SECTION B
SUPPLIES OR SERVICES AND PRICES
B.1 GENERAL OVERVIEW
Provide for all labor, supervision, tools, materials, equipment transportation and management necessary to Removing, Replacing and Installing Gas Heaters in Warehouse 16 at DLA Distribution San Joaquin, California. See Attachment 4 – for complete schedule of supplies and services. This acquisition is 100% set-aside for HubZone small businesses in accordance with FAR 52.219-3. The resulting contract will be a firm fixed-price contract.
B.2 ELECTRONIC SOLICITATION
This solicitation, including all attachments, and any amendments, is only available electronically at the Federal Business Opportunities website www.fbo.gov. Bidders are cautioned that it is their responsibility to access the website for any amendments that may be issued under the solicitation. There will be no advance notification of amendment issuance. Bidders are advised to consult the website frequently to check for any amendments since an amendment may be issued up until the bid opening date and time.
Failure to acknowledge amendments may render our bid non-responsive and ineligible for award.
B.3 MAGNITUDE OF CONSTRUCTION
The estimated magnitude of construction is between $250,000.00 and $500,000.00.
B.4 SITE VISIT DATE, TIME AND LOCATION
Reference Section L, FAR Provision 52.236-27 for specific date, time and location. Due to security measures currently in place on this installation, anyone planning to attend the site visit must provide the name of company, name of visitor, and driver’s license number and state of issue, vehicle registration and proof of insurance, and proof of citizenship to gain security clearance to DLA Distribution San Joaquin CA (DDJC), Tracy Site. Please send the information at least 48 hours in advance of the site visit date to the Project Engineer to allow the security office to run a background check on the visitor’s driver license. Contractors may call Douglas Betz at (209) 839-4232, or send the information in an email to Douglas.Betz@dla.mil. All visitors will check in at the Pass Office located in Building 29A. The gate entrance is located at the Valpico Road and Chrisman Road intersection. If you require a camera pass please make arrangements with Douglas Betz before you arrive. The military installation address is: 25600 S.
Chrisman Road, Tracy, CA 95304. We will begin the site visit by meeting in the cafeteria located in Building 100. There is a parking lot located on the east side of Building 100.
B.5 BID SUBMISSION.
BIDS MUST BE SUBMITTED IN HARD COPY ONLY. ELECTRONICALLY SUBMITTED BIDS INCLUDING FACSIMILE AND TELEGRAPH WILL NOT BE ACCEPTED. BID SHALL BE SEALED IN AN ENVELOPE CLEARLY MARKED WITH THE BID SOLICITATION NUMBER, THE BID OPENING DATE AND TIME. ALL BIDS SHALL

