4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN
FULL AND OPEN COMPETITION:
The authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), and FAR 6.302-1. APC equipment is brand name items particular to one manufacturer, APC. The brand name APC equipment is essential to the Government’s requirement in accordance with FAR 6.302-1(c), thereby precluding consideration of products manufactured by another company.
Brocade equipment and annual maintenance are brand name items particular to one manufacturer, Brocade. The brand name Brocade equipment and annual maintenance are essential to the Government’s requirement in accordance with FAR 6.302-1(c), thereby precluding consideration of products manufactured by another company.
Cisco equipment and software licenses are brand name items particular to one manufacturer, Cisco. The brand name Cisco equipment and software licenses are essential to the Government’s requirement in accordance with FAR 6.302-1(c), thereby precluding consideration of products manufactured by another company.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF ACQUISITION REQUIRES USE OF
CITED AUTHORITY:
APC:
In accordance with FAR 6.302-1(c) the use of APC Uninterruptable Power Supplies (UPS), rack power distribution units, power cords and cord retention brackets are essential to the Government’s requirement. This equipment is required for standardized installation and compatibility with existing network equipment. After the J6 realignment in 2014, a nearly yearlong network redesign and standardization project was completed that identified the future requirements of DLA’s networks and to consolidate all of the existing requirements of the organization. Those gathered requirements were used to develop a standardized baseline network design that all DLA sites will be reconfigured to follow to improve network efficiency, security, and ease of administration. This equipment is necessary as it is what DLA currently utilizes throughout its networks and periodically needs to be upgraded/ replaced. APC UPS are currently used throughout the DLA and pose no compatibility or interoperability concerns with existing network infrastructure. The UPS equipment is required to provide emergency power to protect hardware such as computers, data centers, telecommunication equipment or other electrical equipment where an unexpected power disruption could cause injuries, fatalities, serious business disruption, data loss or mission failure. The rack distribution units, power cords and cord retention brackets are required in order to ensure there are no compatibility issues with the APC UPS equipment.
All of the aforementioned equipment meets the Department of Defense operating standards and configuration management control through the Technical Review Board and Configuration Control Board processes. In order to maintain real time communication capabilities with local and field site personnel located within the Continental United States as well as overseas, this equipment is required and essential to the DLA mission. Existing equipment configurations, monitoring/management tools, and training are tailored to this equipment brand. Any modification from APC brand would require significant redesign to DLA’s network environment to be compatible and will require a cost prohibitive level of spending repurchases tools and training.
Brocade:
In accordance with FAR 6.302-1(c) the use of Brocade equipment and annual maintenance are essential to the Government’s requirement. DLA provides worldwide logistics support for the missions of the Military Departments and the Unified Combatant Commands under conditions of peace and war. It is the goal of DLA Information Operations to provide a viable, supportable, and secure network for all DLA activities and sites. With the consolidation and redesign of the DLA LAN networks, new requirements have been identified to support the standardized LAN architecture. The standardized architecture simplifies the LAN environment and as a result switching infrastructure technical requirements have decreased and primarily focus on the data link layer (Layer-2) and Security Technical Implementation Guides (STIG) requirements.
DLA completed vendor meetings with Cisco, Juniper, and Brocade during the week of October 13 to October 29, 2014. The meetings with the vendors allowed DLA to see product demonstrations and to ascertain whether the selected vendors could meet all of the requirements that DLA specified for the LAN switching infrastructure solution. The evaluation team based the recommendations below on a combination of the vendor’s ability to meet DLA specific vendor technical requirements, cost (initial, maintenance, and lifecycle), implementation concerns, and best performance.
All equipment, configurations, software, and support must comply with applicable DOD Information Technology directives, security directives, and instruction guidance. This includes:
• Current Defense Information Systems Agency (DISA) STIGs
• Must be on the DoD Unified Capabilities Approved Products List (UC APL)
• DODI 8500.2, requirements DCAS-1, DCNR-1, DCSR-2, ECCR-2, and ECCT-1
• National Information Assurance Partnership (NIAP) Common Criteria Evaluated
• Product appears on NIAP Validated Product List (VPL) or Products in Evaluation list
• Federal Information Processing Standard (FIPS) 140-2 and Cryptographic Algorithm Validation Program compliance
• Approved ports, protocols and services (PPSM) for wired networks, and industry best practices.
Based on the vendor demonstrations, the product recommended for the LAN Switching solution is Brocade. Brocade meets all DoD and federal government security guidance and policy for LAN Switching. Brocade devices require the least amount of rack space to meet high- and mid-level switch requirements and provide the most flexibility with stackable high- and mid-level switches. Furthermore, Brocade has the lowest anticipated acquisition and operations and maintenance (O&M) costs of all the solutions evaluated. In this instance to support the brand-name specification of Brocade equipment and maintenance, this brand-name equipment and maintenance are required to ensure the Agency is not unduly impacted by not having access to patches and updates relating to Brocade equipment which is mission critical to the Agency and required to comply with JTF-GNO and DLA-CERT policy. Failure to respond to vulnerabilities and upgrade taskings would result in non-compliance and potential disconnection from the DoD network by DISA, the DoD Agency responsible for network connectivity. Similarly, a hardware failure must be resolved by Brocade -approved maintenance providers utilizing Brocade -approved replacement parts and procedures. Failure to follow Brocade -required maintenance and repair procedures will void the warranty and Brocade supportability of the devices, exposing DLA to equipment support refusal resulting in mission failure.
