7. Award will be made as a Firm-Fixed Priced Purchase Order to the lowest priced quote whose quote conforms to the requirement of the solicitation and where price has been determined fair and reasonable. The quoter must provide pricing for ALL items in the solicitation for its quote to be acceptable to the Government. Quotes must set forth full, accurate and complete information as required by the RFQ.

8. Multiple quotes are not accepted for this RFQ. If multiple quotes are received only one quote (as determined by the Contracting Officer) will be evaluated by the Government. The quote shall be determined acceptable based on the date and time received.

10. PROSPECTIVE CONTRACTORS: Contractors are required to be registered in the System for Awards Management (SAM) for awards resulting from solicitations.

“Registered in the System for Award Management (SAM) database” means that –

a. The Offeror has entered all mandatory information, including the unique entity identifier and the

EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into the SAM database;

b. The offeror has completed the Core, Assertions, and Representations and Certification, and Points of contact sections of the registration in the SAM database;

c. The Government has validated all mandatory data fields, to include validation of the Taxpayer

Identification Number (TIN) with the Internal Revenue Service (IRS). The Offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process.

d. The Government has marked the record “Active”.

This rule more efficiently implements the Debt Collection Improvement Act of 1996, as it requires contractors to be registered in SAM for consideration of future solicitations, awards, and payment.

Registration is required prior to award of any contract, basic agreement, basic ordering agreement, or blanket purchase agreement from a solicitation.

12. State and Local Taxes

The U.S. Army Corps of Engineers is exempt from paying state and local taxes per Title 4 United States Code 104-107. The U.S. Army Corps of Engineers Tax ID Number is 62-1642142.

Contractors performing services for the U.S. Army Corps of Engineers are not exempt from state and local taxes in transactions with vendors, suppliers or subcontractors. It is the contractor’s responsibility to investigate applicable federal, state, and local taxes, along with any specific exemptions that may exist.

This includes any applicable Value-Added Taxes (VAT), sales, use,and excise taxes.

The U.S. Army Corps of Engineers will not accept any invoice with a separate tax line. If there are anyappropriate taxes, the contractor my considerer that tax as the cost of doing business and incorporate that cost within the cost of the item or job.

Performance Work Statement (PWS)

Mud Mountain Dam (MMD) Installation of Playground Equipment Jax Pack Four

04 April 2023

1. DESCRIPTION OF WORK: The Contractor shall provide all labor, equipment, and materials to install climber playground equipment called Jax Pack Four at Mud Mountain Dam Park in accordance with the basic specifications listed below. The playground equipment is currently being stored at Mud Mountain Dam.

2. LOCATION:

Mud Mountain Dam (MMD) is located in Southeast King County on the White River near Enumclaw, Washington. The physical address for MMD is 30525 SE Mud Mountain Rd, Enumclaw, WA 98022. For site location, see Figure 1 in this document.

3. GENERAL REQUIRMENTS FOR ALL WORK:

3.1. Work must comply with safety requirements identified in EM 385-1-1. Contractor shall submit for government approval a Site-Specific Safety Plan, per the requirements of EM 385-1-1, prior to starting any onsite work.

3.2. Prior to installation, the contractor shall conduct a walkthrough site survey with government personnel to confirm exact dimensions, specifications, and requirements. During the walkthrough, the contractor shall inspect all components, hardware, and parts necessary for proper assembly and installation.

3.3. 90 day labor warranty against any defects in workmanship that affects the performance of the product.

3.4. Warranty related repairs will be conducted at MMD.

4. PRINCIPAL ITEMS TO BE ACCOMPLISHED ARE:

4.1. Base Bid Item 0001 – Install Jax Pack Four Playground Equipment

4.1.1. Contractor shall assemble and install the Jax Pack Four playground equipment already stored onsite at

MMD in a secure location and will be made readily accessible to the contractor prior to installation. The model number is 477-004. Contractor shall perform work in accordance with the installation manual and best management practices. In addition, the work shall be performed to meet the following requirements:

Equipment shall fit within a 23’ by 22’ safety footprint. Exact location the equipment is to be installed will be identified by the government. Refer to Attachment 01, for images of site location.

Remove wood chips away from the working area prior to digging holes for footings

Install footing per the installation manual. Spoils from the excavation can be disposed of onsite.

Anchor the playground equipment to the footings per the installation manual.

Provide necessary barricades, cones, caution tape, etc., to keep public away from work site area.

Contractor is responsible for securing the playground equipment until concrete reaches adequate strength to allow play.

Replace wood chips to play area once equipment install is completed.

5. PRE-BID SITE VISIT

A pre-bid site visit may be requested by the contractor if desired.

6. CONDITIONS AFFECTING WORK

6.1. Work Coordination:

6.1.1. The Contractor shall contact the Park Ranger within five (5) days of award to coordinate the installation of the Jax Pack Four.

6.2. Interface with Others:

6.2.1. Contractor shall give five (5) days notice to the PM prior to coming onsite to install the Jax Pack Four.

6.3. Work Restrictions:

6.3.1. The installation must occur during MMD’s normal working hours which are 0800-1600, Monday through Friday, except when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

The Contractor will not provide services on the following federal holidays:

6.3.2. Laws, Rules, Regulations and Compliance: All Contractor and subcontractor employees shall observe and comply with all applicable local, State and Federal laws, rules and regulations, including those concerning fire, safety, sanitation, security, vehicle operation, and hazardous material handling while performing this contract.