B.6 BID OPENING DATE, TIME AND LOCATION
Bid Opening will be held on JULY 6, 2016 at 10:00 AM pacific standard time.
Bid Opening will be held at DLA Distribution, 5404 J Avenue, Building 404, New Cumberland, PA 17070.
Please take note that the contracting office, and bid submission address is in New Cumberland, Pennsylvania. Hand delivering your bid to DDJC will not be accepted.
A teleconference will available for the bid opening if any contractors want to attend.
B.7 ACCESS TO THE INSTALLATION FOR THE BID OPENING
Anyone planning on attending the bid opening must abide by the same procedures as set forth to gain access for the site visit. Failure to follow these procedures may result in you not gaining access for the bid opening. A phone number to teleconference in for a third party location will not be provided. All vendors who desire to be present at the time of the Bid Opening must be present at DLA Distribution San Joaquin, Ca. In order to attend the Bid Opening on July 6, 2016 at 1:00 PM Eastern Standard Time (10:00 AM Pacific Time) vendors are encouraged to contact Douglas Betz at Douglas.Betz@DLA.MIL or (209) 839-4262 arrangements must be made a minimum of 48 hours prior to the Bid Opening.
Information for Bid Opening Address and the documentation that will need to be provided are the same as section B.4 of the solicitation.
B.8 BIDS
Bidders must complete Blocks 14 through 20c on Attachment 11 - Standard Form (SF) 1442.
Bidders must provide all information requested in Section K Representations, Certifications, and Other Statements of Offerors as well as any signed subsequent Amendments as they apply.
B.9 BID BOND
A bid bond is required. Failure to provide a bid bond for an adequate amount shall result in rejection of bid. Required amount for bid bond is twenty percent (20%).
Reference Section L, FAR Provision 52.228-1.
B.10 PERFORMANCE AND PAYMENT BONDS
The successful bidder shall be required to furnish performance and payment bonds to the Contracting Officer as follows: (Reference Section I, FAR Clause 52.228-15)
(1) Performance Bonds (Standard Form 25). The penal amount of performance bonds at the time of contract award shall be 100 percent of the original contract price.
(2) Payment Bonds (Standard Form 25-A). The penal amount of payment bonds at the time of contract award shall be 100 percent of the original contract price.
B.11 WORKING HOURS: Contractor's working hours, which do not require a power outage, will coincide with working hours of Defense Logistics Agency, DDJC, a normal five (5) day, forty (40) hour week, Monday through Friday, from 7:00 A.M. to 3:30 P.M., except Federal holidays. Federal holidays are those days officially observed by the Federal Government.
Saturday holidays are observed on the preceding Friday and Sunday holidays the following Monday. New Year's Day, Martin Luther King Day, President's Day, Memorial Day, July Fourth, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, Christmas Day, and any other day as may be declared by the President to be a Federal holiday.
B.12 INSURANCE
Reference FAR Clause 52.228-5 Insurance-Work on a Government Installation located in this solicitation.
The minimum amount/kind of insurance required is shown below:
Workers’ Compensation and Employer’s Liability - $100,000 (except in states with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers.)
General Liability- $500,000 per occurrence Automobile Liability – Property damage $20,000 per occurrence, Bodily injury $200,000 per person and $500,000 per occurrence.

When requested by the Contracting Officer, the Contractor shall provide a copy of all subcontractors’ proofs of required insurance no later than five (5) days before each subcontractor commences work on the Government installation.
B.13 CLAUSES AND PROVISIONS
Clauses and provisions from the Federal Acquisition Regulation (FAR), the Department of Defense (DOD) FAR Supplement (DFARS), and the Defense Logistics Agency Directive (DLAD) are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were given in full text.

