FOR OTHER THAN FULL AND OPEN COMPETITION
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY.

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.
This justification authorizes and approves the use of other than full and open competition procedures for the procurement of brand name specific maintenance support for existing PRICE Estimating software maintenance. The acquisition will be purchased through DLA Contracting Services Office - Philadelphia (DCSO-P). The award of a firm fixed price contract is contemplated.
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS, INCLUDING AN ESTIMATED DOLLAR AMOUNT.
The Defense Logistics Agency (DLA) has a requirement to procure the renewal of PRICE Estimating Software support for the DLA Technology Foundation Services office. The Period of Performance (PoP) for this acquisition is July 1, 2019 – June 30, 2020, with 2 one-year option for software support. The renewal of the PRICE Estimating Software support will allow the ability to provide “should cost” analysis estimates that decrease the turnaround time, which have a tremendous positive impact on assisting the procurement community in obtaining “fair and reasonable” prices for aviation items that are purchased. 4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL
AND OPENCOMPETITION:
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source is capable of satisfying the Agency’s requirements. The acquisition is for PRICE Estimating software maintenance, which is a brand-name product peculiar to one manufacturer, PRICE Systems, LLC. In accordance with FAR 6.302-1(c)(1), the acquisition of PRICE Estimating software maintenance is essential to the Government’s requirements. PRICE Estimating software maintenance is proprietary to and no other company’s product can meet, or be modified to meet, the Government’s needs.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS
OR THE NATURE OF ACQUISITION REQUIRES USE OF CITED AUTHORITY:
DLA Aviation (Richmond, Virginia) Value Management Support Branch supported by DLA Information Operations, Technology Foundation Services utilizes this software under for the following key features:
In accordance with FAR 6.302-1, brand name PRICE Estimating Software Maintenance is essential to the Government's requirement because the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy the agency's requirements. A brand name, whether available on one or more contracts, is an item peculiar to one manufacturer and may be procured by brand name specification if essential to the Government's requirements. The PRICE System’s brand name specification is essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company.
Price Estimating Suite (PES) Software is a robust, scalable and flexible IT application platform that meets its performance, security, and budgetary goals. Price Estimating Suite (PES) Software licenses are currently being utilized throughout J6 field sites. It is vital to numerous process and cost avoidance improvement projects as well as day-to-day operations within Information Technology at DLA. PES uniqueness stems from decades of tailoring PES complexity and interfaces to military peculiar requirements, systems and digitized environment.

Market research revealed PES was the only COTS software capable of and tailored to match a cadre of DLA specific requirements that DLA exploits to widely support procurement via vendor and military unique items, many in a state nearing obsolescence and still others are state of the art. PES interfaces and higher-level functions are modular and scalable for the aforementioned to permit DLA users to apply user define tailoring on a case by case basis. For example, PES scalability can be applied to the broad range of DLA product offerings to our customers - from a one off Casting or forging identified on 60-year-old 2 D drawing to 3-D thread estimates for emergent technologies – including Additive Manufacturing estimates.
No other system was found to match the breadth of efficiency to meet our need. PES has user-defined functionality within the application which allows DLA engineers to adjust calibrations of the estimate based on complexities and uniqueness.
Price Estimating Suite (PES) Software open standard software products, allow DLA to rapidly explore external technical advances, induce the best-in-class solutions and then reuse all or part or parts of them to create unique new capabilities and lower total cost of ownership, without affecting functionality, productivity, or mission effectiveness of current and future systems. One of the important projects that this software supports is our Distribution Standard System (DSS) Mid-Tier platform. This is a crucial for supporting the Warfighter.
DLA is required to renew the Price Estimating Suite (PES) Software support and maintenance to ensure continued support and maintenance for its Price Estimating Suite (PES) Software license due to it compatibility with mission requirements. Failure to do so will adversely affect the program and result in additional costs to the Government.
In short, the PRICE Estimating Software maintenance is the only products that can meet the Government’s needs as stated.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM
AS MANY POTENTIAL SOURCES AS ISPRACTICABLE:
The current action will be issued via “Open Market” procedures as a Request for Proposal (RFP) posted to the Federal Business Opportunities (www.fbo.gov) in accordance with FAR 5.201(b). All responsible parties will be given an opportunity to submit an offer.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE:
As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that, in order to obtain a fair and reasonable price, the Government will use various price analysis techniques including, but not limited to, the following: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404- 1(b)(2)(i)); 2) comparison with a competitive published price lists (FAR 15.404-1(a)(2)(iv)); and (3) Comparison of proposed prices with the Independent Government Cost Estimate. The Contracting Officer will determine that the apparent awardee’s proposed price is fair and reasonable prior to award.
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS:

Market research actions were conducted amongst the developer/Original Equipment Manufacturer (OEM) and there were no authorized resellers of the required support. A sources sought announcement was also issued to www.fbo.gov and only one vendor replied. That vendor was . A decision was made to issue the requirement via a Combined Synopsis/Solicitation - Request for Proposal under open market procedures and posted to the Federal Business Opportunities website (www.fbo.gov) in an effort to disseminate the requirement to the maximum number of potential sources.

ACQUISITION FOR SUPPLIES OR SERVICES:
PRICE Estimating Software is so imbedded into the DLA Enterprise systems that this barrier to competition cannot be removed absent an overhaul of the current IT infrastructure. At this time, PRICE Estimating Software is the only product that will support DLA’s requirements and meets the Government’s needs. However, DLA has, and continues to, exercise full and open competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both within industry and the Government, as a continuing effort within DLA. Furthermore, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure that, to the extent possible, future requirements are acquired using full and open competition procedures.
