4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER
THAN FULL AND OPEN COMPETITION:
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source is capable of satisfying the Agency’s requirements.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF ACQUISITION REQUIRES USE OF
THE AUTHORITY CITED:
In accordance with FAR 6.302-1, brand name Zebra RF hardware maintenance is essential to the Government’s requirement because the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy the agency’s requirements. A brand name, whether available on one or more contracts, is an item peculiar to one manufacturer and may be procured by brand name specification if essential to the Government’s requirements. The Zebra brand name specification is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
The Zebra RF hardware maintenance is being procured to provide hardware maintenance of DLA’s existing customized inventory of RF terminals in use at DLA Supply Centers worldwide. DLA currently has approximately 4,000 Zebra RF devices deployed across the globe to provide Defense Standard System (DSS) capability in the DLA Warehouse Management System (WMS). The Zebra RF devices have been specifically configured for the DSS software system. The Zebra scanners have special software scripting technology such as Soti/Mobi Control and Staylinked software technology (terminal emulation software) that integrates with Zebra and the DSS mainframe; therefore, three types of software are integrating together. The Zebra devices have highly specialized barcoding features (Soti/Mobi Control) which aligns with the enterprise management software and DSS.
Additionally, Zebra created customized keyboards and touchpads for DLA use only that have unique code, text and features that enable DLA to execute its mission. Most importantly, very particular DoD encryption software (DoD 140-2 Policy) and hardware features which meet DoD IT security measures have been tested, configured and incorporated into both CONUS and OCONUS regions. Only Zebra brand name maintenance meets the Government’s needs; use of third party maintenance would result in voiding all warranties for existing devices.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:
The current action will be issued as a Combined Synopsys/Solicitation-Request for Proposal (RFP) posted to the Federal Business Opportunities website (www.fbo.gov) in accordance with FAR 5.201(b). All responsible parties will be given an opportunity to submit an offer.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE:
As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to, (1) Comparison of proposed prices received in response to solicitations; (2) Comparison with competitive price lists; and/or (3) Comparison of proposed prices with the Independent Government Cost Estimate. The Contracting Officer will determine that the apparent awardee’s proposed price is fair and reasonable prior to award.
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS:
Market research was performed and determined that is the sole authorized reseller of Zebra RF Hardware Maintenance Renewal, and is, therefore, the only company that can access and provide hardware maintenance coverage. It is anticipated that only one proposal will be received when the solicitation is advertised on the Federal Business Opportunities website.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION:
The hardware maintenance provides comprehensive coverage: covers accidental damage, plus normal wear and tear; 8x5 (local time) live-agent support; 3-day repair turnaround time;
access to restricted software; device diagnostics for mobile computers; and support dashboard for mobile computers and scanners to view repair; case management and LifeGuardTM analytics reports. Without hardware maintenance, the DLA mission would be severely affected, especially abroad where the DLA warehouse employees using these devices are in austere environments (war zones) with little to no communication with DLA Headquarters.
10. A LISTING OF THE VENDOR SOURCES, IF ANY, WHICH EXPRESSED IN
WRITING AN INTEREST IN THEACQUISITION:
11. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE
ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES
REQUIRED:
At this time, Zebra RF Hardware Maintenance is the only product that will support the DLA's requirements and meets the Government's needs. However, DLA has, and continues to, exercise full and open competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both within industry and the Government, as a continuing effort within DLA. Furthermore, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure that, to the extent possible, future requirements are acquired using full and open competition procedures.