B.16 INVOICING
The Contractor shall submit payment requests and receiving reports using Wide Area Work Flow (WAWF). Instructions are found in Section G of this solicitation under DFARS Clause 252.232-7003 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS AND RECEIVING REPORTS (JUN 2012)
SCHEDULE OF SUPPLIES/SERVICES
Note: The following project description is for the purpose of general information and is not intended to include and describe every feature or item or to define the scope of work.
PROJECT DESCRIPTION:
Removing, Replacing and Installing Gas Heaters in Warehouse 16 at DLA Distribution San Joaquin CA (DDJC), Tracy Site, 25600 South Chrisman Rd, Tracy CA 95304 in accordance with the attached Statement of Work and Specifications See Attachment 4 Schedule of Supplies
SCOPE OF WORK
1. Remove and replace all gas fired heaters as shown in the drawing and Attachment 3 with the new heater as per the following specifications; Minimum input capacity 100,000 BTU, minimum 83% thermal efficiency, minimum output heating capacity 87,000 BTU, ½” gas connection, 4” vent connection size, maximum full load 3.9 Amps, maximum power consumption 276W, minimum air discharge temperature rise 60 degree Fahrenheit, minimum air volume 1345 CFM, discharge air opening 2.01 sqft, output velocity 668 FPM, maximum motor HP 1/20HP, minimum fan dia 16”, max sound level 54 Db at 15 feet, Reznor model UDAP-100 or approved equal with 409 stainless steel heat exchanger, totally enclosed fan motor, high wind vent cap, thermostat, vertical louvers, stepdown transformer for 120/208 supply voltage.
2. Remove and replace existing heater flue gas vent pipes and vent caps, as shown in Attachment 3, with new gas vent pipes and vent cap. The one pipe section penetrating the roof shall not be replaced. Gas vent pipe size shall meet heater manufacturer recommendations and double layered stainless steel, aluminum color vent pipe compatible with the new heater exhaust. Flue gas vent shall be UL listed Type B Double layered, inner wall shall be recessed to eliminate damage in handling. All straight runs and elbows vent pipes shall be lock-tight connection for Type B Gas Vent. Vent cap shall be stainless steel aluminum color high wind, Make- Duravent or approved equal.
3. Heaters that require to be removed only as shown in Attachment 3; work include removal and disposal of heater, support structure, electrical and gas pipes up to ceiling, flue gas pipes, vent cap and any other hardware related to heater. One vent pipe section penetrating roof shall not be removed and shall be capped below and above the roof.
4. Remove and replace all existing thermostats with commercial digital 5-2 days programmable thermostats VisionPRO 8000 model Honeywell TB8220U1003/U or approved equal. Remove existing conduit and wires and Install new 3/4” EMT, 2#12 Cu THHN to connect thermostat with the gas heater. Thermostat location shall be located on
Source Selection Information https://www.sam.gov/ the nearest wall 10’ above the floor level. Thermostat shall have a lockable cover.
5. Install new 3/4” conduit 3#12 THHN for electrical power requirement for a heater from the 120/208V panel only for heaters as indicated in Attachment 3.
6. Install new electrical disconnect switch, 10A enclosed NEMA 1 toggle switch mounted on wall only for heaters as indicated in Attachment 3.
7. Provide support frame, 2” x 2” black powder coated structural steel angles, if required, to install new gas heater at the level to match the existing heater height. Contractor can use the existing heater support structures.
8. Remove and replace all flexible gas pipes of all existing gas heaters with new UL approved flexible gas pipe. Install new copper gas pipe as required to match existing pipe for new/relocated heaters as shown in the drawing and Attachment 3.
9. Remove and dispose entire existing hot water heating system excluding boiler, pump and associated pipes inside the mechanical room in WHSE16- section B1 as per the attached drawings. Work to include all heaters, supply and return hot water control valves, control wires, thermostats, related electrical wires and conduits and any other hardware associated with hot water system inside the section B1.
Water supply and return pipes are insulated with asbestos containing mudded insulation. Contractor shall follow OSHA Class I guide line to remove and dispose the entire insulated hot water pipe system from the depot and dispose it as per applicable codes. All electrical conduits/wires starting from each heater shall be removed all the way back to electrical panels. Knock outs in electric panels shall be covered with knock out covers. All work in section B1 shall be performed during weekends Saturday 3:30 pm to Sunday midnight. If work cannot be completed in one week end then contractor shall ensure that entire section B1 is cleaned and purged as per asbestos abatement requirements prior to Sunday midnight to enable employees to access the area safely next day. Refer to section 028213 for asbestos abatement work details. Any holes and any other damage to ceiling, walls etc. of section B1 shall be patched up and painted to match existing color.
GENERAL REQUIREMENTS:
1. All work shall be performed during regular work time 7:00 am to 4:30 pm accept WHSE16 Section B1 where work shall be allowed only on weekends from Saturday 3:30 pm to Sunday midnight.
2. Any electrical power shut down will require a minimum of two weeks’ notice.
3. If required contractor shall perform touch up work/ repair to restore existing walls, ceramic tiles, acoustic ceilings, resilient flooring, fluid applied flooring and any other damaged surface during construction to its original condition. Contractor shall perform existing condition survey and submit for government approval before starting any construction.
4. Items shown in the attached submittal register can be added or deleted.
5. Contractor shall field verify all measurements. Some heater location can vary from locations shown on the drawing.
6. Number of heaters to be replaced can vary up to +/- 15%.
7. Heater installation logistics shall be coordinated with area supervisors.
8. All heater rating and installation shall comply with UL, ASHRAE, ASTM, NFPA 80, NEC, NFPA 70E, UFC and other applicable codes.
9. All construction activities shall be done as per UL, ASHRAE, ASTM, NFPA 80, NEC, NFPA 70E, UFC, OSHA and other applicable codes.

FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) (DEVIATION) The Contractor shall be required to commence work under this contract upon receipt of the notice to proceed (NTP) and complete all work to include close out documentation within 180 days after receipt of the NTP according to the following schedule:
A preconstruction meeting will be scheduled within 10 calendar days after the Notice to Proceed is issued. The Contractor shall provide all initial submittal items indicated on the Technical Submittal Registers (Form 4288) and the following contract clause and Non-Technical Initial Submittals in accordance with the Specifications at the preconstruction meeting. Exceptions to this Submittal delivery requirement may be for materials that have a long-lead time.
1. SD-01 Project Submittal Schedule – This schedule must be provided at the preconstruction meeting for all initial submittal register items not provided at the Preconstruction meeting.
2. Contractor must provide Non-Technical submittals as outlined in Section 01330 as well as Section 01525 Accident Prevention Plan (APP).
Contractor shall provide the following submittal items within 30 calendar days after completion of project and prior to final payment:
1. Final Report (deficiencies encountered and recommended corrective action), 07180 1.2.1
2. Operation and Maintenance Manuals
3. Warranties / Guaranties

DFARS 252.201-7000 CONTRACTING OFFICER'S REPRESENTATIVE (DEC 1991)
(a) Definition. “Contracting officer's representative” means an individual designated in accordance with subsection 201.602-2 of the Defense Federal Acquisition Regulation Supplement and authorized in writing by the contracting officer to perform specific technical or administrative functions.
(b) If the Contracting Officer designates a contracting officer's representative (COR), the Contractor will receive a copy of the written designation. It will specify the extent of the COR's authority to act on behalf of the contracting officer. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition of the contract.

DFARS 252.232-7003 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS AND RECEIVING REPORTS (JUN 2012)
(a) Definitions. As used in this clause—
(1) “Contract financing payment” and “invoice payment” have the meanings given in section 32.001 of the Federal Acquisition Regulation.
(2) “Electronic form” means any automated system that transmits information electronically from the initiating system to all affected systems. Facsimile, e-mail, and scanned documents are not acceptable electronic forms for submission of payment requests. However, scanned documents are acceptable when they are part of a submission of a payment request made using Wide Area WorkFlow (WAWF) or another electronic form authorized by the Contracting Officer.
(3) “Payment request” means any request for contract financing payment or invoice payment submitted by the Contractor under this contract.
(4) “Receiving report” means the data required by the clause at 252.246- 7000, Material Inspection and Receiving Report.
(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests and receiving reports using WAWF, in one of the following electronic formats that WAWF accepts: Electronic Data Interchange, Secure File Transfer Protocol, or World Wide Web input. Information regarding WAWF is available on the Internet at https://wawf.eb.mil/.
(c) The Contractor may submit a payment request and receiving report using other than WAWF only when—
(1) The Contracting Officer administering the contract for payment has determined, in writing, that electronic submission would be unduly burdensome to the Contractor. In such cases, the Contractor shall include a copy of the Contracting Officer’s determination with each request for payment;
(2) DoD makes payment for commercial transportation services provided under a Government rate tender or a contract for transportation services using a DoD-approved electronic third party payment system or other exempted vendor payment/invoicing system (e.g., PowerTrack, Transportation Financial Management System, and Cargo and Billing System);
(3) DoD makes payment for rendered health care services using the TRICARE Encounter Data System (TEDS) as the electronic format; or
(4) When the Governmentwide commercial purchase card is used as the method of payment, only submission of the receiving report in electronic form is required.
(d) The Contractor shall submit any non-electronic payment requests using the method or methods specified in Section G of the contract.

(e) In addition to the requirements of this clause, the Contractor shall meet the requirements of the appropriate payment clauses in this contract when submitting payment requests.

DFARS 252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (MAY 2013)
(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract/order:
(1) Document type. The Contractor shall use the following document type(s).

