Cryostorage System
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR 12.6 – Streamlined Procedures for Evaluation and Solicitation for Commercial Items as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a separate written solicitation document will not be issued. This solicitation is being issued under the authority of FAR Part 13, Simplified Acquisition Procedures.
This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2020-05, Effective March 30, 2020.
The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 – Analytical Laboratory Instrument Manufacturing. The small business size standard is 1,000 employees. This acquisition will utilize Full and Open competition procedures.
Brand name or equal requirement. The BIOSTORE III 1500 CRYO Box, manufactured by Brooks Automation has been identified as meeting all specifications identified in the Statement of Requirements (SOR). Quoter’s must provide the salient characteristics of the brand name or equal identified within the solicitation. All part numbers listed are of the Brooks BIOSTORE III 1500 CRYO Box.
This is a brand name or equal requirement. Brand name or equal description is intended to be descriptive, but not restrictive and is to indicate the quality and characteristic of products that will be considered satisfactory to meet the agency’s requirement.

DELIVERY
The Cryostorage Instrument will be delivered within 105 days of the date of award. The items shall be shipped F.O.B. Destination to:

FOB DESTINATION MEANS: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery.
EVALUATION CRITERIA
The Government intends to award a single purchase order resulting from this solicitation to the responsible Contractor whose quotation, conforming to the solicitation, will be the most advantageous to the Government, price and another factor considered:
In addition to price, technical capability shall be used to evaluate quotations.
1. Technical Capability
Technical Approach Evaluation of technical capability shall be based on the information provided in the quotation. NIST will evaluate whether the offeror has demonstrated that its proposed instrument meets or exceeds all minimum requirements herein, and within the statement of requirements document. Quotations that do not demonstrate that the proposed instrument meets all requirements will not be considered for award. If an offeror does not indicate whether its proposed equipment meets a certain minimum requirement NIST will determine that it does not. In evaluating technical capability, additional consideration shall be given to quotations that include the following:
1. An automatic filling station able to safely fill cryopod carriers with liquid nitrogen in less than 10 minutes.
PRICE
The quoted price will be evaluated to determine whether the prices are fair and reasonable in relation to the solicitation requirements.
NIST intends to evaluate quotes and issue a contract based on the initial quotes received. Therefore, the Contractor’s initial quote should contain the Contractor’s best terms from a price and technical standpoint. NIST reserves the right to request revised quotes from, or negotiate final contract terms with, one or more, but not all, Contractors if later determined by the Contracting Officer to be necessary.
REQUIRED SUBMISSIONS
All Contactors shall submit the following:
Technical Approach Documentation that confirms the Contractor is capable of providing the brand name or equal instrument in accordance with the SOR document. If quoting an “or equal” instrument, the vendor must provide documentation of how the “or equal” instrument meets each specification. Quoter’s shall include a copy of the quoted system’s manufacturer’s specifications.
Price Contractor’s shall provide a firm-fixed price for the Line Items (CLINs) 0001- 0009. All equipment must be new. Used or remanufactured equipment will not be considered for award.
· CLINooo1, Firm-Fixed Price: One (1) Cryostorage Instrument inclusive of F.O.B Destination Shipping,, installation, training, and warranty, in accordance with the specifications set forth in the solicitation/requirements documents $_________________total firm-fixed price.
OPTIONS FOR CONSUMABLES (OPTIONS 2 THROUGH 5): The contractor shall provide the following options, to be exercised at the discretion of NIST within one year after contract award, for purchase of consumable products. To be delivered within 30 days after exercise of option:
· CLIN0002, Option to purchase additional bulk 1.5mL CYRO tubes, capped, sterile, external threaded X, 2D barcode on base, 1D linear barcode and human readable number on side for inventory control in bulk, quantity of 5 cases (480 tubes per case).
· CLIN0003, Option to purchase additional bulk 1.9mL CYRO tubes, capped, sterile, external threaded, 2D barcode on base, 1D linear barcode and human readable number on side for inventory control in bulk, quantity of 5 cases (480 tubes per case).
· CLIN0004: Option to purchase additional racked 1.5mL cryo tubes, capped, sterile, external threaded, 2D barcode on base, 1D linear barcode and human readable number on side for inventory control in 48-format rack, quantity of 2 cases (10 racks per case).
· CLIN0005: Option 4: Option to purchase additional racked 1.9mL cryo tubes, capped, sterile, external threaded, 2D barcode on base, 1D linear barcode and human readable number on side for inventory control in 48-format rack, quantity of 2 cases (10 racks per case).
OPTIONS FOR MAINTENANCE SERVICES (OPTIONS 6 THROUGH 9):
Base Year: 12 months from the date of award;
Option Year One: Begins one year from expiration of base year;
Option Year Two: Begins one year from expiration of option I;
Option Year Three: Begins one year from expiration of Option II.
· CLIN0006: Firm-Fixed Price (Base Year): Maintenance Agreement inclusive of one (1) onsite preventative maintenance visit, emergency visits, all parts, labor, travel, and per diem, in accordance with the specifications set forth in the SOR $__________________total firm-fixed price.
· CLIN0007: Firm-Fixed Price (Opt. I): Maintenance Agreement inclusive of one (1) onsite preventative maintenance visit, emergency visits, all parts, labor, travel, and per diem, in accordance with the specifications set forth in the SOR $__________________total firm-fixed price.
· CLIN008: Firm-Fixed Price (Opt. II): Maintenance Agreement inclusive of one (1) onsite preventative maintenance visit, emergency visits, all parts, labor, travel, and per diem, in accordance with the specifications set forth in the SOR $__________________total firm-fixed price.
· CLIN0009: Firm-Fixed Price (Opt. III): Maintenance Agreement inclusive of one (1) onsite preventative maintenance visit, emergency visits, all parts, labor, travel, and per diem, in accordance with the specifications set forth in the SOR $__________________total firm-fixed price.
1. Any award resulting from this solicitation will contain the following statement: “The Government’s terms and conditions, identified herein, shall be the prevailing terms and conditions governing this award. In the event of a conflict between the Government’s and contractor’s terms and conditions, the Government’s terms and conditions take precedence.” If the Contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:” [Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the Contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor’s acceptance of the Government’s terms and conditions for inclusion into the resultant award as prevailing.
2. Contractors shall provide an active DUNS# for the System for Management (SAM) registration.
3. If the Contractors representations and certifications in SAM.gov do not reflect the NAICS code governing this solicitation, the Contractor must submit documentation that they are a small business under the NAICS code governing this solicitation.
4. A completed version of all required solicitation provisions (see attached provisions/clauses document – required submissions highlighted in blue).
Please note that this procurement IS NOT being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If a contractor submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the contractor’s FSS or GWAC contract, and the statement required above shall be included in the quotation;
DUE DATE FOR QUOTATIONS
All quotations must be submitted via e-mail to Tish Walker, Contract Specialist at latish.walker@nist.gov Submission must be received not later than 11:00 a.m. Eastern Time on Tuesday May 19, 2020. A quotation shall be considered received when it is received in the electronic inbox of Tish Walker not later than the date and time identified herein.
All questions regarding this notice must be submitted via e-mail to latish.walker@nist.gov by a week prior to the solicitation due date. Questions submitted after this date may not be addressed by the Government prior to the quotation submission deadline.
