CONTINUED ON NEXT PAGE

The subject solicitation is FOR A FMS (foreign military sales) requirement pertaining to the country of__ Kuwait _____ - therefore, it is required submitting a quote must submit it as FOB origin, inspection and acceptance at "origin". Prospective Offerors who do not quote IAW with the solicitation/quote request requirements as stated will NOT be considered further for potential award actions.

FMS INSTRUCTIONS IAW– DLAD 25.7301 (S-90) and DLAD PGI 25.73 New procurement amendments updated January 1, 2015 from the DLA June 2013 PROC-LTR 13-57 stipulate quotations of these types of requirements will be processed to award stage as FOB origin with inspection and acceptance at "Other". "Other" is defined as the FDA (Federal Drug Administration).

The assigned FDA office will be the regional office closest to the winning contractor's location. This office will be defined by a Federal Activity Code (FAC) and advised as such at time of purchase order award. The FDA will act as the Inspector and acceptor via WAWF (Workflow) after submission of the Invoice and Receiving Report Combo is completed by the eventual awardee.

Payment procedures are "prompt pay".

Offers are to be submitted FOB ORIGIN, INSPECTION AND ACCEPTANCE AT ORIGIN.

Invoices are required to be submitted as FOB Origin, Invoice and Acceptance at Other and must be done as a "Receiving Report and Invoice COMBO". Upon submission of the Invoice within iRAPT (WAWF) should prospective vendors be the ultimate awardee, a copy of the vendor’s COC (Certificate of Conformance), IAW FAR 52.246-15, MUST be attached with the COMBO invoice. No exceptions!

Will product be shipped from vendor's own warehouse or will it be drop ship from manufacturer? If a drop ship, vendor needs to identify manufacturer location with cage code.

All FMS requirements upon award will be issued and administered by DLA Troop Support Medical.

NOTE:

Prospective awardees will have two options with respect to coordination of the transportation requirements for when the instant solicitation becomes a funded award requirement. They are as follows:

Option 1:

Transportation arrangements will be coordinated with DLA Distribution. IAW DLAD 52.247-9034(c), for each FMS delivery order generated against the base contract agreement, the Contractor shall contact the DLA Distribution Supply Chain Transportation Office Helpdesk for shipping instructions at 1-800-456-5507 or via e-mail to delivery@dla.mil (email is the preferred method). The DLA Distribution's operating hours are Monday through Friday, 6:00 a.m. to 5:30 p.m.

eastern standard time, excluding holidays. DLA Distribution will provide the contractor with the MSL (Military Shipping Label) containing the shipping address and any prepaid transportation arrangements This option is available for vendors who do not have access to the DLA VSM (Vendor Shipment Module) system.

Option 2:

The DLA Vendor Shipment Module (VSM), previously known as the Distribution Planning and Management System (DPMS), is available at https://vsm.distribution.dla.mil, may be used to obtain transportation instructions in lieu of contacting the transportation office (as noted above). It is a web-based distribution and transportation system available to DLA Vendors for the purpose of obtaining current shipping addresses, two-dimensional bar coded shipping labels in accordance with MIL-STD-129P, Bills of Lading, Packing Lists, and other shipping documentation. VSM replaces the need for the vendor to contact the DLA transportation office, prior to shipping, when directed in DLA contracts. IAD DLAD 52.247-9011 - Use of VSM is voluntary and is especially beneficial for DLA administered FOB Origin contracts/delivery orders and for DLA administered contracts where ultimate destination is a location outside of the United States.

NOTE 2:

SUBJECT REQUIREMENT IS ___Unrestricted________(note Unrestricted or Small Business Aside).

PROMPT PAY PROCEDURES ARE APPLICABLE TO THE SUBJECT ACQUISITION.

Offers are to be submitted FOB ORIGIN, INSPECTION AND ACCEPTANCE AT ORIGIN.

Please note that Rapid Gate is currently a requirement for access to some military bases; however, these and other locations may require enrollment in other security programs at some time in the future. In this event, the contractor is responsible for obtaining all required enrollments and clearances for each of their drivers as soon as they receive notice of such a requirement.

Many bases currently require enrollment in Rapid Gate and will not allow entry without Rapid Gate clearance. During the contract implementation period, the Contractor must contact all customer locations to determine whether enrollment in Rapid Gate or another security program is required for access to each location. If Rapid Gate or other security enrollment is required, the contractor must take all necessary steps to obtain this in time for the start of performance under this contract. Failure to have Rapid Gate clearance may result in a vendor being turned away from the base and being unable to complete delivery. The contractor is responsible for the additional cost for Rapid Gate enrollment and must ensure that a Rapid Gate enrolled driver is available for all deliveries. We currently estimate that Rapid Gate enrollment will cost about $250 per company and $200 per enrolled employee for 1 year of access to multiple locations, but the cost of Rapid Gate or other security enrollment may vary, so the contractor should contact Rapid Gate to determine its own costs. If more than one driver is required, Rapid Gate enrollment must be obtained for each driver. Note that enrollment can take several weeks, so an awardee that is not already enrolled must begin enrollment at the time of award notification at the latest. If difficulty or delay in enrollment in Rapid Gate is encountered during the implementation period, the contractor MUST contact Rapid Gate and/or the Security Officer at the applicable customer locations to resolve any issues with processing Rapid Gate enrollment so that the contractor will be able to deliver as required.

“Bulk commodities” means the following commodities, when shipped in rail tank cars, tanker trucks, trailers, other bulk wheeled conveyances, or pipelines:

(6) Agricultural products such as seeds, grains, or animal feed.

“Case” means either a MIL-STD-129 defined exterior container within a palletized unit load or a MIL-STD-129 defined individual shipping container.

“Electronic Product Code™ (EPC)” means an identification scheme for universally identifying physical objects via RFID tags and other means.

The standardized EPC data consists of an EPC (or EPC identifier) that uniquely identifies an individual object, as well as an optional filter value when judged to be necessary to enable effective and efficient reading of the EPC tags. In addition to this standardized data, certain classes of EPC tags will allow user-defined data. The EPC Tag Data Standards will define the length and position of this data, without defining its content.

“EPCglobal®” means a subscriber-driven organization comprised of industry leaders and organizations focused on creating global standards file:///C:/Users/RJ30041/AppData/Local/Temp/Temp2_dfars_html%20(1).zip/dfars_html/211_2.htm

“Palletized unit load” means a MIL-STD-129 defined quantity of items, packed or unpacked, arranged on a pallet in a specified manner and secured, strapped, or fastened on the pallet so that the whole palletized load is handled as a single unit. A palletized or skidded load is not considered to be a shipping container. A loaded 463L System pallet is not considered to be a palletized unit load. Refer to the Defense Transportation Regulation, DoD 4500.9-R, Part II, Chapter 203, for marking of 463L System pallets.

“Passive RFID tag” means a tag that reflects energy from the reader/interrogator or that receives and temporarily stores a small amount of energy from the reader/interrogator signal in order to generate the tag response. The only acceptable tags are EPC Class 1 passive RFID tags that meet the EPCglobal™ Class 1 Generation 2 standard.
