Section SF 1449 - CONTINUATION SHEET

PERFORMANCE WORK STATEMENT

C-1. SCOPE OF WORK. Provide all labor, material and equipment necessary to dry-dock and repair Barge 226 according to the following specifications. The work under this contract consists of dry-docking a 41’ x 151’ barge, repairing rusted and/or damaged metal, sandblasting and painting the exterior of the barge and all requirements outlined in these specifications. The Contractor shall assume 25% of the bottom of the barge will need replaced.

Should the removal or shifting of any parts of the barge be necessary for carrying out the repairs specified, the same shall be done by the Contractor and all such removals shall be subsequently replaced. Any damage or loss resulting from action taken or not taken by the Contractor while the barge is under the Contractor’s care or in the Contractor’s possession shall be restored by the Contractor at his/her own expense. The Contractor shall contact the Government should any portion of the barge’s structure require alteration in order to carry out the work, even though not specifically mentioned herein. If the Government agrees, a modification to the contract will be awarded to make the required alterations. The Contractor shall provide workboat services to move Barge 226 from its current location to dry-dock and return to its current location once work is completed. Barge 226 is currently located at Racine Locks and Dam in Letart, West Virginia. The Contractor shall take the necessary precautions to prevent delays and damages that may result from weather. This may include but is not limited to draining lines and constructing temporary cover. The Contractor shall provide all shore power necessary to protect the vessel’s systems (if required). The Contractor shall have 60 business days to perform all work once the barge has reached the dry-dock facility.

C-2. DETAILED REQUIREMENTS.

C-2 A. The repairs required on Barge 226, include but are not limited to:

(1) The barge shall be dry-docked at the site where repairs are to be made prior to commencement of the repair work herein specified. The Contractor shall be responsible for properly positioning the supporting blocks so that the vessel will not be damaged. The blocks shall be set to bear on frames or bulkheads of the hull, and the vessel shall be supported with the bottom of the hull at least 42 inches above the floor of the dry-dock. The Contractor shall maintain his dry-dock and/or other places where work under this contract is being performed, clean and free of expended blasting abrasives, scrap metal, water, scrap lumber, and other debris. All air hoses, water hoses, and electrical extension cables on or about the vessel shall be arranged in a neat, orderly and workman-like fashion.

(2) Brush-off Blast Clean the exterior of the barge, according to SSPC-SP7. Remove all loose mill scale, loose rust and other detrimental foreign matter. Notify Government representative Tyler Lester when this work has been complete so a technical inspection can be performed prior to continuing work. Cover all windows (if applicable) to protect from blast media and paint overspray.

(3) Repair the rust pitting on the hull. Weld fill all pits having a depth of 3/32” and greater. Hull areas with high concentrations of rust pits (rust pit concentration areas greater than 25% of the surface area in a 2’ x 2’ area) must be repaired by cutting out the existing metal and welding new metal into the hull. Replacement material must be of comparable size and thickness of the original. Estimate up to 500 pits to be welded and 2 square feet hull plate replacement; once the vessel is on dry-dock an assessment will be performed by Government representative Tyler Lester. Variations in work requirements shall be adjusted by contract modification. Assume 25% of the hull needs replaced.

(4) All welds shall conform to AWS D 1.1(2006) Structural Welding Codes; Steel.

(5) Once the rust pits are filled with weld, grind them smooth with the exterior of the hull.

(6) Furnish and install 12 each magnesium anodes distributed evenly throughout the exterior of the barge hull. Anodes shall be equal to MG-5 Launch 5 LB Magnesium Anode with Plastisol Coating.

(7) Inspect all ballast tanks and document interior condition. Provide photographs of any paint failure and/or existing corrosion. The Contractor shall inspect all interior compartments of the boat and document the condition. The Contractor shall submit a detailed report including location and photographs of each notable breach in the interior paint coating, structural damage and excessive corrosion point. The Contractor shall submit the condition report within 10 business days after the barge has been delivered to the Contractor’s facility and shall include a list of any repairs necessary to protect the structural integrity of the barge. The list shall be submitted without pricing. The Government shall determine if an additional modification shall be pursued based on the condition report, physical inspection and reasonableness of the proposal and availability of funding. If the Government elects to pursue a modification for the additional repairs, the Government will then request a quotation from the Contractor.