7. SECURITY:

7.1. All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

7.2. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

7.3. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than three (3) business days after the initial contract award.

8. SUBMITTALS:

8.1. Upon completion of all work, the contractor shall submit 90 day labor warranty documentation.

8.2. A Site Specific Safety Plan shall be submitted as identified in Section 3.1

9. PERFORMANCE PERIOD:

The Contractor is required to commence work under this contract within thirty (30) calendar days after the date of Contract Award. The contractor shall prosecute the work diligently and complete all work within forty-five (45) days of Contract Award. The time stated for completion includes final cleanup submission of all required close-out documentation.

1. PURPOSE

This Quality Assurance Surveillance Plan (QASP) provides a systematic method to evaluate performance for the stated contract. This QASP explains the following:

What will be monitored How monitoring will take place Who will conduct the monitoring How monitoring efforts and results will be documented

This QASP does not detail how the contractor accomplishes the work. Rather, the QASP is created with the premise that the contractor is responsible for management and quality control actions to meet the terms of the contract. It is the Government’s responsibility to be objective, fair, and consistent in evaluating performance. In addition, the QASP should recognize that unforeseen and uncontrollable situations may occur.

This QASP is a “living document” and the Government may review and revise it on a regular basis. However, the Government shall coordinate changes with the contractor. Updates shall ensure that the QASP remains a valid, useful, and enforceable document. Copies of the original QASP and revisions shall be provided to the contractor and Government officials implementing surveillance activities.

2. GOVERNMENT ROLES AND RESPONSIBILITIES

The following personnel shall oversee and coordinate surveillance activities.

a. Contracting Officer (KO) - The KO shall ensure performance of all necessary actions for effective contracting, ensure compliance with the contract terms, and shall safeguard the interests of the United States in the contractual relationship. The KO shall also assure that the contractor receives impartial, fair, and equitable treatment under this contract. The KO is ultimately responsible for the final determination of the adequacy of the contractor’s performance.

b. Acquisition Manager (AM) - The AM acts as an acquisition consultant and serves as liaison between the USACE and the requesting program office, as well as liaison between the USACE and the supporting contracting office.

c. Quality Assurance Represented (QAR): The QAR monitors all technical aspects of the contract and assists in contract administration. The QAR is authorized to perform the following functions; assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies, coordinate availability of government furnished party; and provide site entry of Contractor personnel.

The QAR is not authorized to change any of the terms and conditions of the resulting order.

4. PERFORMANCE STANDARDS

Performance standards define desired services. The Government performs surveillance to determine if the contractor exceeds, meets or does not meet these standards.

The Performance Requirements Summary Matrix identifies performance standards. The Government shall use these standards to determine contractor performance and shall compare contractor performance to the Acceptable Quality Level (AQL).

5. INCENTIVES: NA

6. METHODS OF QA SURVEILLANCE

Various methods exist to monitor performance. The QAR shall use the surveillance methods listed below in the administration of this QASP.

Regardless of the surveillance method, the QAR shall always contact the contractor's task manager or on-site representative when a defect is identified and inform the manager of the specifics of the problem. The QAR, with assistance from the onsite USACE employees, shall be responsible for monitoring the contractor’s performance in meeting a specific performance standard.

a. PERIODIC INSPECTION - Periodic Inspections of the quality and the status of the project may be scheduled daily or unscheduled, as required.

b. VALIDATED COMPLAINTS - Upon notification of a valid complaint the QAR will complete an inspection.

Surveillance results may be used as the basis for actions (to include payment deductions) against the contractor. In such cases, the Inspection of Services clause in the Contract becomes the basis for the KO’s actions.

8. RATINGS

Metrics and methods are designed to determine if performance exceeds, meets, or does not meet a given standard and acceptable quality level. A rating scale shall be used to determine a positive, neutral, or negative outcome. The following ratings shall be used:

EXCEPTIONAL: Performance significantly exceeds contract requirements to the Government’s benefit.

SATISFACTORY: Performance meets contractual requirements.

UNSATISFACTORY: Performance does not meet contractual requirements.

9. DOCUMENTING PERFORMANCE

The Government shall document positive performance. A report template is attached. Any report may become a part of the supporting documentation for fixed fee payments, award fee payments, or other actions.

b. UNACCEPTABLE PERFORMANCE

When unacceptable performance occurs, the QAR shall inform the contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the QAR shall document the discussion and place it file.

When the QAR determines formal written communication is required, the QAR will contact the Contracting Specialist and Contracting Officer. Contracting will prepare a Contract Discrepancy Report (CDR), and present it to the contractor's task manager or on-site representative.

The contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the contractor is required to prepare a corrective action plan to document how the contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the contractor has to present this corrective action plan to Contracting and QAR. The Government shall review the contractor's corrective action plan to determine acceptability.

Any CDRs may become a part of the supporting documentation for contract payment deductions, fixed fee deductions, award fee nonpayment, or other actions deemed necessary by the KO.

10. FREQUENCY OF MEASUREMENT

a. Frequency of Measurement. During contract/order performance, the QAR shall take periodic measurements, as specified in the PRS matrix identified in section 4, and shall analyze whether the negotiated frequency of measurement is appropriate for the work being performed.

Commercial and Government Entity (CAGE) code means--

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services.