(4) Payment request and supporting documentation. (a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on
Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is “not dominant in its field of operation” when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph
(e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts—
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/services/contractingopportunities/sizestandardstopics/ .
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the rerepresentation required by paragraph (b) of this clause by validating or updating all its representations in the Online Representations and Certifications Application and its data in the Central Contractor Registration, as necessary, to ensure they reflect the Contractor’s current status. The Contractor shall notify the contracting officer in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in ORCA, or does not have a representation in ORCA for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

FAR 52.223-9 Estimate of Percentage of Recovered Material Content for EPA-Designated Products (May 2008)
(a) Definitions. As used in this clause—

“Postconsumer material” means a material or finished product that has served its intended use and has been discarded for disposal or recovery, having completed its life as a consumer item. Postconsumer material is a part of the broader category of “recovered material.”
“Recovered material” means waste materials and by-products recovered or diverted from solid waste, but the term does not include those materials and by-products generated from, and commonly reused within, an original manufacturing process.
(b) The Contractor, on completion of this contract, shall—
(1) Estimate the percentage of the total recovered material content for EPA-designated item(s) delivered and/or used in contract performance, including, if applicable, the percentage of postconsumer material content; and
(2) Submit this estimate to Defense Distribution Center, Acquisition Operations, Attn: Michael Minto, J Avenue, Building 404, New Cumberland PA 17070-5001.
FAR 52.236-1 PERFORMANCE OF WORK BY THE CONTRACTOR (APR 1984)
The Contractor shall perform on the site, and with its own organization, work equivalent to at least twenty five (25) percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.

DFARS 252.223-7001 HAZARD WARNING LABELS (DEC 1991)
(a) “Hazardous material,” as used in this clause, is defined in the Hazardous Material Identification and Material Safety Data clause of this contract.
(b) The Contractor shall label the item package (unit container) of any hazardous material to be delivered under this contract in accordance with the Hazard Communication Standard (29 CFR 1910.1200 et seq). The Standard requires that the hazard warning label conform to the requirements of the standard unless the material is otherwise subject to the labelling requirements of one of the following statutes:
(1) Federal Insecticide, Fungicide and Rodenticide Act;
(2) Federal Food, Drug and Cosmetics Act;

(4) Federal Hazardous Substances Act; or
(5) Federal Alcohol Administration Act.
(c) The Offeror shall list which hazardous material listed in the Hazardous Material Identification and Material Safety Data clause of this contract will be labelled in accordance with one of the Acts in paragraphs (b)(1) through (5) of this clause instead of the Hazard Communication Standard. Any hazardous material not listed will be interpreted to mean that a label is required in accordance with the Hazard Communication Standard.

(d) The apparently successful Offeror agrees to submit, before award, a copy of the hazard warning label for all hazardous materials not listed in paragraph (c) of this clause. The Offeror shall submit the label with the Material Safety Data Sheet being furnished under the Hazardous Material Identification and Material Safety Data clause of this contract.
(e) The Contractor shall also comply with MIL-STD-129, Marking for Shipment and Storage (including revisions adopted during the term of this contract).
DFARS 252.236-7001 CONTRACT DRAWINGS AND SPECIFICATIONS (AUG 2000)
(a) The Government will provide to the Contractor, without charge, one set of contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.
(b) The Contractor shall—
(1) Check all drawings furnished immediately upon receipt;
(2) Compare all drawings and verify the figures before laying out the work;
(3) Promptly notify the Contracting Officer of any discrepancies;
(4) Be responsible for any errors that might have been avoided by complying with this paragraph (b); and
(5) Reproduce and print contract drawings and specifications as needed.
(c) In general--
(1) Large-scale drawings shall govern small-scale drawings; and
(2) The Contractor shall follow figures marked on drawings in preference to scale measurements.
(d) Omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.

(xv) 52.223-4, Recovered Material Certification. This provision applies to solicitations that are for, or specify the use of, EPA- designated items.
(xvi) 52.225-2, Buy American Certificate. This provision applies to solicitations containing the clause at 52.225-1.
(xvii) 52.225-4, Buy American--Free Trade Agreements--Israeli Trade Act Certificate. (Basic, Alternates I, II, and III.) This provision applies to solicitations containing the clause at 52.225- 3.
(A) If the acquisition value is less than $25,000, the basic provision applies.
(B) If the acquisition value is $25,000 or more but is less than $50,000, the provision with its Alternate I applies.
(C) If the acquisition value is $50,000 or more but is less than $79,507, the provision with its Alternate II applies.
(D) If the acquisition value is $79,507 or more but is less than $100,000, the provision with its Alternate III applies.