(8) Inspect entire barge and provide the Government with a list of necessary changes required to meet all current Coast Guard Standards.

(9) Prepare the barge exterior surfaces for painting by “Commercial Blast Cleaning” SSPC-SP6. The barge before painting shall be free of all visible oil, grease, dirt, dust, mill scale, rust paint, oxides, corrosion products, and other foreign matter, except for staining. Staining shall be limited to no more than 33 percent of each square inch of surface area and may consist of light shadows, slight streaks, or minor discolorations cased by stains of rust, stains of mill scale, or stains of previously applied paint. Before blast cleaning, visible deposits of oil or grease shall be removed by any of the methods specified in SSPC-SP1 or other agreed upon methods. For complete instructions, refer to Joint Surface Preparation Standard SSPC-SP6/NACE No. 3.

(10) Paint the entire exterior of the barge, including the main deck and entire hull with two (2) coats of Carboguard 635 (or equal) all-purpose marine epoxy coating system according to the following Coating Color Schedule. Apply one additional coat of Carboguard 635 (or equal) coats over edges, cutouts and welds. All coats shall be at 4 to 8 mils per coat. Use contrasting colors for each coat and stripe coat. This includes the hull, the deck, and areas above and below the water line, railing, winches, toe knees and all deck fittings. All deck coatings shall include aluminum oxide non-skid additive to include the top of the pilot house. Apply an additional coat of Carbothane 134 HG (or equal) above the water line plus additional paint needed to match the color requirements below. The final coating for the deck fittings, deck rail, etc. will require additional coats to obtain the desired final color. All decks coatings shall include aluminum oxide added to the epoxy to provide a non slip surface. The final coating color requirements are listed below.

Non-skid additive shall be added to the last coat on all deck areas including the pilothouse top.

Piping Systems shall be stenciled with arrows to indicate direction of flow and shall be color coded with 3-inch wide bands to indicate type of service. Bands shall have a maximum spacing of twenty feet with at least two bands per compartment. The following colors will be used:

All items of machinery and equipment shall be painted with individual manufacturer’s standard colors. Painted surfaces damaged in handling and installing the equipment shall be repainted.

Deck fittings and lettering or numerals shall be over-coated (over the barrier coat) with a top coat of at least 4 mils.

C-3. MATERIALS AND WORKMANSHIP STANDARDS. This paragraph covers workmanship standards, and metalwork fabrication procedures applicable to the items of repair work specified herein.

a. Applicable Publications. The following publications of the issues listed below, but referred to thereafter by basic designation only, form a part of these specifications to be the extent indicated by the references thereto:

American Welding Society, Inc. (AWS).

A 2.4 (2007) Symbols for welding and nondestructive testing, including brazing D 1.1 (2006) Structural Welding Code-Steel

b. Workmanship. Workmanship shall be of the highest grade and in accordance with the best modern practices to conform to the specifications for the item of work being furnished.

c. Quality Control. The Contractor shall establish and maintain a quality control system to assure compliance with contract requirements and shall maintain records of all quality control operations covered by these specifications. The Contractor shall provide continuous inspection of all operations for quality control and record the results for submitting to Government Representative Tyler Lester to show compliance with contract requirements.

d. Welding.

(1) General. Welding shall be by an electric arc-welding process and shall conform to the applicable provisions of AWS D1.1, Sections 1 thru 7, 9 and 10 unless otherwise specified or authorized. Welding operators, welders and tack welders shall be qualified and requalified if necessary for the particular type of work to be done. Qualification shall be in accordance with AWS D1.1, Section 5, (Coast Guard qualification acceptable).

