RFQ#PSC295128
(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
(ii) The solicitation number is RFQ#PSC295128. The solicitation is issued as a Request for Quote (RFQ)
(iii) This solicitation and incorporated provisions and clauses are those in effect through
Federal Acquisition Circular 2022-05.
(iv) The corresponding NAICS code is 541511 and the small business size standard is
$30 million.

(vi) Description of Requirements –
The U.S. Department of Health and Human Services (HHS), Program Support Center
(PSC), has a requirement to purchase COBOL IT Software licenses.
(vii) Date(s) and place(s) of delivery and acceptance.
The government anticipates an award by July 29, 2022.
Period of performance:
Base Year: August 2, 2022-August 1, 2023
OPT YR1: August 2, 2023-August 1, 2024
OPT YR2: August 2, 2024-August 1, 2025
OPT YR3: August 2, 2025-August 1, 2026
OPT YR4: August 2, 2026-August 1, 2027

(viii) The provision at FAR 52.212-1, Instructions to Offerors – Commercial Items, applies to this acquisition.
(ix) The provision at FAR 52.212-2, Evaluation – Commercial Items, applies to this acquisition.
The following factors will be used to evaluate offers:
• Vendor is an authorized distributor for COBOL-IT. A letter of confirmation from
COBOL IT's current owner stating the vendor is the Authorized distributor of
COBOL IT is required.
• The vendor can provide all the required licenses by the required start date.
The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
Award will be made to the low price, technically acceptable offeror.
(x) Offerors are to include a completed copy of the provision at FAR 52.212-3, Offeror
Representations and Certifications – Commercial Items, with its offer or acknowledge its registration in the System for Award Management (www.sam.gov) Online
Representations and Certifications Application.
Offerors should also include a completed copy of the below Representation and

Alternate Provision: Contractor Tax Liability or Felony Conviction
The Consolidated and Further Continuing Appropriations Act, 2015 Pub. L 113-
235, Division E, Sections 744 and 745 prohibits covered agencies from using funds to enter into contracts with corporations that have unpaid federal tax delinquencies or certain felony convictions unless certain conditions are met.
a. The Offeror represents that -
1. It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal or State law within the preceding 24 months.
2. It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability.
