THE PURPOSE OF AMENDMENT 0008 IS TO:

1. Extend the closing date for quotes from January 10, 3:30pm EST to January 31, 2020 3:30pm

EST.

2. Answer contractor questions (see below)

3. Incorporate a Amendment 0008 SP3300-19-Q-0070, Amendment 0008 Attachment 1 – Delivery Locations, and Amendment 0008 Attachment 2 – Schedule of Supplies

a. Amendment 0008 SP3300-19-Q-0070: Language was added under #5 Requirements for Pallets, CLIN structure was adjusted in #10, an up to date version of FAR 52.212-4 was added, DOD mandatory provision FAR 52.204-24 was added, and the date for quotes and questions was changed

b. Amendment 0008 Attachment 1 – Delivery Locations: Delivery locations have been revised and broken up into 5 zones instead of the original 3.

c. Amendment 0008 Attachment 2 – Schedule of Supplies: Is revised to remove items no longer covered under this solicitation. Items were also categorized under more appropriate categories. Purchase order texts were also updated.

d. Attachments 3 and 4 remain unchanged.

VENDOR QUESTIONS AND GOVERNMENT ANSWERS

1. We notice the solicitation includes DFARS 252.204-7008, Compliance with Safeguarding Covered Defense Information Controls. Is this accurate? Will the selected contractor be required to be compliant with all 110 requirements in NIST Special Publication 800-171?

Government Response: Yes, the contractor shall comply with provision DFARS 252.204-7008 as it is implemented in all solicitations, including solicitations using FAR part 12 procedures for the acquisition of commercial items.

2. We understand invoicing is through WAWF. What are the payment terms expected? Will prompt payment apply?

Government Response: Yes. Payment terms are Net 30. Prompt payment applies.

3. Will delivery locations be limited to only the locations provided in attachment 1, or will others be added and removed over time?

Government Response: Our current requirements reflect the delivery locations in Attachment 1.

If locations change, a bilateral modification will be issued to address the changes.

4. Will specific delivery instructions, receiving hours, contacts, and security requirements be provided for each location?

Government Response: Yes, each delivery order will contain delivery instructions.

5. If a delivery is refused in error will the government reimburse for costs?

Government Response: The government cannot provide an answer for this question.

6. Just to confirm our understanding of the estimated quantities on the bottom of page 2 (in number 8), the government provided estimated quantities but there is no guarantee that these will be purchased, nor that they will be ordered in a single transaction. Instead, the government will issue delivery orders with a minimum order value of $500.

Government Response: Please reference FAR 52.216-19 Order Limitations on page 8.

7. In the Instructions to Offerors for Volume III, the government requests an index of previous contract data for all subcontractors. If the prime contractor has ample past performance to demonstrate ability to perform, is the subcontractor index still required? (Paragraph 2 of the Volume III instructions leads us to believe the subcontractor data will only be required if the subcontractor experience is provided as part of the most relevant contracts.)

Government Response: It is the offerors decision as to what past performance information to provide.

8. We notice clause 52.219-14 applies to this solicitation. We want to ensure we are translating this correctly – does this mean that a small business bidder cannot subcontract more than 50% of the value of the contract to large companies?

Government Response: Please reference FAR 52.219-14(e)(2) “Supplies (other than procurement from a non-manufacturer of such supplies), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded”

9. Demonstrated evidence of understanding ASTM standards is a somewhat abstract concept.

When the Government determines technical acceptability for the Offeror’s demonstrated understanding of the numerous ASTM standards, will Government require Offerors to evidence this through successful performance on other contracts?

Government Response: The government is evaluating technical and past performance. Please read in detail FAR 52.212-1 Instructions to Offerors on page 23 of the solicitation and FAR 52.212-2 Evaluation of Commercial Items on page 26 of the solicitation.

10. Under DFARS 252.216-7006, there appears to be an inconsistency with the order dates. The order dates in (a) do not align with the period of performance on page 1.

Government Response: The amendment will correct the date in DFARS 252.216-7006 to say September 1, 2019 to match page 1. Please remember these are estimated dates.

11. Will you confirm that all pricing must be FOB Destination?

Government Response: Yes, all pricing must be FOB Destination.

12. In addition to the packaging items in accordance with ASTM 3951-15, Standard Practice for Commercial Packaging, are shipments also required to be marked in accordance with MIL-STD- 129?

Government Response: Yes

13. Are there any CLIN packaging and marking requirements within each of the CLIN groups?

Government Response: Please mark the ship to DODAAC and CLIN Numbers on all packaging

14. We would like to confirm understanding that government requires heat treated winged pallets for all locations. Winged pallets are not as common in the commercial marketplace, so fewer are recycled. New pallets are a significant expense to government.

