October 2017, no response was received from Robertson Fuel Systems.
VII. DETERMOINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE
The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.404-1, it is anticipated that negotiations will be conducted using information other than cost and pricing data from the contractor. Thorough price analysis will be conducted using available information and approved pricing techniques that will support the contracting office in making a determination that the price paid to the contractor is fair and reasonable to the Government. Based on the foregoing, the Contracting Officer hereby determines the anticipated cost to the Government will be fair and reasonable.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS OR STATEMENT OF THE REASONS MARKET RESEARCH WAS
NOT CONDUCTED
Efforts were made to ensure that offers were solicited from as many sources as practicable through synopsizing. This item is unique to weapon system indicator codes for (24F) A-10 Thunderbolt II. Potentially, there are two capable approved sources, which are large manufacturers. “See section II above.” Market research was conducted via Sources Sought on 26 October 2016. Synopsis was posted on FedBizOpps.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
The acquisition will be issued using Other Than Full and Open Competition under the authority of 10 U.S.C. 2304 (c) (1) and FAR 6.302-1. Delay in award of an Indefinite Quantity Contract would result in serious injury, financial or other, to the Government.
The solicitation is unrestricted. A technical data package for the items is not available.
This OEM is not willing to sell data rights to the Government, which means the technical data package, specification, and engineering description suitable for Full and Open Competition cannot be developed without reverse engineering. The Government has determined that reverse engineering is cost prohibitive.

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE
MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES
A pre-solicitation synopsis was posted on FedBizOpps for SPE4A7-17-R-0124.
Procurement Note L22-Restriction of Alternate Offers for Source Controlled Items was included in the solicitation since the acquisition is restricted to material manufactured by the sources listed on the source control drawing, as indicated by AMSC code B.
XII. CONTRACTING OFFICER'S CERTIFICATION
The Contracting Officer's signature on the Coordination and Approval Document is evidence that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.
XIII. TECHNICAL/REOUIREMENTS PERSONNEL'S CERTIFICATION
As evidenced in the technical certification located in the Material Master, the technical personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete. The approved technical certification is incorporate in this document by reference.
