MEMORANDUM FOR RECORD

SUBJECT: Brand Name Solicitation #SP3300-20-Q-0023

REFERENCE: FAR 11.105, DFARS/ PGI 211.105 and FAR 13.106(b)(1)(i)

1. Identification of the Agency and Contracting Activity

DLA Distribution, DLA Distribution J7 BLDG 430 Mifflin Ave New Cumberland PA 17070

2. Describe the contract action, to include the dollar value and the type of limited justification.

DLA Distribution Susquehanna, Pennsylvania (DDSP) intends to award one firm fixed price purchase order for two thousand feet of Towline chain finger Part Number: 226-0301 for DLA Distribution Susquehanna, PA. This acquisition is conducted under the use of brand name items, which are peculiar to one manufacturer.

3. Description of the Supplies/Services DLA Distribution Susquehanna, Pennsylvania (DDSP) has a requirement for the acquisition of two thousand feet of Towline chain finger Part Number: 226- 0301 for an operational section of the towline in support of DDSP Distribution mission.

4. Justification Rationale for Use of Brand Name Restriction of sources for this acquisition is justified in accordance with FAR 13.106(b)(1)(i) which allows to solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., brand-name). manufactures the Towline chain finger. DDSP has used other manufacturers of chain in the past and it caused excessive and premature wear on the floor plates and turn-arounds in the warehouse due to the larger size as the chains are wider and the pins protrude out further than the brand name requested chains. DDSP requires the chains for compatibility to existing chainline. A slight difference in size negatively affects production and will eventually cause work stoppages. Utilizing the chain will prolong the life of the equipment in the building and will minimize downtime for mission operations. The use of products is to ensure compatibility, consistency, sustainability of the towline equipment already in place, and to meet the functionality requirements of the equipment. Additionally, continued use of the manufactured chain will prevent equipment failure and work stoppages, affecting the DDSP mission.

5. Market Research and Interested Sources Informal Market Research indicates that small business resellers will submit quotes for this requirement. The examination of the authorized resellers on their website and other online websites revealed that there are multiple small businesses, which sell the required towline chains. the chain manufacturer, has several independent re-sellers who are able to set their own pricing.

Resultant of the market research, DLA Distribution J7 was able to conclude 1) the procurement of are considered to be commercial items customarily sold, leased or licensed to the general public; and 2) competition in the open market exists amongst three (3) or more known authorized distributors.

6. Determination In accordance with FAR 6.302-1(c), an acquisition that uses a brand name description or other purchase description to specify a particular brand name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition regardless of the number of sources solicited.

As a result of the above and in accordance with FAR 13.106-1 (b) the Contracting Officer has determined that it is in the Government’s best interest to conduct this acquisition by limiting sources based on the use of a brand name specification.