The Contractor shall certify by name the welders and welding procedures under which qualified. Prior qualification will be accepted if welders have performed satisfactory work under the code for which qualified within the preceding three months. The Contractor shall require welders and welding operators to repeat the qualifying tests when in the opinion of Government Representative Tyler Lester their work indicates a reasonable doubt as to proficiency. Those passing the re-qualification tests shall be recertified. Those not passing shall be disqualified until passing. All expenses in connection with qualification and re-qualification shall be borne by the Contractor.

(2) Inspection. The Contractor shall maintain an approved inspection system and perform required inspections to assure compliance with contract requirements. Welding shall be subject to inspection by Government Representative Tyler Lester Officer or his authorized representative to determine conformance with the requirements of AWS D1.1, the approved welding procedures and provisions stated in other sections of these specifications. The Contractor shall clean the welds of scale, slag, weld spatter, etc., in preparation for inspection. The Contractor shall ascertain that all welding conforms with the requirements and/or these specifications as to size, length, location, and positioning of members prior to welding, particularly members that are to be positioned into close contact for welding. The Contractor shall carefully examine each weld for surface defects, undercutting, lack of fusion, insufficient penetration, porosity, craters, cracks, gas pockets, etc., in the weld or base metal.

(3) Non-Destructive Examination. By formal modification to the contract, the Government may require non-destructive testing of Contractor welds. If Contractor welds are to be non-destructively tested as required by the Contracting Officer, the Contractor shall make the necessary arrangements for the non-destructive testing by a recognized testing agency. If the welds are found to be satisfactory, the Government will pay the costs of the non-destructive testing. If the welds are found to be defective, the Contractor will be required to bear both the costs of the non-destructive testing and of the required rewelding. All sections of welds found defective shall be chipped, cut, or gouged out to base metal and properly rewelded.

(4) Procedure. The Contractor may be required to prepare and submit for approval a complete schedule of welding procedures consisting of detailed procedure specifications to be used for each welded connection. The schedule shall conform to the provisions of AWS D1.1, Sections 2, 3, 4, 7, and 9 and applicable provisions of Section 10. Procedures shall be such as to minimize residual stresses, distortion and shrinkage.

Approval of any procedure will not relieve the Contractor of the responsibility for producing a finished structure meeting all requirements of these specifications.

(5) Temporary welds. Temporary welds required for fabrication and erection shall be under the same controlled conditions described herein for permanent work. All temporary welds shall be made by welders qualified for permanent work as previously specified. Temporary welds shall be removed after having served their purposes, and shall be ground flush with adjacent surfaces. All depressions shall be filled overfull with weld metal and the excess weld metal shall then be ground flush.

(6) Preheat. Preheating shall be performed as required by AWS D1.1, Sections 4.2 and 4.3 except that the temperature of the base metal shall be at least 70 degrees F. The weldments to be preheated shall be slowly and uniformly heated by approved means to the prescribed temperature, held at that temperature until the welding is completed, and then permitted to cool slowly in still air. Preheating temperatures shall be monitored by the use of suitable temperature-indicating sticks, liquids, or pellets, as manufactured by Tempil Corporation, Markal Company, Curtiss-Wright Corporation, and others.

(7) Filler Metal. The electrode, electrode-flux combination and grade of weld metal shall conform to the appropriate AWS specification for the base metal and welding process being used. The AWS designation of the electrodes to be used shall be included in the schedule of welding procedures. A controlled temperature storage oven shall be used at the job site as prescribed by AWS D1.1, Section 4.45 to maintain low moisture of low hydrogen electrodes.

e. Flame Cutting. Structural steel may be cut by machine-guided or hand guided torches instead of by shears or saws. Flame cutting of material other than structural steel shall be subject to approval by Government Representative Tyler Lester. Where a torch is mechanically guided, on chipping or grinding will be required except as necessary to remove slag and sharp edges. Where a torch is hand guided, all cuts where the material is to be welded and the cuts will be exposed or visible shall be chipped, ground, or machined to sound metal. Where metal is not to be welded and where cuts will be exposed, burrs and rough edges only shall be removed. Where the torch is mechanically guided, flame gouging will be permitted in preparation for welding.