In summary, if maintenance and software upgrades are not procured from Brocade authorized equipment and maintenance providers, DLA will not have access to patches and updates for Brocade equipment; will be in non-compliance with JTF-GNO and DLA-CERT policy; will not be able to respond to vulnerabilities and upgrade taskings, will be exposed to potential disconnect from the DoD network by DISA, and will void the warranty and supportability of Brocade equipment thereby resulting in significant degradation of the DLA ETN LANs and DLA mission failure. Existing equipment configurations, monitoring/management tools, and training are tailored to this equipment brand. Any modification from the Brocade brand would require significant redesign to DLA’s network environment to be compatible and will require a cost prohibitive level of spending repurchases tools and training.
Cisco:
In accordance with FAR 6.302-1(c) the use of Cisco Wireless Local Area Network (WLAN) equipment and software licenses is essential to the Government’s requirement. In order to help to accomplish its mission of supporting the war fighter, DLA has a need to provide and maintain real-time communication capabilities with its local and field site personnel located both within the continental United States and overseas.
DLA Information Operations – Network and Telecommunications Services is under strict
Control Board processes. These controls are consistent with industry and Department of Defense operating standards. Currently DLA utilizes Cisco equipment for Network and telecommunications services and continued use of Cisco equipment is imperative to ensure compatibility and interoperability with the existing infrastructure. Use of any other equipment jeopardizes the functionality, connectivity, security and interoperability of existing network equipment and infrastructure. It has been determined that expanding features already imbedded in the existing Cisco hardware would be more cost effective to the Agency. Cisco network equipment is also compliant with DLA Enterprise Voice Over Internet Protocol (VoIP) communications and Local Area Network (LAN) Standardization projects which is required for this project. By expanding the capabilities of already-owned hardware, DLA reduces the need for additional funding, testing, and manpower resources to mitigate compatibility issues. DLA will be enhancing and extending capabilities already in place utilizing Cisco hardware. The introduction of hardware, software and equipment provided by different sources would require significant expenditure to obtain the products and would also require significant time due to additional training efforts which would lead to schedule delays and ultimately day to day mission failure.
The aforementioned Cisco equipment meets the Department of Defense operating standards and
Control Board processes. In order to maintain real time communication capabilities with local and field site personnel located within the Continental United States as well as overseas, this equipment is required and essential to the DLA mission. Existing equipment configurations, monitoring/management tools, and training are tailored to this equipment brand. Any modification from the Cisco brand would require significant redesign to DLA’s network environment to be compatible and will require a cost prohibitive level of spending repurchases tools and training.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:
This requirement will be synopsized to solicit resellers of APC, Brocade, and Cisco equipment and services in accordance with FAR 5.201 and FAR 5.203(b).
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE:
Pricing will be determined fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to (1) Comparison of proposed prices received in response to solicitations; (2) Comparison with competitive price lists; and (3) Comparison of proposed prices obtained through market research for the same or similar items in order to obtain a fair and reasonable price. Specifically, the Contracting Officer expects to received competition amongst the reseller’s proposals. Additionally, the Contracting Officer will search various reseller’s price lists for comparative pricing. The Contracting Officer will determine prices fair and reasonable prior to award.
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS OR A STATEMENT OF THE REASON MARET RESEARCH WAS NOT
CONDUCTED:
Market research was conducted through reviewing prior contract history, DLA’s configuration management controls, and through a request for information (RFI) that was posted to FedBizOpps.gov. A nearly yearlong market research was conducted to vet vendors for network equipment. All vendors were authorized to submit their proposed plan to meet DLA’s provided requirements. Three primary vendors were identified from the responses (Juniper, Brocade, and Cisco). From there, a standardization effort was conducted where each vendor was compared to the same set of industry standards; and each vendor provided cost estimates on their proposed solutions. Any vendor that had comparable metrics against the industry standards was then compared against cost with the lower cost vendor taking priority. Brocade was identified to be able to provide the most amount of requirements at the lowest cost. Similar market research processes were conducted to identify Cisco as the best suited vendor for wireless and APC as the best suited vendor for UPS equipment. The RFI was completed in conjunction with the vendor standardization market research effort in 2015; it was determined that APC, Brocade, and Cisco are the sole designers and producers of their respective equipment and services.
There are multiple resellers that can provide these equipment and services.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION:
N/A
10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN
INTEREST IN THE ACQUISITION.
N/A
11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY
SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED:
DLA has and continues to exercise competition as often as possible and is required to conduct reviews to keep abreast of new technology, both in industry and in the government. Brocade, Cisco and APC equipment is so imbedded into the DLA Enterprise systems that this barrier to competition cannot be removed absent an overhaul of the current IT infrastructure. At this time, Brocade, Cisco and APC are the only equipment that will support the DLA's requirements and meets the Government's needs. However, DLA has and continues to exercise competition. As a continuing effort, DLA uses a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure future full and open competition.