Government Response: For specialty material that will not fit on winged pallets, customized pallets are acceptable. Custom pallets can be used to support odd shapes and lengths of material that will not fit on winged pallets

15. Is there any guaranteed volume we can use for pricing breaks?

Government Response: No there is no guaranteed volume.

16. On page 23, you ask offerors to hold their pricing firm for 90 calendar days from the receipt of offer. What if raw materials for this NAICS increase during that time period? Can we index pricing to align with the raw materials?

Government Response: No, however this contract will include an Economic Price Adjustment clause for changes in raw material pricing. FAR clause 52.216-2 Economic Price Adjustment Standard Supplies can be found on page 7 of the solicitation.

17. Is it possible to get photos or samples of items?

Government Response: No it is not possible to get photos or samples of the items.

18. I am assuming in the above referenced solicitation that zone 1 is Continental US and zone 2 is outside Continental US?

Government Response: Attachment 1 breaks down what locations are in each zone starting on page 5.

19. However, it is my understanding that even if the agency provides this volume and specific delivery location information that the information provided is no assurance that these items or quantities will be purchased as in the past should a new contract be awarded, correct?

Government Response: You are correct, please reference FAR 52.216-21 on page 9 of the solicitation.

20. Is FAR 47.304-1 applicable in determining the delivery terms of this solicitation?

Government Response: Yes, shipping locations are known and listed in the Attachment. FAR 47.304-1(f) states that when acceptance must be at destination, solicitation shall be on an f.o.b destination only basis.

21. Since the shipping characteristics of each individual order that could be placed towards an eventual contract under this solicitation are undetermined I submit that; FAR 47.305-16 Shipping Characteristics item (d) Specific Quantities Unknown would be applicable and should be incorporated as part of this solicitation, also incorporating FAR 52.247-62 Specific Quantities Unknown should be included.

Government Response: The Government has determined this requirement will only be FOB Destination.

22. Can the agency provide historical usage of each product requested by delivery destination?

Government Response: Historical usage of product quantities is reflected in the projected average annual use. This is further delineated by usage numbers given for both delivery zones, Zone 1 (East) and Zone 2 (West).

23. Can the agency also provide by delivery destination the unit order quantity for each item by delivery order and frequency of orders by item per delivery destination?

Government Response: Please see the question above. The unit of issue is listed on the quote form and/or item list. Specific orders by specific location information is not available.

24. Furthermore the agency has listed delivery locations outside of the Continental United States. Will the contractors responsibility be to ship to CONUS freight consolidation locations marked for ultimate destinations overseas?

Government Response: Yes. San Joaquin CA and New Cumberland PA are DLA’s two consolidation points for OCONUS shipments.

25. One more issue with the request. I notice the agency is incorporating requirements for winged pallets per MD00100452 in virtually all request I have been seeing out of this office. As you are probably aware the MD00100452 does incorporate pallet designs other that winged pallets.

It is my understanding that winged pallets are fairly common in the North East however they are less prevalent and usually require special ordering for manufacture in this part of the country.

I’ve been supplying shipments on ISPM 15 compliant pallets for some time and recently provided a small shipment on winged compliant pallets. However, these pallets are more expensive in this region and I’m curious what the recent mandate for all winged pallets requirement is about when conventional stringer pallets without wings could also be sufficient to unitize loads?

Also while on the subject of palletization I also submit that standard industry practice for shipping products such as roll foam and bubble pack which you have on this request is to ship floor loaded and doing so yields a more economically feasible freight capacity and shipping cost.

Let’s take item 4030 for example. The difference in capacity of this item floor loaded versus palletized and loaded is a 35% savings in shipping capacity on a 53 foot trailer. Each bundle weighs about 25 pounds and two to three workers can unload a truck in less than an hour by hand. I understand palletizing plank foam and the barrier paper products for ease of handling but you don’t lose the freight capacity with those that you do with the roll bubble and roll foam goods.

If movement from the docks to the storage areas is an issue the receiving locations for large quantities should have cart racks for ease of movement and handling for these commodities.

26. On the list of supplies Other Packaging Item 0039: This item does not specify what specification, It calls out Material Barrier 48” x 200 yd, .03 FM Max rate Water Vapor Transmission 100 SQ in ea. / 24 hrs. 50 lbs. in min break strength 10 lbs. min puncture resistance, Class 3. Class 3 of what specification is the question?