C-4. BLAST CLEANING AND PAINTING. This paragraph covers surface preparation and painting standards applicable to the items of repair work specified in paragraph C-2.

a. Surface Preparation. Surface preparation of bare metal as well as tightly adhering coating will conform to manufacturer’s recommendations unless specified differently in this document. Areas that might require blast cleaning in preparation for application of the paint system, for example but not limited to damaged coating, corroded metal, and bare metal, shall be performed in accordance with Steel Structures Painting Council Specification SSPC- SP-6, for “Commercial Blast Cleaning”. Surfaces shall be dry at the time of blasting. Within eight (8) hours after cleaning, but in any event prior to the deposition or formation of any detectable moisture or corrosion, all blast cleaned surfaces shall be cleaned of dust and abrasive particles by brushing, vacuum cleaning, and/or blow-down with clean, dry compressed air, and given the first coat of paint. Cleaning and painting shall be so programmed that dust or other contaminants from the cleaning process do not fall on wet, newly painted surfaces, and surfaces not intended to be painted shall be suitably protected from the effects of cleaning and painting operations. Prior to painting, abrasive particles, dust, water, and all other matter on the deck which might, in the opinion of Government Representative Tyler Lester, adversely affect the painting application, shall be removed to the satisfaction of Government Representative Tyler Lester.

b. Paint Requirements. Paint shall be delivered in sealed containers with labels to indicate manufacturer, contents, and any special instructions. Paints and painting materials shall be stored under cover and protected from extreme temperatures. Paints shall not be used if they have exceeded the closed shelf life or pot life recommended by the manufacturer. Additionally, paints shall not be applied in weather or humidity conditions not recommended by the manufacturer.

c. Application of Coatings. Surface preparation and paint application shall be in strict compliance with the coating manufacturer’s recommendations. The Contractor shall take particular care to insure that coating system requirements are met in all areas, especially those difficult to coat, such as flange undersides. All painting on both the interior and exterior surfaces below the main deck shall be accomplished prior to launching of the vessel. All requirements outlined in this specification are additional to the manufacturer’s recommendations and does not relieve the Contractor from meeting both the manufacturer’s recommendations along with the additional requirements outlined in this specification.

d. Coating System. The system is outlined in the manufacurer’s specification for a Carbozinc primer, a two coat Carboguard 635 system, and Cabothane 134 HG top coat.

e. Inspection. Surface preparation and paint application will be inspected by Government Representative Tyler Lester for compliance with the provisions of this section. Blast-cleaned surfaces and each applied coat of paint will be examined for imperfections by Government Representative Tyler Lester.

SPECIAL CONTRACT REQUIREMENTS

Contractor and Government Equipment and Supplies The contractor shall furnish all personnel, equipment, transportation, disposal, supplies and materials to perform the work. No government equipment or supplies shall be used for this project. The Contractor shall provide Personal Protection Equipment to include steel-toed safety boots, hard hat, safety glasses, hearing protection, sleeved shirts, long pants, gloves and sunscreen.

Contractor Submittals. The successful offeror shall provide as a minimum the following documentation. All contractor submittals must be reviewed and accepted by Government Representative Tyler Lester or government designated authority prior to commencement of any work.

A. Invoice as stated on the contract award.

B. Man hour report at completion of work.

C. Warranty as stated in the Performance Work Statement.

Damage Reports. All instances where Government materials, supplies, property, and/or equipment are damaged shall be reported immediately to Buckner Douglas, Lock Master, Belleville Lock and Dam, at (740) 378-6110.

When the damage is caused by contractor employees, a written report of the incident and extent of such damage shall be submitted to Mr. Douglas within two (2) business days (less weekends and holidays) of occurrence. For property damage accidents of $5,000 or more, the Contractor will complete and submit to Mr. Douglas a copy of ENG 3394, which may be requested from project personnel or contracting office, if needed.

