JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY.

Requiring Activity:

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

This justification authorizes and approves the use of other than full and open competition procedures for the procurement of brand name specific maintenance support for existing StayLinked and SOTI MobiControl software licenses. Maintenance support for the existing StayLinked and SOTI MobiControl software licenses is currently procured under Contract No.

SP4701-16-C-0088. Under this contract, maintenance support for certain StayLinked licenses expire in September 2018. The remaining StayLinked maintenance support and SOTI MobiControl maintenance support expire on December 31, 2019. The proposed procurement action will result in the award of a Firm Fixed Price contract for StayLinked and SOTI MobiControl software license maintenance and support, and will co-term all StayLinked and SOTI MobiControl maintenance support beginning in the last option period beginning January 1, 2020 through December 31, 2020.

3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS/ESTIMATED DOLLAR AMOUNT.

DLA has a need for StayLinked and SOTI MobiControl maintenance support for existing software licenses in order to receive software updates for DLA’s hand held devices utilized by DLA warehouse employees in New Cumberland, PA. The maintenance is outlined below.

SLPS-TE-S-MAINT-R StayLinked Pool Server - Maint Renewal 4,292 a 12 month base period (September 18, 2018 through September 17, 2019), one 3-month option period (September 18, 2019 through December 31, 2019), and one 12 month option period (January 1, 2020 through December 31, 2020).

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION:

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source and no other supplies or services will satisfy the Agency’s requirements.

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF ACQUISITION REQUIRES USE OF

CITED AUTHORITY:

In accordance with FAR 6.302-1, StayLinked and SOTI MobiControl software support licenses and maintenance are brand name products. There are two manufacturers of the required maintenance. StayLinked software maintenance is a brand name product peculiar to one manufacturer, StayLinked Corporation. SOTI MobiControl software maintenance is a brand name product peculiar to one manufacturer, SOTI, Inc. Use of this brand name support is essential to the Government’s requirements. No other brand name software maintenance is compatible with brand name StayLinked and SOTI MobiControl software licenses. Only StayLinked and SOTI MobiControl software maintenance will support the existing licenses owned and utilized by DLA.

StayLinked software is a TN3270 Emulator that allows for a connection to the mainframe. The software that is installed on the Hand Held Devices utilized by DLA warehouse employee interact with the StayLinked server. The server then relays this data to the mainframe for processing. If StayLinked software were to fail, warehouse processing on the Hand Held

Devices would halt and would cause a complete work stoppage and cost DLA estimates of millions of dollars per day in lost production.

SOTI MobiControl is DLA’s Warehouse Management Software. This software allows DLA to completely automate its build of devices, remotely manage, push software updates, sync files, etc. If SOTI MobiControl were to fail then DLA would lose out on all of the automation processes that it has in place with the Hand Held devices, resulting in more manual labor, increasing costs to the government.

Without renewing the support and maintenance contracts for these licenses, DLA warehouse employees would not be able to process the worldwide scanning of data with their Hand Held Devices, which is the primary method utilized to perform their duties. Without Hand Held processing, there would be a site outage across DLA and negatively affect DLA’s mission.

These Hand Held Devices allow for warehouse employees to stay mobile and complete their Pick, Pack and Stow and receiving tasks on-the-go as opposed to bringing every item back to their desks to make a transaction occur, which would cause significant delays.

The required software maintenance support is particular to the manufacturers of the StayLinked and SOTI MobiControl software. The license updates, patches, troubleshooting and support comes directly from the manufacturers. A third party supplier would not be able to provide these updates for software versions and patches. StayLinked and SOTI MobiControl maintenance is the only maintenance that can be utilized with the existing software licenses.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:

The current action will be issued on an unrestricted basis via a Request for Proposal (RFP):

SP4701-18-R-0043 posted to the Federal Business Opportunities system (www.fbo.gov) via open market solicitation procedures in accordance with FAR Part 12. Offers will be solicited from as many potential authorized resellers of StayLinked and SOTI MobiControl maintenance as practicable.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:

As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: 1) comparison of proposed prices received in response to the solicitation (FAR 15.404-l(b)(2)(i)); 2) comparison with competitive published price lists (FAR 15.404-l(a)(2)(iv)); and 3) comparison of proposed prices within prices obtained through market research of the same or similar items (FAR l 5.404- l(b)(2)(vi)) in order to obtain a fair and reasonable price. The contracting officer will determine prices fair and reasonable prior to award using price history, IGCE, and published price lists (if available).

8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS:

DLA conducted market research via a Request for Information on the Solutions for Enterprise- Wide Procurement Government-Wide Acquisition Contract (GWAC) system (NASA SEWP) (www.sewp.nasa.gov), a Sources Sought action on the General Services Administration (GSA) eBuy GWAC (www.ebuy.gsa.gov), a Sources Sought action on the Federal Business

Opportunities system (www.fbo.gov) and open market procedures. Quotes were only received via the Sources Sought action posted to FBO and through open market requests. The NASA SEWP and GSA eBuy posts yielded no quotes.

the decision was made to issue the RFP as unrestricted using open market procedures via Federal Business Opportunities.

The Contracting Officer determined this approach to be in the best interest of the government which will obtain the most advantageous pricing and provide all StayLinked and SOTI MobiControl resellers an opportunity to submit a proposal.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION:

ACQUISITION FOR SUPPLIES OR SERVICES:

The StayLinked and SOTI MobiControl software and maintenance are so imbedded in the DLA warehousing system in New Cumberland, PA that this barrier to competition cannot be removed absent an overhaul of the current infrastructure. However, to encourage competition to the greatest extent possible under the circumstances, the requirement will be solicited competitively on the Federal Business Opportunities site to ensure that offers are solicited from as many authorized resellers of the software maintenance as practicable. DLA exercises competition as often as possible and conducts ongoing reviews to keep abreast of new technology, both within industry and in the Government. Furthermore, DLA utilizes a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue the practice of surveying the market to ensure full and open competition whenever practicable.