Contractor Employees’ Conduct and Competency. All contract employees shall conduct themselves in a proper manner at all times. The conduct of all employees is critical and will be closely monitored. Use of controlled substances or consumption of beer or alcoholic beverages by contract employees is strictly prohibited. The contractor may be required to immediately remove from the work site any employee of the Contractor who is incompetent or who endangers persons or property or whose physical or mental condition is such that it would impair the employee's ability to satisfactorily perform the work.

Contractor Invoice. Contractor shall submit its invoice to Mr. Tyler Lester, Maintenance Section, U.S.

Deficiencies. If the Contractor fails to perform, or if performance in any area is judged unsatisfactory, the Government may take corrective action. If any of the work does not conform to contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no cost to the Government.

Veterans Employment Emphasis for U.S. Army Corps of Engineers Contracts:

SECURITY REQUIREMENTS

All Contractors and subcontractor employee(s) working on this contract who require access in and/or around any Huntington District facilities shall receive authorization to be on site at these facilities based upon a favorable background investigation in accordance with “Homeland Security Presidential Directive 12: Policy for a Common Identification Standard for Federal Employees and Contractors” (HSPD 12). The Huntington District Security Management Office shall submit contractor(s) personal information to complete the basic background investigation in order to make a recommendation to the Contracting Office of an employee’s suitability for work on Government property. The Procuring Contracting Officer (PCO) has the right to deny any contractor or subcontractor employee from working on the contract based upon the results of the background investigation provided by the Huntington District Security Management Office. The Government, Contractor, and subcontractors shall not permit any employee(s) access to drawings, blueprints, records, photos, sites, or projects until the Huntington District Security Management Office has completed an Operations Security (OPSEC) review of such items and determined they can be released.

FOR ALL CONTRACTS 1-YEAR AND SUBSEQUENT OPTION YEARS:

Contractors shall submit a complete investigation packet for each contractor and subcontractor employee to the Huntington District Security Management office within 10 working days after award of any contract, or prior to the individual being permitted unescorted access in or on District facilities.

The Contractor must also provide the following: (1) Name of the Contract Specialist with whom he/she is working,

(2) Project Name, (3) Contract Number (4) Task Order Number when applicable, and (5) Security Information sheet on each employee working on site must be submitted directly to the Huntington District Security Office.

The Contractor must provide a full legal name, complete SSN#, Date of Birth, Place of Birth (City and State) and Driver’s license number if available. It is the Contractor’s responsibility to ensure the above information is accurate and legible, otherwise delays may occur.

Contractors shall have background checks completed for their employees annually in the case of Contracts with option periods. For instance, if the employee was cleared in May of 2018, they shall be cleared again in May of 2019. It is the Contractor’s responsibility to ensure that each employee’s security is up to date. Failure to comply may lead to possible removal from the project/jobsite.

The Contractor must ensure if new employees are brought in to work on an existing Contract with the U.S. Army Corps of Engineers (USACE), they must process the employee through the Huntington District USACE Security Management Office for background purposes.

FOR CONTRACTORS REQUIRING DOD COMMON ACCESS CARDS (CAC)

The documents listed below are required:

SF 85, Questionnaire for Non-Sensitive Positions (see http://www.opm.gov/forms/ to print form). FD 258, Contractor Fingerprint Card (one card for digital prints, two for ink prints) (NOTE: a trained/qualified individual must take prints, ORI block on the FD 258 must be USOPM000Z) (Contractor Fingerprint Cards (FD-258) may be obtained by Contracting Division by contacting the Huntington District Security Management Office).

Contractor shall report any changes in personnel, or at any time conditions change at least 5 working days prior to individual(s) need to have access to the site. The Contractor shall provide the same information as listed above for all new employees.

Following submission of paperwork, the Huntington District Security Management Office will conduct an initial criminal check based upon the information provided. If there are no issues, the Huntington District Security Management Office will make recommendations to the PCO or their Designated Representative. The Huntington District Security Management Office cannot give approval due to unfavorable report(s). The Huntington District

Security Management Office shall coordinate with Office of Counsel and will jointly make recommendations to the PCO and/or the Designated Representative should a background investigation come back with derogatory information. The PCO will make the determination whether to allow the Contractor personnel to work on the site based on Security and Office of Counsel recommendations, and the PCO will advise the Contractor of the decision.

FOREIGN NATIONALS

The Contractor shall provide the package listed above, as well as additional materials noted below for all Foreign Nationals. The Contractor is to expect additional time in the approval process for all Foreign Nationals due to the level of review and elevation of the review to Headquarters staff to complete. All Foreign Nationals must comply with the following paragraph:

In accordance with Engineering Regulation 380-1-18, “Technology Transfer, Disclosure of Information and Contacts with Foreign Representatives” dated 1 August 1996, Section 4, all foreign nationals who work on Corps of Engineers’ contracts shall be approved by the Headquarters US Army Corps of Engineers (HQ USACE) Foreign Disclosure Officer before beginning work on this contract; this regulation includes subcontractor employees. The Contractor shall submit to the Security Management Office, the names of all foreign nationals proposed for performance under this contract, along with documentation to verify legal admittance into the United States. Such documentation shall include at least one of the following: a U.S. passport, Certificate of U.S. Citizenship (INS Form N-560 or N-561), Certificate of Naturalization (INS Form N-550 or N-570), Alien Registration Card with photograph (INS Form I-151 or I-551), Employment Authorization Card (INS Form I-688A), etc.

In order to assure forms are properly completed, and to minimize time delays, the Contractor is encouraged to work closely with the Huntington District Security Management Office. The Government will return for correction incomplete forms, illegible forms, etc. which will delay the contractor / subcontractor from beginning work.

Security requirements are subject to change in accordance with HSPD-12, Office of Personnel Management, regulation or policy changes, etc. The Government shall add any changes to security requirements by modification to the contract.

AT/OPSEC Requirements. The following shall be accomplished by the contractor before any work will be ordered:

1. AT Level I Training. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities and controlled access areas shall complete AT Level I awareness training within thirty

(30) calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to Government Representative Tyler Lester, within five (5) calendar days after completion of training by all employees and subcontractor personnel. AT Level I awareness training is available at the following website: https://atlevel1.dtic.mil/at/; or it can be provided by the RA ATO in presentation form which will be documented via memorandum.

2. Access and General Protection/Security Policy and Procedures. All Contractor and all associated sub‐ contractors employees shall comply with applicable installation, facility, and area commander installation/facility access and local security policies and procedures (provided by government representative).

The contractor shall also provide all information required for background checks or background investigation and to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services, or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.

4. Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something).

The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.

5. For Contracts that Require OPSEC Training. All new contractor employees will complete Level I OPSEC

Training within 30 calendar days of their reporting for duty. Additionally, all contractor employees must complete annual OPSEC awareness training. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee, to Government Representative Tyler Lester), within 5 calendar days after completion of training. OPSEC awareness training is available at the following websites:

6. For Information assurance (IA)/information technology (IT) training. All contractor employees and associated sub-contractor employees must complete the DoD IA awareness training before issuance of network access and annually thereafter. All contractor employees working IA/IT functions must comply with DoD and Army training requirements in DoDD 8570.01, DoD 8570.01-M and AR 25-2 within six months of employment.

7. Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify

Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements.

The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to Government Representative Tyler Lester and shall become part of the official contract file.

8. Threat Awareness Reporting Program. All new contractor employees will complete annual Threat Awareness and Reporting Program (TARP) Training provided by a Counterintelligence Agent, IAW AR 381-12. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee(s) or a memorandum for the record, to Government Representative Tyler Lester, within 5 calendar days after completion of training. 52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (JUN 2016)

(a) Definitions. As used in this clause--

Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public Web sites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019)

The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications--Commercial Items.

(a) Definitions. As used in this provision--
